OMAR LUCIO ADMITS POLICY WAS IGNORED IN KILLING

BROWNSVILLE, Texas (AP) — Detention officers did not follow sheriff's policy when an inmate being transported to a dental appointment overpowered his guard, escaped, and killed a man before being fatally shot by police, a South Texas sheriff said Friday.

Two guards are supposed to transport an inmate, Cameron County Sheriff Omar Lucio said during a news conference, but only one was available Thursday to take Miguel Garcia, 38, to his appointment.

Authorities say Garcia fashioned a toothbrush into a weapon and brought it into the sheriff's vehicle, The Brownsville Herald reported. Authorities allege that Garcia somehow undid his shackles and slashed the guard in the neck when they arrived at the dental office in Brownsville, near the Mexico border. Garcia then allegedly took the guard's handgun and fled.

He swam across a creek to a residential neighborhood where he entered a nearby home and "executed" Mario Martinez, 56, in front of his wife, Brownsville police Chief Orlando Rodriguez said at the news conference.

"He just barged in and took the family by surprise," Rodriguez said.

Garcia took the family's car, authorities say, and was chased by Brownsville police, state troopers and county constables. The chase ended in an industrial park in San Benito, northwest of Brownsville, and Garcia was shot in an exchange of gunfire. He later died at a hospital.

The guard was hospitalized Friday in stable condition.

Rodriguez said there were early reports that Garcia also took an assault-style rifle from the guard but said that wasn't true.

Lucio said sheriff's officials will review department procedures to see what changes are needed to avoid such an escape from happening again. He'll likely seek additional funding from Cameron County commissioners to boost jail staff, he said.

The Martinez family is likely to sue the County for bundle of tax dollars because of the Sheriff's department screw up. Costs the Sheriff nothing, and a policy review will likely not see anyone get reprimanded...A fish stinks from its head and in this case the Sheriff is the fish head.

Could the employee have complained, could he of gone to his superiors and said hey " this is against policy" does sheriff Lucio allow his employees to do that? What kind of environment do the superiors at CCSO create for subordinates?

What a joke press release from the Sheriff. He talks about manpower shortage but yet he has two jail commanders driving around in unmarked expensive trucks and ford expeditions performing personal agendas. Sheriff you need a change in administration within the jail and start with your useless chief jailer. Comon sheriff do the right thing and leave with dignity as a good law enforcement official.

They say that confession is good for the soul, but it does not turn a cluster fuck into a simple mistake. This is a total failure of supervision, on every level by the SO. There were layers of neglect and negligence for this to occur.

This being Browntown where compadrismo and palaca replaces professionalism, nothing will change but the insurance rate of the city liability police and a tax increase to pay for it.

As long as the voters accept this kind of shit as normal and natural, we will continue to be the US capitol of ignorance, poverty, corruption, incompetence and negligence.

With all the forfeiture monies that he has gotten from drugs and so why, why in heavens name has this so called lame of a sheriff still not have enough backup? Enough of the old man. An innocent victim in his own home gets "KILLED" because of his incompetence. The victim was not armed, unlike one of his own policeman. The intruder, got a weapon,( that he himself designed in jail), undid his shackles, only one police officer escorting him to a "PEDIATRIC" dental facility, too many stupidities. These stupidities cause an innocent victim his life. Question should be," was the murder even shackled?" Was the murder padded down to check for weapons?", before he was transferred. Either this old man is owed a lot of favors to continue his incompetence or what the hell. Like they "LIFE IS A BITCH" old man Lucio

Old man Lucio is a poor excuse as a sheriff. He claims that an innocent victim home with his family got killed by one of his prisoner because of lack of man power. With all the forfeiture money that he gets for his department, and the toys that he is allowed to spend on his department and his lame excuse is "LACK OF MAN POWER". First of all it seems like the trouble stated in his jail. Before the murder is even on the road trip. The murder is armed, the murder is either not properly shackled or not shackled at all, broken protocol, as to having "TWO" police escorts, to transfer murder to "PEDIATRIC" dentistry. He claims that the doctor dentist makes appointment to see more than one prisoner to make his visit worth wild. This is poor excuse for the death of innocent victim, who was home enjoying a meal with his family.

These are the facts, The county gives the Sheriff Dept. $500,000 yes (half a million) in overtime, source: Auditors office, they can get the help to send two jailers. Second, his own staff is saying the prisoner had no shackles, third, the county is getting more and more urbanized so there is no need for more deputies since the county is losing land to cities so where do you patrol Lucio? Time to retire and PLEASE, why do they let him alone during press conferences, I didn't think San Benito High School taught OK, OK, OK,OK, language where Lucio went to school. But I guess its better than smelling Gus Reyna's beer breath. Ya Vamonos guys, your time is finally up!!

It happens all the time with Cameron county, previous vehicle accidents get paid, no employee is charged, reprimanded or fired? Great place to work with Cameron county, no one ever gets fired, lots of benefits plus health insurance too. lol

And if we can't provide for our veterans who gave their service to protect us and not kill us, why should we have to contemplate esos babosos que no valen para nada. the Martinez family and I wish I were a personal injury lawyer so that I could donate my time to sue the hell out of Lucio and the county. Come on, one of you legal advocates, imagine what you can do for the family and not charge them for anything, not even a contiguency fee. Andale, Gamez, go

I remember the days when the Anglos were in charge, running everything and getting most of the money. We didn't like that and told them, through the ballot box, to back off and let us run things. Now we run things and get most of the money. Big improvement right?

Browntown is has the highest poverty and lowest education in the country. How can this be after 40 years of running things and taking care of our own people? Could it be the Anglos were not the problem? Could it be that we were and are the problem? This is a hard question to ask, but it needs to be asked. If this town we love is to work for the people and not against them, we need a level of honesty not shown before.

Quite frankly, the Anglos did a better job of taking care of the Mexicans, than the Mexicans have done taking care of themselves. Own it vatos, for it is the truth!
