ACCION AMERICA: BISD'S JOE RODRIGUEZ MUST GO


Accion America Calls For Termination of Athletic Director Joe Rodriguez

On September 23, 2008, allegations were brought to the Area Superintendent of Operations, Brett Springston, the initial investigation centered on inappropriate use of District vehicles, equipment and personnel, and consumption of alcohol at the 17th Annual Student Scholarship services Golf Tournament. This report was presented to Yolanda Gavito by Lissa Fausto and Olivia Rodriguez.
The finding of this first report found that the allegations of inappropriate professional conduct had merit. The allegation of alcohol consumption also had merit. The allegations concerning "other Athletic Department issues" made by employees against the Athletic Secretary and Coworker had merit. The report found extensive violations of BISD policy.
A second internal report conducted on December 2, 2008 by Margarita Pizano-Flores, Lead Internal Auditor for BISD, found non compliance with the following District Policies:

Purchasing and Acquisitions
Employee Standard of Conduct
Employee Standard of Conduct Standard 1.2
Assignment and Schedules
Gifts and Solicitations
Relations with Parent Organizations
Unauthorized Use of equipment
Fundraising by outside Organizations.


The report also strongly recommended that compliance be resolved as soon as possible.
The report found that the Student Scholarship Services Foundation was in existence for 17 years, but was able to identify financial records from 1994 to 2008.
After careful and extensive review, the lead auditor issued the following violations of BISD Policy:

Utilizing the District Tax ID for purchase made ( Violation of federal tax laws)
Using athletic Department Employees under his supervision to conduct fund raising activities.
Falsifying time sheets (violation of Department of labor laws, a felony offense)
Utilizing District equipment including kitchen equipment, district vehicles, district fuel and district office equipment.
Not following District Fundraising activities
Charging rental fees

The report also identifies a relationship between Johnny Cavazos and the Athletics Department,

Footnote: Johnny Cavazos has been prominently mentioned as a alleged silent partner in the $38 million insurance contract awarded to Mutual Assurance.

The report also uncovered prepayment of $8,781 that lacked supporting documentation as advanced funds.

Payment to La Quinta in Olmito, Texas on several occasions, both were personal use and not a business related expense.

The report also alludes to questionable practices and unusual purchases that will be reported in a separate report.

Accion America is asking this of BISD Board Members.

Why did the 4 Board Members and Miguel Saldana sue the Attorney General to suppress this report that shows criminal activity and fraud.

Why is this employee is still employed by BISD.

Why this matter was not turned over to the Cameron County District Attorney of United States District Attorney to determine if any laws were violated.

Why the report states that no Scholarship were Awarded under the name Student Scholarship Services Foundation.

Why was BISD Tax ID used for outside organizations with no relationship to BISD.

What is the relationship between Joe Rodriguez, Johnny Cavazos and Rick Zayas who went to law school with Joe Rodriguez's son.

Finally, Accion America questions the disparate treatment given to Hector Gonzales, who was fired and who was not charged with any illegal criminal activity and or personal abuse of funds.

The reports disseminated today merit the immediate termination of Joe Rodriguez and a full scale criminal investigation to determine if there was any collusion and attempt to hide criminal activity by Board Members Rick Zayas, Rolando Aguilar, Ruben Cortez and Joe Colunga.

You do a great service - tolerance of these things just gives more control to the government at the cost of our freedoms.
How can we expect a fair shake with any administration that allows the tax money that is extorted from us, to be stolen or otherwise misused, rather than to be directed to the purpose intended.
It seems that new programs are merely to provide new opportunities to steal from "We the people". We tolerate it so we are the suckers!

WHY DIDN'T THE BD MEMBERS REFERRED THIS REPORT TO LAW ENFORCEMENT, IF JOE ROD FUDGED TIMESHEETS AND DID ALL THIS,PUT HIM IN JAIL.

Joe Rod wouldn't have a time sheet but those who work in his office would as certified personnel and admistrators are not hourly employees.

Mr. RRun RRUN is the photo that is next to Joe Must Go an endorsement from Dr. Escobedo that he agrees that corruption at BISD must come to an end, along with the corrupt commissary contract that was awarded to the 2 BISD Board Members and now a public bid contract.

If it is an endorsement he has my vote
