RUBIO'S DEFENSE WANTS EL RRUN-RRUN'S TAKE ON VENUE CHANGE MOTION

By Juan Montoya

Mar 12
Mr. Montoya,
Would you be able to testify on venue issues on March 25, 2010 at 10 am?
Thank you,
Ed Stapleton

We received that Email from Ed Stapleton, one of accused child murderer John Allen Rubio's defense attorneys after we posted an article on our blog about his upcoming re-trial.
A local jury had just declared him competent to stand trial for the horrific murders and decapitation of three children – one of them his– and the court was now considering his motion for a change of venue claiming he could never get a fair trial in Cameron County citing the widespread publicity given the notoriety of the case.
In our post, we quoted a local 14th St. denizen who expressed her disdain for Rubio in no uncertain terms and expressed her desire to have him executed as soon as possible.
Other commenters on other blogs have said the same thing (Brownsville Voice, March 5, for example) "This is the same reason that i agree with you here. I do believe that Rubio is whacked, but I don't think that it restricted him from understanding and appreciating the wrongness of his actions.," stated a commenter with the initials TB.
We really don't know what we could contribute to the court's deliberations, but if it helps to finally put this case to bed and stop the hemorrhage of public funds being spent to try this convoluted case, we can do nothing else but comply with Ed's request.
From the outset, I will tell our readers that I am not a supporter of the death penalty. But if I was, I agree that if any one case warranted the maximum penalty, this is it. For my liking, shutting this man in a jail cell with other killers, thieves and rapists for the rest of his life would suit me fine.
A change of venue hearing is probably not the place to weigh in with your opinion on capital punishment, however. So for now, Ed, take this missive as a "yes" to your question.

I hope they move the trial to Houston, or Kerrville, Maybe the Dallas area or Waco area, just as long as we don't have to see this looser on tv or the newspaper.
