Despite a full-court press from the Texas Southmost College (read Juliet Garcia) administration to approve the partnership agreement between the college and the University of Texas System on Thursday, a majority of the trustees remained steady and extended the deliberation period for one more month.
And even after each trustee assured the audience that they were not out to dissolve the partnership but rather to modify it to get local residents a more even-handed deal, the administration's strategy soon became evident.
The administration pulled out all the stops and sent in the troops that included heavyweights like IBC president Fred Rusteberg and Chamber of Commerce diva Reba Cardenas-McNair and all the usual suspects (even a priest), plus a student whose teary performance was worthy of a drama award.
They all voiced the same message: Please don't dissolve the UTB-TSC partnership.
In fact, trustees Robert Lozano, Robert Robles, and David Oliveira went as far as to suggest that if the majority didn't approve the contract on Thursday, then they should schedule a special meeting within the next two weeks to ink the deal.
Lozano's and Robles' performances – despite a local blog's mistaken take on the subject – were especially pathetic.
"You could see that they were at the command of Garcia with their statements," said a participant. "Robles even made the motion that the board take action on Oct. 21."
The majority opted to take a month to study the proposal and put the accord before the community, who in the end will have to bear the burden of funding the agreement for the next 80 years.
TSC counsel Dan Rentfro, who is representing the college district in negotiations with the UT System, had demanded that the trustees sign on Thursday and said the UT Regents were expecting the accord on their desk in that time.
However, inquiries made by some trustees revealed that when UT Chancellor Dr. Francisco G. Cigarroa was contacted, he said that the pressure to pass the agreement with but cursory examination by the community was not coming from Austin.
"He said that it was his understanding that 'that's what you guys wanted,'" said a source close to the board. "So the pressure is not coming from Austin. It's coming from the TSC president's office. Juliet wants to be able to do whatever she wants without having to get approval from the board."
With the only public presentation of the agreement scheduled for Oct. 4, it would have meant that there would have been no public input into the agreement from the residents and taxpayers of the TSC district if it had passed Thursday.
The majority of the trustees have expressed their concerns about some aspects of the report. Some say they are troubled by the gobbling up of the community college (and all its assets including bank deposits, real estate, and buildings) by the new UTB-TSC entity. At the same time, while the UTB-TSC monster swallows up all the goodies, the only reason to maintain the college district is to be able to incur debt in the form of bond issues and property tax income.
"Our trustees have to realize that what they do with this agreement will be the legacy they leave to the community," said an observer. "Do they want to be remembered as the board that stood by and destroyed our community college? Or do they want to be remembered as the board that stood up to Juliet and her sycophants and demanded that our residents and students get a fair shake?"
Among some of the clauses found objectionable by the majority are:
"The partners contribute resources, including land, buildings, equipment, bank deposits, investments, and other assets to set up UTB/TSC, for the use and benefit of the new entity.
UTB/TSC assumes the outstanding liabilities associated with these assets and the previous operations of UTB and TSC, except that UT System and TSC remain liable for its bond debt."
Nowhere is there any clarification if this includes the more than $10 million in rent arrears that the UT System has incurred and has refused to pay the local taxpayer.
There are other parts equally objectionable such as:
* "Authority: The UT Board of Regents, as the managing partner will manage the business and affairs of UTB/TSC on behalf of the Partnership, except for (1) major organizational divisions which require consent of both partners, and
(2) day to day operational decisions, which are vested in the administration of UTB/TSC.
*The agreement calls for the president to be selected and appointed not by the local board, but by the UT Board of Regents. The TSC board will be allowed to "advise " the Regents, including discussions of the final candidates in a joint executive session. In other words, in secret.
*The president will be an employee of UTB/TSC and may be removed (only) by the Board of Regents.
*"Other Officers of UTB/TSC: The President may designate and remove other officers and assign them duties and powers as needed for the management of UTB/TSC.
In other words, TSC is being asked to turn over all its real estate, buildings, assets, bank deposits, etc., and to continue as a taxing entity with the ability to issue debt.
In return, the college has a minority voice (they can advise and discuss) in the final selection of the president (Juliet, we assume), and she will have unbridled authority to hire, promote (and fire) whoever she wants.
Nowhere is there is any mention of including the UTB/TSC under the millions generated from oil and gas leases for the Permanent University Fund that is accessible to other UT and A&M Systems schools.
There is also a continuation of the so-called "trustee scholarships" available to district residents instead of in-district tuition. During the last elections, we learned that UTB/TSC was the only community college that did not offer these in-district tuition to all its residents in the district.
As a result, local students pay higher tuition and user fees than anyone in the state.
It has become abundantly clear to everyone concerned that it is not the UT Regents that want these agreement in its present form. It is Juliet Garcia and her coterie of favorites at the college that want it and are pressuring the trustees to railroad it through over the legitimate interests of the local residents who will foot the bill.
(Note to trustees: Say no, Hell no to the agreement as it stands. We didn't elect you to represent the interest of Juliet Garcia and her lackeys. We elected you to represent us. Get on with it. We're behind you if you do what's right.)

It appears that several of the TSC trustees (Lozano, Robles and Oliviera) continue to prove that they are pawns of Queen Scorpiana and not public servants. These guys, handpicked by Juliet, continue to do her bidding. It appears that they are puppets (no brains and willing to allow Juliet to speak for them) and have forgotten any need to open this up for public discussion. Maybe Mark Sossi is their legal advisor...advising them that the voice of the public is bad and should be contained...limited.
Again the public is not served well by elected officials who disregard and avoid public input and, in the case of TSC, work to serve the Queen not the taxpayers. Dictatorship "uber alles".....Hitler would be proud.
Seems that Juliet is so afraid of the changing face of the TSC Board of Trustees that she is working to save her ass....by working for the state to eliminate public and local control of TSC....and turn local assets over the UT Systems....who owss TSC millions of dollars. So, instead of UT paying up....Juliet now wants to turn over local assets...land, buildings, etc....over to UT. Doesn't seem smart of logical, but she's trying to save her power and control.

Mr. Montoya or someone who can explain things in plain simple layman terms, would you please interpret all this for us? Does Julieta want to give TSC away to UT? Would that mean that TSC would no longer exist? Who has given her this power? Who has given the board members this power? Why does the Brownsville Herald not have this story for all of us to read in their simple language and misspelled words? I read and reread and find it hard to believe that this is happening under our nose? Where are Fernando Ruiz, Dagoberto Barrera, Roman Perez, Robert Uresti and Alex Resendez? They need to go chew their heads off with their "vocallities." Que pasa contigo, Juliet?

the only beneficiery of this deal is juliet, not the students. ut system is getting a university for free. tsc should sell utb to the ut system and use the money to revamp the community college. as its stands now, the ut system blesses us with the ut stamp for the buildings and diploma.dont blind yourselves with the number of students , grants,highereducation,we could do that ourselves without the stamp.its the ut alumni sucking up to the system to make themselves look good (oliviera).partnership is a partnership, this is a takeover.
I would like to know what action the city can take to collect the 10 million dollars in taxes owed to the city. If someone can let me know, I will drive that force for the betterment of the city.

Watch the replay of the last two TSC Board meetings. It will tell you all you need to know about what a government in disarray and confusion looks like. Unwilling to do its job to act for the people, the board now seeks to ask the public to decide for it. They extoll the virtues of the partnership and the chairman cries, "Long live the UTB TSC Partnership", but then they act in ways that show a plan to split. Who's name on the library books, whose money in the endowment funds...all sound like someone about to take his ball and go home.
Obviously, the board doesn't know what it wants, doesn't have the leadership to suggest a future, lacks the discipline and courage to do the board's work and simply sits down and waits, hoping someone will do something.
This is a poor excuse for governing. Here's another note to the board: Don't just sit there; do SOMETHING! If you don't like the administration, get your own! If you believe your 'fiduciary duty' is to the taxpayers, rather than to students, cut the tax to zero! If you don't think the people want to support UT, then get out of the deal. Do SOMETHING! Or get the hell out of the way and let them run the university.
Stop fawning and whining. It's embarrassing to watch...

It's 16 pages of contract. It's in simple language and takes about half an hour to read carefully.
It makes you wonder why it would take any one four months to.
Charlie, I am sure you would use the 10 million dollars in taxes for "your" sports park. All that money you wasted on it could have been used for drainage in Brownsville. Neto Gamez should go after you, or is he one of your coharts?

In the past years that Dr. Garcia has been president of UTB-TSC, it has grown in immensely in a very positive direction. From the beautiful performing arts center to the distinguished lecture series programs, to the stopping of the building of the border wall on campus...
Where in this time period has there been a negative decision made that poorly affects our community? None. Therefore, why do you people want her out? It makes no sense to me. WHERE in this contract does it say that the trustees will loose power? ?
If the partnership is broken, Brownsville will have to TRIPLE the taxes in order to keep TSC alive. Last time I checked, NOBODY wanted their taxes raised!
For you who said that there are respective board members under the rule of Dr. Garcia, maybe they are simply able to see the big picture with their common sense and see that there is nothing wrong with UTB-TSC.
The idea of breaking the partnership is absolutely radical!

To have the President of the Student Council in tears as well as other prestigious faces around Brownsville is no joke!! Obviously, there are many people supporting the partnership for essential reasons. Did anyone other than certain board members speak AGAINST the partnership?? Wake up board members!!
Who is more qualified to run our university? The proven success of Dr. Garcia's administration or the questionable judgment and hidden agendas of the amateur board of trustees, it's a no brainer.
No One spoke against the partnership agreement. EVERYONE SAID IT IS A GOOD THING. It is just how much are we as taxpayers willing to give UP.
What happens when Dr. Garcia gets a better position and leaves. Is everyone going to be OK with an outsider taking your taxes and not being accountable. LISTEN DO NOT JUST HEAR THE SPIN
Get rid of TSC. Get rid of taxes. Get rid of remedial education. Get rid of Kiko Rendon. Get rid of all the Trustees.
Sounds like a personal problem with Kiko Rendon. The Trustees would be glad to leave their positions if UT would take over and there would be no more taxing district but, that is not what they want they want to keep the taxpayers as their slaves/ Wake up
