What is the issue with Brownsville Independent School District board chairperson Caty Presas-Garcia and why is she being sued by Joe Rodriguez?
The answer is very simple.
She took two audit reports that contained some very disturbing stuff and took it to the District Attorney, as it is her duty to do so. Is the Rick Zayas/Bobby Wightman/Brett Springston trio suggesting that she should have ignored this disturbing behavior? The results of the investigation reveal non compliance with the following district policies and procedures.
In layman's term they were:
*Falsifying time sheets,
*Illegal use of BISD 501-C 3
*Knowingly using Athletics Department employees under his supervision to conduct fundraising activities during district compensable time
*Utilizing district equipment and supplies for non profit organization use
*Utilizing District Fuel
*Using BISD equipment, sound tables and chairs during the golf tournament event.
The report states that "Vendors that have diligently contributed for this special event include Cavazos Insurance.
It mentions that "several of the students were asked to wait to cash their checks because of insufficient funds" and notes that "documentation shows outstanding payments in the amount of $8,781 as of July 7, 2008 lacks supporting documentation." Further, it also shjows that invoice #6150351 from La Quinta in Olmitos and #6150259 were charged to BISD even though Joe Rod did not use these hotel rooms for BISD business. It was for some unexplained personal purpose.
*Questionable practices purchasing shirts
*Unusable purchases were noted (Athletic Department Investigation Part B)
The Fausto Reports reportedly found possible violations of labor laws and several witnesses reported possible misappropriations of monies.
The audit reports contain sworn testimony from employees who state they saw what had happened. They verified wrongful and potentially criminal behavior.
The auditors stated that several issues were severe and pervasive, specifically, that they admitted to committing fraud and falsifying time sheets.
Workers complained of discrimination and retaliation and about harassment working on the fundraiser
They also mentioned several safety concerns and about inappropriate use of funds and a maintenance employee admitted taking a picture of a BISD employees washing Joe Rods car.
It talks about fraud being committed on the Harry Odom contract to assemble and install lockers, instead of Mr. Odoms firm doing the work. An employee confirmed that he was paid $100.
Must we go on detailing all the potential wrong doing?
Carebrownsville did not perform the reports.
Two BISD auditors did them reports at the request of Brett Springston.
So now some discredited blogger makes Caty Presas into the bad guy, when she did what every other the other trustee failed to do – report this behavior to law enforcement to determine if any laws were being violated by BISD employees.
Where was Chief Oscar Garcia? Was there an investigation?
No. Instead of being investigated, Joe Rod received $90,000 in goodbye money, $40,000 more, incidentally, than what it is costing to defend her for exposing these instances of potential wrongdoing by the guy who is suing her.
What is he trying to hide? There should be no doubt in anyone's mind Brett Springston has very dirty hands and we welcome any lawsuit by him. Truth is the best defense to libel.
We will not be intimidated, extorted or coerced.
The Brownsville Herald had the right (though belated) idea filing the motion to have that disbarred lawyer who is in cahoots with Rick Zayas and Minerva Pena as a vexatious litigant and deny him access to Cameron County courts.
Our recommendations for Tuesday: Get rid of Springston. Investigate him and see how he will tell the whole truth and nothing but the truth. We assure you he will sing like a canary, most of them do.
Look at Item 21, Joe Colunga Agenda Item is a smokescreen to hide the fact that Johnny Cavazos and his cronies will once again get that lucrative insurance contract. It is not about the Healthsmart, after all. It is about the insurance money for your benefactor Cavazos, isn't it Joe?
