BISD EXPLAINS RENDON SETTLEMENT

BISD News Release

The following facts are important to understanding the Board’s actions to approve settlement in the lawsuit by Art Rendon.
The action to end Mr. Rendon’s employment with BISD in 2010 came from a divided Board vote. BISD’s lawyers in this lawsuit, after months of investigation and discovery, recommended the Board settle on the terms that it did. The district’s insurance company, which provides a policy applicable to many employment lawsuits, selected these lawyers as is its right under its contract with BISD.
This contract makes BISD responsible for the first $50,000 in cost, fees, or damages in a lawsuit, and the insurer is responsible for the rest subject to certain exclusions and policy limits. However, this financial cap is lost if BISD rejects a proposed settlement agreed upon by the insurer and the other party, and the case then proceeds to a point where cost, fees, and awarded damages exceed the proposed settlement terms. The district, not the insurer, is then responsible for the dollars beyond the proposed settlement amount.
The school district will always choose to cooperate with its insurer when it is in the best interest of BISD. This includes not exposing tax payers to potential significant dollars by rejecting a recommended settlement. BISD also cooperated in this suit by agreeing to re-employ Mr. Rendon at the same level he previously held subject to his complying with all BISD policies and procedures in the same manner as other employees.
Brownsville ISD faces a couple other lawsuits from former high level administrators that arose from divided Board actions. The lawyers assigned by the insurer to defend BISD and also BISD will take an aggressive and prudent position to safeguard tax payer dollars. The district is strongly committed to defending claims while diligently safeguarding local tax funds.

Nice to see no comments for this story. BISD/Zayas, Cortez, Augilar and Colunga tried a power play and got their butts handed to them......never met any of them including Rendon but they got stuffed....employees have rights. I have been reading about this story for two years. It's over!

You didn't know anybody? I can tell you, you don't know much either! It's not over, it's starting all over again. They are now giving him a new department to screw-up! BISD may have had to listen to ACE about the money laid out, but since when was ACE authorized governance as to who to hire??? Somebody is feeding us a bunch of BS! What kind of sick minds allow this to happen??? Wow, I wish it was 2012 already! I mean ALREADY!!!!!

I agree it’s not over, we the Tax payers will eventually foot the bill to pay this Rendon (Muerto de hambre) Work for your money like the rest of us pinch pelon! Lets vote all these idiots out next election. Especially the likes of Presa-Garcia with her bird beak nose! and Minerva something the one with the bangs that looks like a tarantula is crawling down her face…perfect for Halloween!
