WHY DO FEDS WANT BLAYLOCK OUT OF LUCIO CASE?

By Juan Montoya
Does Assistant U.S. Attorney Michael J. Wynne want to recuse most to the members of the Cameron County Bar Association (and some from Hidalgo) from participating in the defense of some of the principals in the Armando Villalobos-Eddie Lucio racketeering trial?
Wynn told U.S. District Judge Andrew S. Hanen that he was reserving the right to introduce into evidence during the Lucio trial a 2008 audio recording between Lucio's defense attorney John Blaylock. The recording is reportedly a conversation between Blaylock and Limas about Limas’ campaign. Limas voices concern about re-election, the local daily reported.
“I can’t rule it out,” Wynne said.
Blaylock, known as a bulldog in local legal circles, correctly interpreted as a subterfuge by the government to  remove him from the case. Local legal observers say that if the government achieves its goal, it would remove Blaylock and Lucio will have to be replaced by another attorney who would have to play catch-up defending the accused.
"It's like forcing the opposing team to change quarterbacks before the big game," said one. "Obviously, Wynne doesn't want Blaylock on the defense table."
It would be hard for Lucio to find a local attorney with whom Limas did not speak to about his election with formidable campaigner Elia Cornejo-Lopez, the current 404th District judge. Every election she has been in has been a bare-knuckle, no-holds barred event. Limas probably spoke about his concerns with more than a score of attorneys as he solicited funds from them for his campaign.
Who, among those listed below, could pass Wynne's litmus test and defend Lucio?
The following attorneys made contributions to Limas and were listed in his campaign contributions report for the 30-day period (January 1-24) before the 2008 election against Cornejo-Lopez:

Barrera, Horacio (Mr.): $1,500
Benavides, Gilberto (Mr.): $1,000
Bonner and Bonner: $500
Denton Navarro Rocha and Bernal: $250
Esparza and Garza: $1,000
Garcia and Martinez: $2,500
Garcia and Villareal: $2,500
Graham, Joseph (Mr.): $750
Hemphill, Paul (Mr.): $200
Hinojosa, Fred (Hon.): $500
James, Tony (Mr.): $500
Law office of Bruce Tharpe: $2,500
Law office of James Belton: $500
Martinez, Tony (Mr.): $500
Pena, Ruben (Mr.): $1,000
Perez, Frank (Mr.): $500
Rodiguez Colvin Chaney and Saenz: $1,000
Rodriguez, Reynaldo (Mr.): $2,000
Rosenthal, Mark (Mr.): $1,000
Royston Rayzor Vickery and Williams: $1,000
Rubane, Rebecca (Ms.): $800
Sweetman Sabo and Toland: $200
Vela, Manny (Mr.): $1,000
Vidaurri Lyde Gault and Quintana: $1,000
Villareal, Javier (Mr.): $2,000
Watson, J. Lynn (Ms.): $2,000
Whittington, Randy (Mr.): $500
Williamson, John (Mr.): $1,000

If we were to go back to the prior reporting period, we would undoubtedly find the other half of the attorneys practicing in the local courts among those making contributions who had discussed Limas' concerns about the election. Does Wynne have recordings of them, too, and is awaiting to pick who to have as an opponent?
The Brownsville Herald reported that "Blaylock said playing the tape was an attempt by the federal government “To injure me.” He said it was like “striking my client over my shoulder. I haven’t done anything wrong.”
Hanen requested that all parties involved attempt to reach an agreement by Feb. 8 as to whether the recorded conversation between Blaylock and Limas will be played at the trial.

"I have done nothing wrong" is a statement that almost no lawyer can truthfully make. Sounds like a version of "I did not have sex with that woman" said by Bill Clinton. Blaylock is a player in the local "injustice" system and has played on both sides...as an assistant DA and a plaintiff's attorney. He has run for political office and that classifies him as "political". I am sure there are many local attorneys who didn't have phone conversations with "Disable" Limas during his campaign. Lucio chose Blaylock because of his knowlege of the local "system" and because he is a "player" in the local "injustice" system.

there are plenty of local lawyers that have not contributed to Limas or talked to him in private or ex parte

With the history of Cameron County going back to the days of Ray Ramon, why would anyone believe you can find an attorney who has not been touched with the Camval County way of doing things. Didn't Blaylock work for the feds once?

Perhaps Lucio hired Blaylock because he's good at what he does, that is mount a good defense for his clients. Sounds like Wynne can't outsmart Blaylock in the courtroom, so he's trying to remove him as defense counsel...

I have to fully disagree with you on this one. I case you do dont know its really hard to ever beat the feds when you go to trial against them because they get to cherry pick the cases that they want to prosecute and because all laws and court rules are written and adopted to their benefit. But the prosecutions move to disqualify John Blaylock from a case especially this case is a game move. You see, John Blaylock is known and has proven himself an effective and damn good attorney and prosecutor. Dont forget he had back then county commissioner Tivi Valencia convicted by a jury trial. But as a defense attorney he has gone against the federal prosecutors during jury trials and has actually beaten the feds in many federal cases. These cases were tried and his clients were aquitted by federal juries. Two of those clients were U.S. Custom Agents who were accused and tried by the feds for bribes. It is known in the legal circle that Blaylock has beaten the federal prosecutors in cases in federal courts many more times than our legal eagle wanna bes like Ernesto Gamez and Juan Magallanes. Blaylock has proven he can beat the feds and I think that the federal prosecutors move to remove him from this case shows that the feds are scared of losing to Blaylock. Gooo Blaylock and beat the feds

I say to the Feds, leave John Blaylock. He hasn't tried a case during the Villalobos administration because he did work for him, about six months. But, he did get whatever he wanted from his buddy, Villalobos on any cases he charged ridiculous rates and fees for, OOPS! The cat is out of the bag! John Blaylock is such a "shark" that there are numerous complaints about his lack of representation to his clients BUT he sure does make sure that they put up money first before he scratches his balls. Now, the question is? How much is Eddie Lucio (no relation to the other elected suspected crooks) paying John to defend him? Because John Blaylock does not do anything without money in his hand. Ask anyone who was or has been a client!

EITHER WAY.....ANYONE HAVING ANY TYPE OF RELATIONSHIP WITH LIMAS PROFESSIONALLY OR NOT IS TAINTED...AND IF THEY WANT TO PRESERVE THEIR REPUTATION...THEY NEED TO STAY AWAY!!! I CAN SAY THAT THE DEFENSE ATTORNEYS MAY HAVE NO CHOICE BUT TO PRY INTO OR OPEN DOORS OR MATTERS THAT WOULD BE FAVORABLE TO THE PROSECUTION....ONCE THEY OPEN UP THESE DOORS...IT BECOMES PART OF THE RECORD....AND ALLOWED TO BE QUESTIONED BY THE PROSECTION. THESE DEFENSE ATTORNEYS ARE GOING HAVE TO BE VERY CAREFUL WHAT THEY ASK AND OR HOW IT IS ASKED....BECAUSE IN THE MARCHAN'S CASE...THE DEFENSE ATTORNEYS OPENNED UP DOORS ALLOWING THE PROSECTION TO USE...AND BECAME RECORDS...AND OPEN TO THE MEDIA...AND THE PUBLIC...FOR EXAMPLE NAMING MORE PEOPLE RELATED TO THE CASE..IF THE FEDS HAVE A CASE...THEY HAVE CASE....LETS SEE WHICH WAY THE BALL ROLLS!!!

This is not a level playing field. It is advantage feds. If the built in advantages are not enough for them and they are trying to remove the defense attorney because they fear he is too competent, shame on them. More proof that they have lost their way and allowed it to become about winning and not about justice. If this is true they have it in common with the lawyers they are prosecuting.

"Because John Blaylock does not do anything without money in his hand"

Don't we all? Show me someone who does not work for money and I'll show you a poor person.
