ON A DOMESTIC FLIGHT, CAN BORDER PATROL DEMAND CITIZENSHIP ID?

On Tuesday morning, Nancy Morales and Omar Figueredo were arrested by Brownsville Police officers after they both refused to answer questions regarding their citizenship status made by Border Patrol agents at the Brownsville airport.
We believe that this illegal arrest, though carried out by the Brownsville Police Department was essentially a favor to the Border Patrol agents who had no authority to arrest them or to force them to answer any questions. Omar and Nancy had made it perfectly clear to the Border Patrol agents that they were willing to present their identification and boarding passes to the TSA agent without need for any further harassment by the Border Patrol agents.
When it was clear that the Border Patrol was not going to and could not arrest them, and that there were no legitimate charges that could be levied against them, the Brownsville police stepped in, instead, and arrested the two without any justification.
For standing up to the Border Patrol and asking questions, Omar has been charged with failure to identify himself (Class A misdemeanor), obstruction of passageway (Class B misdemeanor) and resisting arrest (Class A misdemeanor). Nancy has been charged with interference of public duties (Class B misdemeanor) for simply asking questions.
We believe that these are all bogus charges. We believe that to have a Border Patrol agent stop all passengers boarding a domestic flight after never having left the country constitutes a form of harassment that borderland dwellers, whether documented or undocumented, constantly endure in their daily lives. This practice of forcing people to answer unnecessary questions through intimidation and fear must be resisted and stopped. Nancy and Omar were totally justified, both morally and legally, in their actions, and we commend them for standing up to the Border Patrol's racial profiling and harassment, not criminalized and charged. For this reason, we believe that all charges stemming from this interaction should be dropped immediately.
We can make this happen if we generate enough calls to the local District Attorney of Cameron County, Luis Saenz, who has the power to drop these charges and refuse the case.  live-streamed videos

It they can't identify themselves at an airport....then they are culpable and the BPD did the right thing. Anyone travelling honestly should be willing to identify themselves and show proof of their identity.

Fail to Identify is a class c misdemeanor....plus, he was not arrested for failing to Identify himself, he was charged with it after being arrested.... do some research.

Come on Juan......you are a journalist.....you know there are three sides to every story.....have you requested a copy of the police report? Have you obtained freedom of info request for airport video? How about Border patrol's report/memo? You cant make a fair unbiassed opinion based on a shoddy few second video.....

I am questioned every time I travel and I am white, I answer yes, provide my passport and boarding pass. If the questioning became inappropriate and continued, I could seek redress legally.

Read it correctly. They agreed to present their identification and boarding passes. Since when does border patrol ask for more than that? They were well within their right to not have to answer any questions.

The questions that some PP fucktards ask at the Sarita checkpoint are way out of line and intimidating. we live in the USA and should not be subjected to this type of harrassment from these racist tubs of lard....there is no basis or logic to justify their cushy jobs.....most of the time 2 are working and 1000 are raskandose la-----.

So much mierda gets past them...so obviously they are not doing their jobs.....why are drug runners caught past the checkpoints?????
That would not be happening if they were doing what they are supposed to be doing....instead of harrassing honest citizens.

B.P. has the right to ask for citizenship/identification at the airport due to us being along the border. If they were not there, persons could illegally cross into the U.S., buy an airplane ticket, and be anywhere in the U.S. by circumventing the checkpoints. Those two knuckleheads only needed to answer a question and be on their way. They wanted attention, inconvenienced other passengers, and got what they deserved!

Some of you are right, they did agree to present their IDs & boarding passes... To the TSA Agents down the line. It isn't TSA's job to make sure someone is in this country legally, it's their job to make sure people don't board with any prohibited items. We've all been subject to BP's questioning before entering the gate. What's the big deal? We all identify ourselves on the HWY up north. If we've got nothing to hide, well damn just hand them your ID. Come on! We give our IDs to the kids that work at the movies, just so they'll let us in to see an R rated movie and who te hell are they to do that? And to the bouncers at clubs, do they have some type of security clearance to be trusted with our personal information? NO. Do we complain, NO. That's probably because we're so eager to have a fun time. Well you wouldn't have such a fun time if there was a criminal on your flight that could potentially be the end of you, would you? You'd be crying and blaming everyone else for your misfortune and lack of safety. So let the guys in green, blue, black & what have you do their jobs! People don't stop to think how hard life is for those men & women, they give up SO much so that the rest of us can have a nice life. Be law abiding people, that's what it is to be a US citizen! It's an agreement that if we treat society well, society will treat us well. Did anyone see the video of this Nancy chick? She deserved to go to jail for causing the scene, bet if any of us had been there we would have felt threatened too.

Is your fucking right to refuse to give your id, there will be consequences but those two individuals made a choice. Those mother fuckers at checkpoints do give up a lot to protect us from harm, now turn your brain switch on if there is one, they chose to do that job and they do not do it for free, they are well paid. The issue is we are giving up smallbits of our freedom every day to the Federal Government. If any of you that commented on this issue are old enough to rmeber WW II , the Nazi party started the same way. Small grabs of power and taking of civil rights from the German people. If we allow the Federal Government to do these same actions , we too will be wearig stars on our sleeves. It's not the acion of the agents , they are just the enforcing part of the law. It starts with you and I standing up for EVERY US CItIZEN'S RIGHTS. If you think "Oh just answer , if you not a criminal whts the big deal" You have the right and privilage to giveaway any and ll of your rights but YOU do NOT have the right to give away mine! Also it is your right to refuse to answer the question and by law the border agent has no authority to do nothing more then ask again. They do not have the authority to arrest , detain other then the time to ask the question. You do not have to show ID or even speak to the agent.
