For the past two months, Cameron County District Attorney Office investigators has been looking into allegations that some defendants were able to skip performing community service hours for a cash payment, that illegal waivers were sold to bypass the state-mandated 72-hour waiting period, and now that some plaintiffs were promised favorable decisions by making a cash payment.
The latest scandal brewing at the Justice of the Peace Erin Hernandez Garcia 2-2 court is that a plaintiff was reported to have complained in open court during a small-claims hearing that he expected a favorable ruling from the justice of the peace because he had paid a staffer money.
Speaking on condition of anonymity, a courthouse source said that the investigation into the favors for cash case has been developed over the past two months, but that the case was actually heard months before the investigation began.
"The plaintiff complained to the court that he expected a favorable ruling because he had paid a clerk money under the promise that the court would rule in his favor," she said. "Everyone at the court – including the bailiff – heard it."
Now investigators are said to be asking why JP Hernandez-Garcia did not stop the proceedings and report the incident to law enforcement or to the DA's Office.
"Constable Abel Gomez is right across the hallway," said the source. "She could have easily have him come in and look into the matter."
Instead, it is said that Hernandez-Garcia said nothing about the matter and continued with the conclusion of the case.
"That's one of the reasons that the DA has had people in there going through the files in the office," she said.
And there's more trouble brewing for the JP in the horizon. This morning, local attorney Luis Sorola, in preparation for a Monday presentation before a church to fight a claim against a plaintiff accusing Brownsville Towing, 2581 Old Port Isabel Road, of illegally taking her car from the parking lot of the Iglesia Metodista El Buen Pastor was denied a copy of the motion with the complaint.
A court clerk asked Soroloa's assistant who wanted the copy and when she told them she it was Sorola Hernandez-Garcia's staff called her on the phone and the assistant was told in no uncertain terms that she could not have a copy.
"You won't get a copy today," the woman reported she was told.
Later, when Sorola went to the court herself demanding the copy at the window, Hernandez-Garcia personally came to talk with him and asked him to step inside. At that moment, two constables came from across the hallway and approached Sorola.
"There was no way I was going int there with her," Sorola said later. "She could very well accuse me of any number of things and I would walk out of there in handcuffs. I'll have to get it another way."
In fact, Hernandez-Garcia wouldn't even file stamp Sorola's request for a copy of the lawsuit.
If Brownsville Towing was to lose the case, Hernandez-Garcia not only has the power to assess the costs to the car owner and the church, but also to assess a $1,000 fine. If the towing company refuses to pay it, she has the further option of taking their license to operate a towing business.
"What that means is that they would be removed from the rotation for tow trucks and they'd be out of business," Sorola said. "That would mean more business for the other companies in the rotation.
Although no one is saying it, removing a tow truck business from the rotation would benefit other companies, including Peña's Wreckers, located directly across the Hernandezes graphics business. Minerva Peña, a Brownsville Independent School District trustee, is currently running for the the JP 2-2 Court and is a political ally of the Hernandezes.
Or could Brownsville Towing Company belong to Daddy Ernie?
The plot, however, thickens even more.
With early voting scheduled to start Tuesday, at least three Yolanda Begum supporters have told her that they had been given a copy of a Brownsville Police Department incident report involving Jonathan Gracia, one of the candidates running against Erin Hernandez-Garcia. Begum and Gracia are challenging Erin for the position in this years' Demo primary.
They all said that the source of the report sent to her is none other than the JP's father, Pct. 2 commissioner Ernie Hernandez.
"Apparently, he wants Begum to attack Gracia while Erin coasts in to win," said one of the three supporters who showed El Rrun-Rrun the report.
So far, only a blogger allied with the Herandezes – Robert Wightman (click on graphic on top right) – has published a copy of the report, ostensibly to keep Yolanda's son Alex, an attorney, and this blog from reporting on it.

Montoya? You really expect a suspicious constable like Abel Gomez to go against Erin "Fugly Piggy" Garcia? Much less this suspicious constable to really investigate a crime? Now, that is funny! Erin's days are numbered and she knows it. We, the voters see the writing on the wall and that's the Hernandez' only making a dollar or getting favors to further their political careers. Sad, that Erin is in a profession that is already critiqued by the public.
How did Minerva Pena acquire those chingonas tow trucks?

well folks like many say, money talks and bullshit walks, guess Erin might be having some kind of a cash flow problem, so here is an easy way to fix it, at public expense of course.

Erin is not at all ugly - she is beautiful. She is very nice....I don't know why people think the opposite. I saw her in person once, and I said WOW!!! Very nice...very nice....woman
Whoever wrote the piece about how nice and attractive Erin Hernandez Garcia is must be blind. Erin is a cow...and an ugly cow. Obviously Ernie and Norma have bad genes....at least ugly ones. Norma probably wrote that piece above.

The picture illustrates 'birds of a feather' flocking together. Citizens STILL want to know: How's over $20 million in taxpayer dollars to build a bridge just disappear; and NO ONE goes jail for it?? What about it Eddie??
Erin's grossly overstated advertisement in today's Herald left out the money she has made by marrying couples and for allow illegals and how many time she has taken questionable shortcuts through the laws. Erin is like Ernie (and Norma) and clearly indicates that the acorn doesn't fall far from the tree. She should be indicted so they can both enjoy room and board at public expense. After all the money they have taken from the public....payback would be welcome.
I don't understand why JP Court Judges charge and keep the money to marry couples in their court. They were elected to serve the people. The money made for marrying people should be paid to the county since they are done on county time and county property. That's why the JPs get a salary. Im sure most of the ceremonies take place in their courtrooms. The county should pay them a $500.00 stipend a year to have that cover the cost to conduct weekend ceremonies. Plus the mileage is already covered under the stipend they get yearly. This would also mean that they get a part of all the traffic citation they collect because they collect the fines. Why hasn't the county judge or the commissioners done anything to change the law requiring that all monies collected for wedding ceremonies be deposited into the county coffers? Why are they paying David "El Manitas" Garcia a lot of money to lobby for the county. Don't you think he would have already done something for us? So adding the JP salary of about $48,000.00 a year plus all the extras they make on the side might total to over $100,000.00 a year. No wonder they turn into criminal with all the money they make on the side. They more they make, the more they want. No wonder we have a bunch of criminals always running for JP. I wouldn't be surprised if Aurora de la Garza or her theif of son Joey de la Garza run for JP themselves. They live for the money.....
