WIGHTMAN LECTURES SAENZ, FEDS ON JUSTICE

We have come to a fine situation in Cameron County.
When you have a disbarred lawyer who was run out of Dallas on a rail sermonizing the sitting district attorney how to do his job, and then taunting his public relations employee to enter into a dialogue with him, we have crossed over to a very twisted parallel universe.
This topsy-turvy condition has been in the making ever since Robert Wightman – a well-known legal malingerer – has tried to ingratiate himself into the local political life in this town and county. Wightman, who has finessed the demand letter and legal threats of indictments with a healthy dose of reports to the various local, state and federal authorities alleging all sorts of criminal behavior, wants attention.
He wants Cameron County District Attorney to seek indictments against a whole gaggle of potential defendants. Fist he castigates Saenz for not indicting San Benito attorney Oscar De la Fuente. You remember Oscar,. He was the feds' main source of insider information on former DA Armando Villalobos and spilled his guts about just about everyone that had their hands in the cookie jar along with him.
Wightman would have Saenz prosecute De la Fuente despite whatever immunity the federal and state government may have conferred upon him for his testimony.
This is the guy who wants at least three candidates for pubic office indicted on the spot because they forgot to put the word "for" in front of the position they were seeking. To him, this was an indictable offense of the highest degree. Those three were JP-elect Mary Esther Garcia, candidate Pete Avila and county commissioner Alex Dominguez.
The TEC merely told Avila to place a sticker with the wor "for" on his campaign signs and that was that. Ditto for Garcia and Dominguez. In other words, its ain't no big shakes, partner.
But while Wightman wrings his hands in despair at these heinous crimes, he doesn't seem to call Saenz on the floor for not prosecuting Erin Hernandez, the JP who admitted she had issues waivers for the state-mandated 72-hour waiting period because she thought she could. A Texas Attorney General's opinion clearly stated she was not authorized to issue (or sell) the waivers.
Wightman is happy to let that go.
He also sided with her father Ernie Hernandez for subverting the civil service process at the county by promoting the illegal hiring of Robert Cadriel, his brother-in-law. Wightman thinks that poor Ernie was railroaded even after a handful of county employees testified that it was Ernie and his administrative assistant Raul Salazar who were behind the plot to have Ernie's brother-in-law pass the civil service exams.
Testimony in Salazar's trial indicated that a county staff person was told to take the test for him and then – when that job fell through – was actually given the answers to another test.
The list of wrongdoing by this bunch has been thoroughly documented, yet, in his letter to the local newspaper Sunday, Wightman forgot all about that. Instead, he wants Saenz to prosecute City of Brownsville Mayor Tony Martinez for the purchase of La Casa Del Nylon from his buddy Abraham Galonsky. In the past, he has virtually ascertained that Martinez and federal judge Andrew Hanen reached a deal to obstruct justice by not prosecuting Da Mayor's son in federal court on some unspecified crimes which Wightman does not document.
And the list goes on and on. County Judge Carlos Cascos – after a brief fling with Wightman – has become a persona non-grata with Wightman who accuses the judge of trying to bribe him so that the county could fire a park employee. And because his administrative assistant Cris Valadez stopped playing ball with his as did Landin over at the DA's office, he has vowed to bring them down to their knees using all the wiles and guile in his bag of tricks.
 Even the U.S. Dept. of Justice doesn't escape Wightman's wrath. As far as he's concerned, they have been asleep at the wheel and by not indicting everybody and his brother have deliberately allowed massive criminality all around and willfully "created more victims."
Now he wants to goad DA spokesperson Melissa Landin to answer his allegations, in other words, to engage in a dialogue with him, his most exalted bearer of morals and ethics.
And who else gave him a soapbox to spew his vitriol but the local newspaper, the Brownsville Herald?
This is the same newspaper that Wightman has accused of covering up corruption and being the lapdog of crooked politicians.
Do the people at the newspaper know who they're dealing with when they provide him with the space to slur local people at will?
How sick is this puppy?
Very.
Let's just cite but one (of many) examples of this gentleman's delusions.
Four years ago, Chase Bank sent a large mailing to potential customers who might want to apply for a credit card.
Instantly, because one was sent to him and another person who had been target of one of his many lawsuits, Wightman's suspicions were roused.
Could it be, he thought, that the Federal Bureau of Investigation, former U.S. Attorney Albert Gonzalez, current U.S. Attorney General Eric Holder, Texas Supreme Court Chief Justice Wallace Jefferson, Texas Gov. Rick Perry, and the FBI Director Robert Mueller, were all trying to entrap him by sending him the application?
But of course, that was it.
So Wightman, who has been known to sue people and companies at the drop of a legal pad did what comes naturally to him. He sued them and demanded that the court appoint a special prosecutor to pursue the investigation into who had sent him the credit card application.

In his petition to the court in Wightman vs. Robert Meuller, et al, Civil Action No. 10-00238 (JDB) he requested that the Court order defendants to recuse themselves from a criminal investigation that he sought to open.

Wightman began with accusations that Chief Justice Wallace Jefferson of the Texas Supreme Court "orchestrated an usurping of power" from Texas Governor Rick Perry "with Governor Perry's full consent for the sole purpose of obstructing justice."

Wightman also alleged, among other things, that FBI Director Mueller and former Attorney General Albert Gonzales used the FBI to entrap him on credit card fraud charges in order to silence his criticism of appointments made by former President George W. Bush. He claims that the FBI was responsible for a Chase credit card application addressed to him and to a person targeted in a previous lawsuit he filed; he believes that the application is evidence of the FBI's scheme to entrap him on credit card fraud.

Wightman also contended that Mueller could no longer conduct a criminal investigation of Governor Perry and Chief Justice Jefferson because he would implicate himself and his office, and that Attorney General Holder was now involved in the coverup because "President Obama seeks to appoint to federal offices Democrats who have made themselves party to the criminal conduct initiated under the Republicans."

He further argued that the Court's failure to compel the FBI to investigate and indict Governor Perry and every member of the Texas Supreme Court will make other judges "party to the criminal conspiracy started by Governor Perry and the Texas Supreme Court and covered up by FBI Director Mueller."

According to Wightman the FBI reviewed his claims of public corruption and attempted credit card fraud at his request but declined to investigate further, citing a lack of evidence. He sought declaratory, injunctive, and mandamus relief ordering defendants' recusal from a criminal investigation of Governor Perry and Chief Justice Jefferson and the appointment of an "independent investigator" to pursue the investigation.

The defendants moved to dismiss the complaint pursuant to Rule 12(b)(1) for lack of subject matter jurisdiction. They argued that Wightman-Cervantes's bizarre and implausible factual allegations were not entitled to a presumption of truth, and that his complaint therefore did not raise a federal question and warranted dismissal on jurisdictional grounds.
And this is the guy Saenz and the Department of Justice attorneys should be listening to? If they give the time of day to this warped individual, we're in for a wild ride into his la-la land.
This is the guy who the Brownsville Herald is giving space so that he can dispense his keen legal sense of justice onthe unwashed masses of Browntown?
