WILL NEW BISD TRUSTEES TAKE COUNSEL BULL BY THE HORNS? OR WILL THEY CONTINUE THEIR DOUBLE STANDARDS?

When the three new members of the Brownsville Independent School District board take their oath of office on Wednesday, they wil be asked if they agree to uphold the U.S. Constitution, state law and district policies so help them God.
As far as a we know, Cesar Lopez, Joe Rodriguez and Carlos Elizondo will pledge to uphold the law, so help them God.
I know of a person who has been trying for months, if not more than a year, to get employment with the BISD. After his initial application was approved and he was told he had a job, district personnel called him back to rescind the offer because of a pending DWI. It's not that he had not included the information in his application. He had. But the personnel staff told him that the fact that he had been charged was enough to disqualify him. Up to this day, the case has not been resolved. He explained that the case arose as a result of a divorce and the traumatic effect on his life. Nonetheless, he remains unemployed.
Now, looking through the district's own employment polices regarding "Employment Requirements and Restrictions: Criminal History and Credit Reports," it states that "No one convicted of a felony or and misdemeanor involving moral turpitude may be considered for employment in the district. Moral turpitude is an act of baseness, or depravity in the private or social duties outside the accepted standards of decency and that shocks the conscience of an ordinary person."
Among some of those crimes are included, of course, public lewdness, prostitution, theft or theft of service (in excess of $500 in value) and fraud.
This is apart from non-reviewable offenses such as criminal homicide, capital murder, injury to a child, aggravated sexual assault, indecency with a child, sale or purchase of a child, kidnapping, prohibited sexual conduct, murder, rape, arson, robbery, and sexual assault.
If the offense was a felony, the applicant is automatically excluded form employment with the district.
Some misdemeanor convictions do not automatically disqualify an applicant form BISD employment. "Examples, but not by way of limitation, of offenses that do not involve moral turpitude are: misdemeanor possession of marijuana, disturbing the peace, DWI, drunkenness in a public place, gambling, and simple assault."
Since the person in question hasn't even gone to trial for the DWI, it would seem that he would qualify for BISD employment. A conviction of a first DWI is a misdemeanor, after all, and we know of several people working for the district with one or two DWIs.
So why was this person not hired?
Let's take another case.
The same personnel policy requires all applicants for employment with the BISD to submit their criminal history records and the district to complete "a national search on a person the district intends to employ."
A conviction is defined as "a finding of guilt or acceptance by the courts of a plea of guilty or nolo contendre."
At the Superintendent's discretion, the district shall not employ an applicant who:
1. Is a convicted felon.
2. Is convicted of a misdemeanor involving moral turpitude.
3. Is charged with a felony or misdemeanor involving moral turpitude until there is a final disposition of the charge.
4. Is on probation for any offense (including deferred adjudication probation) that would otherwise restrict employment."
On April 2013, a majority of the board acted upon the recommendations of the BISD administration to hire Baltazar Salazar as board legal counsel. Then, on December of 2013, the board voted to extend his contract for another year, change his job description to general counsel, and to give a 10 percent increase to his $240,000 annual retainer.
When Salazar applied to the BISD, he was in the process of trying to expunge his record of three felony arrests for felony theft. In at least one case (83-CR-416-A) that happened on January 15, 1983, Salazar was found guilty of felony theft of $5,700 and sentenced to three years imprisonment suspended to seven years probation. He appealed the sentence to the 13th Court of Appeals in Corpus Christi and the appeals court upheld the conviction (13-85-181-CR) in May 1986.
The other two arrests (83-CR-23-A and 85-CR-450-A) happened on April 26, 1984. 
In the course of the petition for expunction, Salazar told the courts that as far as the January 15, 1983 offense and one of the April 26, 1984 offense, "he had been released, that the charge has not resulted in a final conviction and is no longer pending. and that there was no court ordered community supervision..."
As far as the remaining April 26, 1984 offense (85--CR-23-A), Salazar told the court that prosecution "is no longer possible because the limitations period has expired."
The 13th Court of Appeals did not buy Salazar's argument and reversed the expunction order he obtained in the 107th District Court in Cameron County. 
Yet, when he filled out his application with the BISD, Salazar answered that "in 1984, in Cameron County Cause #84-CR-A-4113, theft by check, I was placed on deferred probation and the case was dismissed. In 1985, Cameron County Cause #85-CR-23-A, theft by check, I was placed on probation and the case was dismissed and conviction set aside."
That would probably be news to the 13th Court of Appeals which reversed the expunction order.
But more to the point, we looked up the first case he mentioned (Cause #84-CR-A-4113, theft by check), and the case, a misdemeanor, does not relate to Salazar in any way. In other words, it was not a true statement. The other case he mentioned (Cause #85-CR-23-A), was the case he appealed to the 13th Court of Appeals and lost.
He never listed the other two cases he tried to get expunged 83-CR-416-A (January 15, 1983, theft by check), 85-CR-450-A (theft by check, April 26, 1984) and failed after the DPS objected. On the very day that he made his pitch to the BISD board of trustees (April 1, 2013), he was awaiting the appeals court decision on the DPS objection and never said anything about it.
Now, we have a proven convicted felon and one who lied on his application getting hired and given an extension and a raise. And we have a person who has only been charged (and never convicted) not getting a job with the district.
Two of the new members who will be getting sworn in on Wednesday will have the opportunity to review the general counsel's performance, including his fraudulent application. Lopez got $4,000 in reported campaign contributions from Salazar. Elizondo only got $1,000.
Salazar also recommended that the defense of the district to the Luci Longoria-Catalina Presas-Garcia First Amendment federal lawsuit be assigned to the  Colvin, Chaney, Saenz & Rodriguez, L.L.P. law firm in Brownsville. The "Rodriguez" in the firm refers to Tony Rodriguez, the son of incoming new trustee Joe "Coach" Rodriguez. So far, the district has paid the firm almost $200,000 to defend it,
For months, trustee Presas-Garcia and Longoria have tried to get a third trustee to sign on to place a review on Salazar's employment without success.
Will two of our new members – either Rodriguez, Lopez, or Elizondo – fulfill their promise to uphold the law and district policies? Or will they choose instead to continue this farce?'S

What has the person who hasn't been hired done to find out why he is not being considered? There may be other reasons you do not know about. If there are none, he should request that Texas Workforce investigate or EEOC. If what you say is correct he is being treated unfairly.

Cata is the least effective board member. If she really cared about the district and students she would resign so someone who can work with people be appointed. Will she resign or does playing the martyr to her delusions of grandeur overshadow all? Such a sad individual.

DWI's?? That's should not be a reason not to hire. Lots of folks on the BISD have DWI's and more. If you misbehave, you get moved to the "glass-palace" and all is good. And if you get booted from other School Districts, the BISD welcomes those employees with open arms and with top positions. This is the law of the land at BISD. Shit always floats up to the top!

We also have Bertha Pena who got a job for her friends and relatives some of those Dora Sauceda and Bertha's own daughter; Bertha is also trying to get her secretary ,JJ DMion a level four promotion AGAIN????

Many in BISD have dwi's and some have been dismissed from other districts for much worse accusations and BISD hires them. I know of several but they are related to hire ups. DWI's happen on one's personal time and have nothing to do with education or that person's job performance. They are treating that person you talk about very unfairly. Poor individual: he made a mistake while going through a tough divorce. Divorce as you know is very tramatic and painful and now he's having to deal with this. He's in my prayers, We all make mistakes, nobody is perfect. He should have been hired, it's a misdeamenor not a felony. Shame on you BISD.

Divorce is tough and devestating and now he's having trouble w/BISD because mistakes he made under duress and lapse of judgement because of mental and emotional pain.Life is tough and divorce is even tougher. Give him a break, he's just trying to get back up. I'm talking from experience, i've been there, alot of us have been there. It's no fun and we make mistakes,we all do.In my school there are people who have done worse and they are still employed. My hat goes off to this guy for trying,don't give up, somebody will listen.Sue the shit out of them, everybody does.My prayers are with you.

I don't know what happen with the gentleman you wrote about but, i do know that it takes two to make a marriage work and two to get a divorce. It's painful and stressful in everyway and it affects everybody around you.You can't think straight and you make mistakes. BISD give this gentleman a break,from my experience i don't wish divorce for anybody. It hurts really bad.

I've been with BISD for two decades and have seen many atrocities. DWI's are nothing to what I have witness. They are doing a disservice to this individual.Divorce is horrible and emotionally draining, my empathy for him. If he applied last year and was denied, tell him to sue for last years wages and be given a job. He hasn't been found guilty or convicted of any thing. They're misdemeanors for godsake, nothing to do with "Moral Turpitude". Sue the Bastards. Good Luck buddy, who ever you are.

I believe I have an idea who the individual is you wrote about. I'm a former Board member and if it's who I think it is (no name) he's a very qualified and very educated man with graduate degrees. Yes, he went through a very painful divorce and like most of us we/he made errors.He's a good friend and very helpful, he'll take the shirt of his back for you. I don't understand why BISD has this policy, he has done nothing of moral turpitude. I would have hired him immediately if I were on the board. Divorce is seldom talked about and the devastation it brings to families and the parties involved. DWI's have nothing to do with moral turpitude. He's well know in the community and has done plenty to help others. He has value. BISD give him a chance, with his experience, friends and all the people he knows and helped, he's a treasure worth having. A FORMER BOARD MEMBER and proud friend of this individual.

Retired Administrator: If they offered this gentleman your're talking about a job, it's because they saw his potential and qualities. They felt he could be an asset. If i had been that administrator i would have fought for him inspite of DWI"S. They have nothing to do with moral turpitude. Be human, he was going through an emotional divorce when this happen. It could happen to any of us. Life is tough. Don't give up. Seek the Lord's guidance.

What's happening to this guy really pisses me off. He's got graduate degrees and just survived a horrific divorce and he's done helpful things for the community and BISD won't give him a second chance. Who is he Juan? I'll represent him Pro Bono and we'll see them in court. I've beaten BISD before of a bunch of money, I'll do it again. Attorney. i think you have an idea who i am, not long ago i got BISD to settle. I really feel bad for this guy and it really upsets me. Ready to go court for him and i will fight like there's no tomorrow. I'll be in touch, need information.

Moral turpitude. no way DWI's have anything to do with w/moral turpitude. It's a sad story you wrote on this gentleman especially since he has graduate degrees. I wish i knew who he is so i could offer my assistance. Sounds like he's a good man, especially with the help he's given the community and people. Juan, who is he? Good story but sad how he is being treated. He doesn't deserve this. He made mistakes, for heaven sake we all have, were not perfect, nobody is. He seems like a nice fellow, I wish I knew who he is, I'd bend backwards to help him get a job and I feel terrible about his divorce. Divorce can take the life out of you or anybody that goes through it, it's terrible and hurtful and you make mistakes because your decision making is not where it needs to be. Generally, sometimes I don't agree with your blog but, this story about this individual actually made me feel really bad and determine to help him if, I knew who he is and why he wasn't hired last year. Juan, your story about him touched my heart. This may be your best journalistic stories. I had several friends read it and were all for this individual. What can we do to help? Who is he? Good but sad story. Your best story so far, very humanistic.

Que pasa con BISD? Este guy was going through a bad divorce when he got a DWI, so he had a lapse of judgement. Who hasn't? You have and I have and we weren't going through what this person was experiencing. I can just imagine his emotional and mental pain at the time. I didn't get a divorce but, was close. I can tell you it's horrific, you can't eat, you can't sleep and your're constantly in turmoil, it's terrible and you make mistakes, we all do. My heart goes out to him, who ever he is and I say this, don't let BISD get you down. You already survived the divorce, that's a step in the right direction. Keep your head high. I know divorce is very hard. BISD's loss so far but, don't give up. Juan, one of your best stories but,SAD. What can I/we do to help?

First time to your blog. Friends called to tell me about the man you wrote about in your blog, his divorce and rejection from BISD. I read the article and i felt terrible for him. I hope he's doing well with everything he has had to deal with. No one should go through what's he's going through. Divorce is hard enough. So he had DWI's while going through his divorce, so what, worst things have happen in divorces. He didn't kill anybody, he was just emotionally depleted. We can all understand that! Give the guy a job (BISD) he just wants to live a peaceful life. My friends are upset and reach out to me, Austin TX, I will go down there and i'll find out who this man is who is being treated unfairly and the Board are not going to like me much. Do they want a situation w/me, i don't think so. I've never followed your blog, i will now, friends are upset. Stay on top of it, my friends and i now will be watching. First timers to this blog, had never heard of it before until friends encouraged us to read the story of the man you wrote about and his unfair treatment. It' seems unfair and brought tears to me and my wife. Heartfelt divorce, DWI"S, rejection from BISD without being guilty or convicted. Something is wrong w/this picture. Tell him to read about "Job" in the bible. He also went through some struggles. Tell him to endure, things will get better, pray. DWI is not a moral turpitude issue, he should have been hired last yr. Whats wrong w/BISD policy, the policy is good for some but not for others. I'm following this man's story. Divorce does not discriminate when it comes to gender. It is a death but worse than from natural causes or illness because both parties are still alive and having to deal from the devestation it causes. Rash decisions are made along with poor choices and then we are left to deal with consequences. I've gone through one divorce and i to made bad decisions and poor choices, this is what divorce is capable of having do. I had never been in trouble before but decided to self medicate myself with "Alcohol" and got in trouble. It's happened to both men and women. Like i said divorce does'nt discriminate. However, it's not a case of "Moral Turpitude". If you know this man tell him to apply again He should have been hired. He didn't kill, abuse or steal. Oh my God, were dealing here with DWI's. I don't care what they say and don't know what their policy is or why they discriminate hiring one but not another with the same offenses. We checked and there are many in BISD who have been charged with similar offenses or "Worse". We have anonymous friends in BISD who have made us aware of some of the atrocities of BISD employees. For exemple; Drug use during school hrs, sex in classrooms, sex w/administrators for favorable treatment and the list goes on. This guy can't be hired because of DWI's, come on. This is ridiculous. This is far removed from "Moral Turpitude". Attorneys -at-Law McAllen, Tx Who is he?

Who is this man who is receiving unfavorable treatment at the hands of powers to be? "Moral Turpitude" I don't think so...Where can I find him, other attorneys made me aware of this story. One, two DWI's and no convictions or guilty verdict. Something is not right here! Others have done much, much worse in BISD. Now, i'll follow your blog. Ready and willing to go to court. I like this battle, i can't sleep just thinking about it. This is an injustice. We will follow your blog, hopefully they'll come to their senses and hire him. God Bless the "Glass Palace" if this man doesn't get hired. Last night at the "Vermillion" he was the topic of converstion and we are salivating like a pack of wolfs. We (group of lawyers) are ready to go up against BISD legal team (pro bono). To BISD we say, Give this man a job or suffer the consequences (Financially, big time). BISD, save yourself the embarrassment and change your policy.
