WILL HERALD COVER STORY WHEN REMOVAL SUIT FILED?

Even before Tuesday's meeting where Cameron County Clerk-elect Sylvia Garza-Perez failed to produce a $500,000 surety officeholders bond to allow her to take the oath of office, rumors have been circulating around the courthouse that someone will file a petition for her removal in a district court.
Garza-Perez has had from November 4 to acquire a surety bond to take office. She asked the court through her attorney Ron Armstrong to "show some tolerance" for 30 to 60 days so they could work it out with county legal counsel Bruce Hodge to satisfy the law.
Up to yesterday, Garza-Perez had refused to say why she had been unable to secure more than $100,000 coverage – instead of the $500,000 required by law.
Yesterday, a teary-eyed Garza-Perez told a local broadcaster that it was not due to any "judgments" against her that she had failed to obtained the surety bond, but attributed her failure to the fact that she had "bad credit." Now, we have never claimed to be legal eagles, but unless he was applying for a personal loan, how does bad credit apply to the issuance of surety bonds? After all, it is the county that pays for the premium for the officeholder bonds, not her.
And why does she need a lawyer to get her bonded? We hear that Armstrong is seen as somewhat of a pitbull in a legal tussle, but going against Hodge would seem to be a walk in the park. Why the legal muscle?
The commissioners court, meanwhile, have said that current county clerk Joe Rivera will remain in his office as a "holdover" until Garza-Perez is bonded and pay for salary.
However, Garza-Perez and the commissioners' hands may be forced. According to reliable sources, an identified party may file a petition for her removal from office in a local district court.
The basis for the petition, sources say, is Section 87.014 of the Texas Local Government Code that states that:
"TEXAS LOCAL GOVERNMENT CODE
Sec. 87.014. GROUNDS: FAILURE TO GIVE BOND. A county officer who is required by law to give an official bond may be removed under this subchapter if the officer:
(1) fails to execute the bond within the time prescribed by law; or
(2) does not give a new bond, or an additional bond or security, if required by law to do so.
Acts 1987, 70th Leg., ch. 149, Sec. 1, eff. Sept. 1, 1987.
Sec. 87.015. PETITION FOR REMOVAL. (a) A proceeding for the removal of an officer is begun by filing a written petition for removal in a district court of the county in which the officer resides."
The "holdover" provision must not have come at a good time for Rivera. He has been one of the potential candidates for appointment as a county judge when incumbent Carlos Cascos leaves the county to accept the position of Texas Secretary of State January 21. If it takes longer than that for Garza-Perez to acquire the required bonding, or if the petition for her removal as an officeholder to county clerk prevails in court, Rivera may find himself sticking around in his office for the next two years until the next general election.
That, obviously, is not something either Garza-Perez or Rivera envisioned when the election cycle began way back in the March primaries.
Meanwhile, readers of the Brownsville Herald and the Valley Morning Star have been left out in the cold in the reporting of the fiasco at the county. The reporter for the Herald did a small feature on the meeting focusing on the Mayor Leticia Salazar, of Matamoros, giving outgoing county judge Cascos a traditional Tamaulipas cuero, or leather jacket to send him off on his way to the cold Hill Country environs.
Salazar, who has come under scrutiny for her autocratic ways and the involvement of her Grupo Hercules in the disappearance and murder of three U.S. siblings from Progreso, Texas, was present at the meeting to wish him well. Cascos was born in Matamoros and Salazar said she hoped he would not forget the area when he was holding his new office.
So, unless there's a piece of fluff lurking somewhere near meaningful new stories, readers of those dailies shouldn't expect much coverage from these advertising cash cows.

We cannot expect the "Herald" to print any stories critical of local government or officials....unless they get indicted....or to publish stories critical of local officials. Just look at the section on Dec 31 about Brownsville "as a pendulum" of progress and potential. That was a lot of crap...especially since they focused on Carlos Cascos (not a city official) and considered progress to be actions totally out of the hands of local officials (SpaceX for example). The city of Brownsville is impotent...and has no leadership to take action...regardless of the pendulum analogy. Brownsville is poor, fat, and ignorant and the local officials tend to focus on making life better for their friends and otherwise "muddle" along....wishing that Brownsville was like it used to be in the past.

now that Ms Salazar is mentioned, isn't there a story circulating on the internets (ala bush) that 2 of the siblings were part of disorganized crime in the area along with the bf, states they were in fact taken by hercules and the handed to semar who in turn dropped off in front of their friends who didn't really like to see them getting dropped off by semar and then we know how the story ends. IDK

As a former District Attorney in another county in Texas, I question the "bad credit" excuse. I have never heard of bad credit being an obstacle to such a bond.
