THIS TIME, UNCLE LUIS, DA'S OFFICE, COULDN'T HELP

He dodged a bullet when the Cameron County District Attorney's Office under his uncle Luis V. Saenz failed to file papers in time to revoke his one-year probation for 2013 conviction for Failre to Report Felony Where Severe Bodily Injury or Death Resulted.
Saenz had appointed Ed Cyganiewicz as a special prosecutor to remove any appearance of conflict of interest in him prosecuting his nephew's case.
Garcia was initially charged with Accident Involving Injury or Death felony charge and with Failure to Report Felony Where Severe Bodily Injury or Death Resulted, a felony.
The case arose out of an automobile accident where Victor and his sister Kacie – who had both been drinking – ran over a man walking on the side of Southbound Expressway 77 in Brownsville on Sept. 9, 2013. Police charged them with leaving the site of the accident after striking 21-year-old Gilbert Perez and fleeing the scene of the accident leaving him critically injured on the side of the road.
A plea bargain with the special prosecutor resulted in reducing all the charges to one, the last one.
The agreement between the DA's Office and defense attorney Ed Stapleton resulted in the court assessing him 12 months probation and 24 hours of community service.
The court also went along with placing Victor with deferred adjudication so that after he served his probation, the record of the offense would be erased. He was to remain on probation until Aug.11, 2015.
But even after getting off with a nice plea bargain, Victor could not manage to stay out of trouble. (That's Victor campaigning for Saenz's reelection last month in the graphic at right.) He is the young man wearing a cap and sunglasses top right.)
On June 7, 2015, the Texas Department of Public Safety arrested Victor again, this time on a charge of DWI.
For some unknown reason, the DA's Office through its special prosecutor, did not file the necessary motions in court to revoke the probation until after Aug. 14, 2015, three days after the Aug. 11 end of the year of probation ordered by the court. That's when the deferred adjudication period enters.
As a result, just yesterday, Victor pleaded guilty to a DWI Class B, a first-time misdemeanor offense, and was sentenced to 180 days in county jail.
Victor and his family have said that they never got any special considerations from the DA's Office. But as it can be seen, the unexplainable delay in filing for the probation revocation in the first offense, resulted in Victor serving six months on the second offense instead of having the court sentence him to the initial one-year probated sentence.
At this juncture – and with early voting where his Uncle Luis is seeking reelection – it had become too tenuous and politically risky for him to extend a family hand to his nephew this time.
In response, the siblings' mother – and Saenz's sister-in-l;aw, created a FB page (The Truth) to rebut charges in the mailer by a victims' group that Victor had gotten favorable treatment form Saenz.
In it, Diana Gonzalez (related to former District Clerk Aurora De la Garza, nee Gonzalez) said the kids made "a mistake" and left the scene because they were "young and scared." They had done their time and wanted to move on as should the rest of the "mudslingers."
Unfortunately for mom, the second charge was pending at the time she posted and later that day, Victor was incarcerated to serve his sentence.
Yeah, he did move on, but it was just north a little bit up the road to Olmito.

Thanks to victims united that made the people see what DA Luis Saenz was doing for his family and now with all the pressure and "The Truth " that victims united provided us MR Saenz had to really play by the book of giving him jail time, now lets wait to see when he askes in a favor to the jail to have victor treated special while uncle Luis brings in El Chapos crew to make him a tunnel to go kiss his mommy good night and have a drink on the way back just in time to make roll call!

I have observed and participated in very many political campaigns for well over 30 years.
I don't believe I have ever witnessed a
campaign conducted like the dangerously misguided campaign Masso is waging for Cameron County Dist. Atty.
It is one thing to run on your merits and accomplishments for a public office, but his campaign is far different.
I will address him directly and try not to use big words so that he may be truly edified by my statements.
Sir, using the term loosely, you claim to be a truthful individual but your awful vocal spew reaks of regurgitated innuendo. Your sub par allegations sound like vain repetititious Chisme that no one in their right mind
would give any credence to.
You are a shame to all barristers worldwide. No self respecting lawyer
(No pun intended) would persist in attempting to satisfy the whims of his cronies by promising to return the illegal operation of unlawful eight liners. To make matters worse you pick out an obscure court case that was conducted by bonafide licensed attorneys and try to use that as campaign fodder. C'mon Carlos keep up, your impeachment is almost over.
When you try to use a group called
"Victims United for justice" it is a travesty because your are neither united nor a victim of nothing more than your poor choices in life.
Spend more time doing righteous things than trying to resurrect the
criminal political activities that have plagued Cameron County for decades.

Get your facts right...DA Saenz did Not appoint Ed Cyganewitz as special prosecutor a visiting judge did. Makes me wonder how many other lies/facts you've spread.

It's no wonder why residents of Cameron County always complain about corruption. They look at this year's DA race and only see two candidates, Saenz and Masso, yet they completely ignore the Republican candidate Jeremy SoRelle.

"Jeremy who," you ask? Jeremy SoRelle, the person who should be our next DA. The only DA candidate most of you never heard of because he has not been mentioned in any of our local scandals.

We all know Saenz as the current DA who has refused to prosecute his corrupt friends like Ernie and Erin Hernandez. We all know Saenz to be a hypocrite, claiming to raid the 8-liners to protect our morals while promising to smash each and every machine so they'll never again be used in the RGV, but turning around and selling them to clients of Masso and Zayas. What happened then? The gambling machines resurfaced in the RGV. What a hypocrite!

And Masso? Do you not think he owes Saenz a massive debt for confiscating the gambling devices from all the independent operators so that his client can have a monopoly here in the valley? A vote for Saenz or Masso is a vote to continue the same oppressive corrupt system that each of you hate, or claim to hate. But we'll find out on election day.

Jeremy SoRelle. Your third choice to stop and change the corrupt system we have now. Most of you will vote in the Democratic primary this spring, and you will not see his name. But he will be waiting for your vote in the general election this fall. Open your minds to someone other than corrupt candidate Saenz or corrupt candidate Masso. You have a choice for a better Cameron County.

This is in reference to the so called mom of the criminals," what if the victims had a been your kids?" Would Luis Saenz had followed the same path as he did for this victim? What about to Diana Gonzalez, would you have just settle and forgiven on a simple... they made a mistake? Your son didn't learn from the first so called mistake, he was caught drunk driving and endangered another victim. The answer could be, "so what", my uncle, Luis will get me off. Nepotism caused and will continue to place a big part of corruption in Cameron County. This is my opinion

Anyone could have hit that kid. He was drunk and on drugs in the middle of the expressway. He was on the expressway because His friend kicked him off the car because he punched him. He admitted his guilt in court. What if it was someone you knew that hit the kid??? What if you had hit this person? You never know what can happen! Shit happens! I never hope you go through what any of these three had to deal with! They all made bad choices and they are all trying to move on! They both paid for their crimes! People commit crimes all the time! There are D.W.I.'s everyday! Go look at the inmate list for county and count the people! You may think you are perfect, but NOBODY is! You don't know Diana or victor, and you don't know the victim! You don't know the situation! As for her son not learning from his first mistake, you are no one to judge him!

I don't know what is more pathetic, your pretentious writing skills or how you lie to defend Saenz's criminal nepotism and his dismal failure at prosecuting real criminals. Saenz is a vindictive bully who uses his power to go after his enemies and who favors his family and his minions.

Masso is not squeaky clean either remember as a member of the port of Brownsville board a few years back when the international bridge to nowhere deal with sucio lucio and other companies netted those crooks $22 million, and then masso voted to accept a $1 million dollar settlement, really? oh I forgot its just taxpayers monies, hey im waiting it out till november and vote for the republican guy, these two turds here saenz and masso are both a bunch of crooks, more crooked than a mesquite tree.
