Did you hear about Cameron County Precinct 3 Commissioner David Garza bringing up the subject of some of his constituents on the JP courts warrant list complaining about getting a letter from the Jonathan Gracia Law Firm soliciting his business?
Garza wanted to discuss the matter with the court – and did in executive session – to determine whether it was appropriate for a sitting Justice of the Peace to send letters offering his legal services to people on the list.
Just recently, the county moved to collecting the fines owed justice of the peace courts. Estimates on what can be collected ranges from $12 million up to $30 million.
Now, these warrant lists are available to the public as well as to any law firm that want to get a hold of it. If you have ever been charged with a crime in the county, it is perfunctory that a letter offering legal services will invariable pop up in the mail.
However, the fact that it is the law firm of a sitting justice of the peace doing it was what raised Garza's question.
According to some sources, the commissioners court came to the conclusion that it is probably not illegal, but might be straddling the appropriateness fence.
As former Cameron County Judge Tony Garza used to say: Sometimes the appearaance of inappropriateness is worse than the act itself.
That may be case here.
During the campaign for his election, one of his opponents (Erin Garcia) made a police report available to her favorite blogger which showed that while he was with the DA's Office, Gracia had been involved in an escapade involving a disoriented woman who wondered barefoot out on the frontage road by a hotel where they were renting a room.
At that time, the conclusion that was reached was that he was not to blame for the woman's condition, but that he could have used better judgment.
To be fair, we understand that the letter that was sent out from his office was not sent to anyone residing in his JP precinct (2-2), but only to residents who lived outside his precinct.
Was it just another lapse in judgment, as the commissioners decided? Or was he well within his right as a working attorney to drum up- business for his legal practice?
Utimately it comes down to the court of public opinion.

If you knew Juanito had the letter and was going to write the story before you, you would have put out the story first but he beat you to it.
