Even after he was forced to accept the changes downward on his fire captain's exam when "someone" changed them to place himself over the 70 point mark, fire fighter union president and current Brownsville Independent School District trustee Carlos Elizondo is one of three finalists for chief of the Brownsville Fire Dept.
And even after a police complaint assault was filed against him by a fellow union firefighter on April 14, the city administration appears to be leaning to selecting Elizondo as the next chief over local firefighter Jared Sheldon and an applicant from the Dallas area.Sources within the department say it has come down to those three. Barring any delays in the vetting of the candidates, City Manager Charlie Cabler will be making his decision on who to recommend that the city commissioners hire as the next chief either Friday or Monday.
Between that time, acting Brownsville Fire Chief Joseph Horne is said to be retiring at the end of this week, perhaps as soon as this Friday.
Horne has made it known that he does not favor Elizondo's hiring as the chief. He points to the alleged verbal assault witnessed by a second firefighter as well as the recent lawsuit filed against Elizondo by firefighter Sacramento Diosdado after the change from 69 to 71 on Elizondo's test placed him above Diosdado for the rank of captain. Elizondo originally scored a 69 and Diosdado a 70. With the unexplained changes, Elizondo scored a 71.
Civil Service department director Carlos Ayala, who has since resigned, claimed he had a lapse of "dementia" and cannot recall how the points were added to Elizondo's scores to place him above Diosdado.
In the alleged verbal assault, both the alleged victim and the witness have filed a police report and have been interviewed by Brownsville Police Department detectives. So far, there has been no movement in the case.
Horn has told intimates that should Cabler recommend that Elizondo be hired, he would go public with his objections. Among his objections is a 2002 felony charge for theft that was dismissed after Elizondo agreed to pay restitution in Abel Limas' 404th District Court. Representing him in that case was then court-appointed defense attorney Armando Villalobos.
However, other sources say that Cabler is under pressure from at least two city commissioners – Jessica Tetreau-Kalifa and Cesar de Leon – to tap Elizondo for the top firefighter post.
Both of those commissioners are said to have aligned themselves with Cameron County Clerk Sylvia Garza-Perez and are pushing for him to get the top post.
The local daily reported that 39 people – including interim Horn and Elizondo – applied to fill the position left vacant when 30-year veteran Fire Chief Lenny Perez left to fill a similar position in Pharr. The applications, according to the story, are still under review before the interviews are scheduled.
Diosdado filed his lawsuit in the 444th District Court Oct. 16. He asked the court to issue a temporary injunction and a temporary restraining order preventing the city from from filling any captain vacancies until the merits of his lawsuit have been finalized.
Named in the lawsuit as defendants were the city, the City of Brownsville's Firefighters and Police Officers Civil Service Commission, and Elizondo. Elizondo is currently president of the International Association of Firefighters-Local 970.

The city manager, Charlie Cabler has a way of rewarding those that will be loyal to him, as he did with hiring the assistant city manager without experience and her only qualifications was being the daughter of a fellow policeman. Charlie created a committee to make it appear the selection process was fair and transparent, when in reality the committee was stacked with people he controls. In that instance, Charlie appointed the police chief Orlando Rodriguez and Norma Zamora to guarantee the outcome. The position pays $123,600 annually, plus benefits, which is not bad for someone without any experience as an assistant city manager and she has now moved on to San Antonio. Cost taxpayers a lot of money to hire people that are not qualified, and the compadre system is very much alive. The same is most likely to happen with the Fire Chief appointment, which is ear marked for Carlos Elizondo regardless of how the rank and file may feel about Carlos or his qualificaitons. Carlos is most likely to get the appointment, because Carlos knows how to play ball. Stacking the committees by Charlie guarantees the results as the sports park audit proved when it was given the seal of no wrong doing, when there was many irregularities, unauthorized and illegal spending, but the public perception created to poke our eyes is created by the city manager to protect people like Atkinson to cover the Sports Park Gate. If only an independent forensic audit audit were done, the skeletons would talk and you would have the Texas Rangers here.

The best decision the city can do is hire someone from the outside for this position. It's obvious that there will be lots of favoritism toward all those kissing his ass in his department. As a Brownsville taxpayer I fear if he is appointed it will cost taxpayers money. City Council we voted for you and you are the voice of the citizens.
