WILL IT BE LA PALANCA OR LEGAL PERFORMANCE AT 445TH?

(We received this in the email today in support of Rene De Coss. We have met him and he is the real deal. He is facing an uphill fight against the palanca so we will see how that goes. We would hope that history doesn’t repeat itself by electing a woman lawyer that wants to play judge over someone far more qualified. Anyone come to mind?)
IT'S ALL ABOUT GETTING IT RIGHT

As a judge, one carries an enormous responsibility to assure that the law is applied fairly and impartially and – most importantly – correctly.
The law may be an abstract, but every decision we make affects breathing, living human beings. It may send someone to prison for many years for a crime. Or it may free wrongfully accused persons.

We can't afford to get something "partially" right, or wrong. Every "i" has to be dotted and "t" crossed to give all the parties in a trial an even playing field.

When judges fail in the application of the law, it mocks the concept of a fair and impartial legal process that can result in a murderer walking our streets, kidnappers thumbing their nose at their victims, criminals attacking our la enforcement officers without facing any consequences, and brings dishonor to our profession.

I am proud to say that in the 1,000 or more cases over which I have presided, only two have had appeals filed regarding procedure and one already came back upholding my decision, finding no error. There is only one still in the appeals process.

We're all humans and no one's perfect. But rest assured that if you decide to keep me on the bench of the 445th District Court as your judge this November 8, every decision that I make will be based on sound legal principals that will prevent such grievous miscarriages of justice.

Let's get it right the first time.

I have covered the Tipton case and De Coss has actually done a great job. My only concern is how he got into the issue of who can and cannot file things in the case. But I went out of my way to say his Intent, and Intent is everything was to insure the defendant was not given an out because of improper filings. De Coss has held his ground where the law allows. But there are things for the attorneys to do. the judge is not an advocate for either side. He knows the indictment is flawed, but by law he cannot act on it. He cannot take sides. Only Saenz can amend the indictment to make it right. But if the defendant walks over the defective indictment it will not be De Coss' fault, it will be Saenz.

Also judges do not write the jury charge. It starts with the DA and then defense counsel argues for changes. In the Hernandez case, Saenz and his staff messed up the jury charge. Without a motion the judge had not right to change a jury charge agreed to by the parties.

Saenz is your problem. If you want justice for Mary Tipton protest in front of the FBI office and demand Saenz be indicted. That will make national news if you can get 50 people there.

Let"s have faith in our community. Some of us think before we act. Being that De Coss is Republican, could be an issue. For those of us that know and have dealt with Gloria, please consider voting democrate. De Coss' opponents who is on an ego trip and her 1 concern is herself. I'm Democrat; however, De Coss has my vote.

I'm a democrat but, De Coss has my vote and family and friends are voting for him. Palanca days are gone...

DeCoss has my vote. The fact that his seat has not been controversial is a positive for us. He is a quality young man and has served Cameron County very well.

I agree, forget the palanca.This is man has served honorably. How can one ignore the fact that he is the best qualified. My family and friends are going with Judge DeCoss. Oh, and by the way, we are all democrats.
