By Juan Montoya
On the day that police and investigators from the Cameron County District Attorney's Office showed up with search and arrest warrants at former Brownsville Fire Department Chief Carlos Elizondo's house, he was said to be fishing.
When he was given the heads up by friends that the fuzz was knocking on his door, he headed back to the city and went to his lawyer Noe Garza's office on the corner of 9th and E. Van Buren streets to confer with him.
DA investigators found out he was there and showed up and told Elizondo and Garza that unless the wanted man gave himself up within a period of time, they would have no choice but to enter the building and arrest him. After the time was up, they did. But Elizondo and Garza were already gone.
Fearing that Elizondo – with family in Matamoros – might abscond or try to flee the city, they had the Brownsville Police Department dispatchers issue an all-points bulletin to arrest him on sight. That didn't last long because unbeknownst to the officers, Garza had already spoken with Cameron County District Attorney Luis V. Saenz and they had agreed that Garza would bring in his client.
Now, Garza could have taken him to the Rucker-Carrizales corrections center in Olmito and have his client give himself up and get booked and arraigned there. Instead, it appears that Garza and Saenz agreed that he should bring Elizondo to the second floor of the Cameron County Courthouse's administrative section on Harrison Street. A grand jury had indicted the demoted fire chief with Theft by a Public Official and Misappropriation of Fiduciary Property
What Garza didn't know was that the media had been alerted that Elizondo was on his way there and that they should be waiting in the hallway. The DA's offices have locked doors and can't be entered unless someone from the inside unlocks them. What followed was a lengthy period of time when Elizondo, Garza and attorney Victor Ramirez waited as the media tried to question Elizondo about the charges.
The wait only lasted for 3 and one-half minutes, but to Elizondo and his layers it must have seemed an eternity as reported asked him about the charges and he deflected them by turning to them. Some said that Elizondo's pacing and repeatedly looking through the glass to the inside reminded them of a cornered rat.
(The Brownsville Herald documented the moment and included the link in its website. Click to view.)

"Do you have anything to say to your community?," asked one.
"Does this have anything to do with the private ambulance company?," piped in another.
At one point Garza turned and rebuked them by saying: "He doesn't have to say anything...this is all political."
Finally, an exasperated Garza addressed himself to the people behind the door and said that if no one was coming to serve the arrest warrant they would leave.
Some insiders say that the fact that the defendant and his lawyers were kept waiting and that the media had been alerted had enraged Garza to no end given the fact that he and Saenz supposedly enjoy the greatest of friendship. In fact, Garza's wife Adela Kowalski Garza, works for Saenz as one of his prosecutors.
"Noe was pissed that they had to wait in he hallway and that the media was alerted to Carlos being taken there," said a courthouse observer. "He and Luis are supposed to be the greatest of friends. On Luis' birthday, Noe lets him use his ranch to have his parties. He wasn't expecting that."
After Elizondo turned himself in, he was then led – handcuffed – out the back door, and in the full glare of the cameras. He was then taken to Rucker-Carrizales for booking.
"If Garza had just taken Elizondo directly to the jail, he would have spared himself the grief of being cornered by the media," the observer said. "But he thought that had been taken care of when he talked to Luis."
There was also another bone of contention, they say. Apparently, Luis had wanted the panel of district judges to appoint Noe's wife Adela Garza to the new position of Associate Judge and had lobbied with them to appoint her. Former commissioner Ernie Hernandez and his wife Norma – a waning, but still latent political force in Brownsville – were also lobbying for their daughter, former JP Erin Garcia, to be appointed to the post.
Instead, the panel of district judges opted to appoint attorney Louis Sorola, married to JP Mary Esther Sorola and son-in-law of Pct. 2 commissioner Sofia Benavides as a safe and competent compromise.
"What happened in the Elizondo episode made Noe mad that he and his client had been left waiting outside at the mercy of the media," one said. "Noe was livid. He wasn't expecting that. Let's see if he lets Luis use his ranch for his next birthday party."

I WONDER HOW MUCH MONEY THIS CROOK IS USING FROM THOSE $62,000.00 THAT HE STOLE FROM THE CITY OF BROWNSVILLE AMBULANCE SERVICE TO PAY FOR ATTORNEY'S FEES??? NOT JUST ONE ATTORNEY BUT TWO ATTORNEYS??? GARZA AND RAMIREZ!!!!!
GARZA'S WIFE AS A PROSECUTOR FOR THE DA'S OFFICE IS A WORTHLESS AND WASTE TO TAX PAYERS MONIES!!!!
ELECTIONS ARE COME AROUND AGAIN AND WE'LL SEE WHO GETS ELECTED NEXT TIME!!!!
Carlos and his wife Cindy Elizondo Huerta think they are above the law and feel that they are better than everyone else. Sorry Carlos, reality check, the long arm of the law caught you.
theatrics
CARLOS ELIZONDO IS NOT A GOOD ROLE MODEL FOR OUR STUDENTS AND COMMUNITY.
WE KNOW HE'S CORRUPT AND NEEDS TO STEP DOWN FROM THE BOARD.
ITS TIME FOR AN INTERNAL INVESTIGATION ON THESE SCHOOL BOARD MEMBERS. SOME DESERVE JAIL TIME IT'S A FACT.
CARLOS ELIZONDO
CERSAR LOPEZ
JOE RODRIGUEZ
COWEN JUST STARTED ...
RATAS !!
Carlos is a great guy, you will see at the end that he gets off from this political arena a few firemen are after. Puro Pinche pedo. Once again, Carlos has the bigger hose and the with small hoses are pissed. HA HA HA
I agree. To many people involved.
What is this so called high profile atty. Noe Garza, doing at the ADMINISTRATIVE office? Is he and the so called corrupt judge going to post bail, and make an application for an estate or a juvenile under the age? Then they use it as tool to manipulated the bail along with more monies and later claim it as forfeiture money. We the lay citizens of Cameron county have been played this game. This is guarantee that "he" Noe Garza and the judge get paid for cover-up corruption. They are not denying us "JUSTICE" for free. Take a big wif of corruption at it's best/ FBI Check how many estate and probate cases are being set for a hearing with no monies nor restitutions but set up by our so called judges as SHELLS to transfer monies into their own pockets. Maybe we should go back to an eye for an eye and a tooth for a tooth senerio, and take the law into our hands. This is just an opinion
His Attorney is just as bad as Carlos lets see what kind of deal he makes wit the DA since his wife works for the DA.
I am sure he will come out fine in the end. He will sell out and throw everyone else under the bus in order to get the best deal possible.
So we were invited (forced) to go to Dr zendejas show with Pablo Montero. Guess who's ambulance service was staged outside the TSC performing arts building? That's right intercity!!!
The show was half empty on Friday night. The porter cowboys (they lost by 70 points) had a bigger audience.
What I think will happened will be and I predict this Noe Garza is going to ask to take the case to another County, because his eat of a client is going to say he will not get a fair trial, well let me see, will we have another To My Yzigurre case let off easy? I think Carlos has alot of information recording's that will bring down alot of people will this be his plea bargain? Will be serve any time? Maybe just probation? I don't know but I think this Rat will be released free out into our community like the Rat he is!!
Learn to write you Hoser.Must be great since you've seen his hose and everybody's elses Ha Ha Ha.
Of course Carlos is a good guy, he is such a sweet heart and loving man.
Thats why he felt the need to record and black mail a commissioner, and the $8,000 he withdrew from an ATM, that was for charity. He probably block walked down town handing out money to the needy.
AND if someone says no money was handed out to the needy down town, then it wasn't Carlos how withdrew the money.. era otro!
Good advice
I'll consider

Advise to attorney Noe Garza, drop Carlos Elizondo case and recuse yiurself. Let me tell you why, you have a good track record of winning your cases and Carlos is a sure loss for you so bail out while you are still ahead. Also, Carlos has burn so many bridges, no one will ever trusts him again and his enemies will become yours and that is bad for business. Overall Elizondo is done, his burned and attracts to much heat for any future deals. In a nutshell. The End.
It is an open secret that the DA, Luis Saenz has a double standard when it comes to prosecuting local individuals or politicians. The standard is not based on right, wrong, truth or justice, Luis will prosecute those that he deems will give him high exposure and he can use to manipulate the masses with in pursuit of his political agenda.
It is not surprising that he set up Carlos Elizondo and his attorney Noe Garza to get media coverage for himself. Luis Saenz will do anyting that helps his agenda and it is not about justice.
Learn how to spell with Angel.
You must really feel like a chicken shit, because Noe only wins cases outside of Cameron County, if you do a dirry deed in Cameron County that person should be trailed in Cameron County, not in another county.. just saying.. be a man rhe vood attorney you say you are. Let's see if he can get off clean,
