DA FILES 2 MORE CHARGES; BREACH OF UNION COMPUTERS

News reports indicate that former Brownsville Fire Chief Carlos Elizondo has been slapped with two more charges by the Cameron County District Attorney, this time having to do with the breach of  computers' security and gaining sensitive information from the firefighter's union PAC site.

Noticias Nueve earflier reported that ELizondo accessed the computers and retrieved information when he was not on duty. According to other sources, when computers were confiscated from Elizondo's home as authorized by a search warrant, investigators discovered he had gained unauthorized access to the union site and made false entries with the use of their password.

Records obtained by the Brownsville Herald indicate Elizondo has been charged with two counts of computer security breach — Class B misdemeanors — and that the incidents occurred Sept. 7, 2017. The charges were filed against him Wednesday.

According to the Texas penal code, a person commits a computer security breach “if the person knowingly accesses a computer, computer network, or computer system without the effective consent of the owner.”

A spokesperson for the Cameron County District Attorney's Office would not say what the charges pertain to.

KVEO reported that it had confirmed that Elizondo was arrested Wednesday,according to Cameron County District Attorney Luis V. Saenz's spokesperson Victoria Cisneros, "under the authority of an arrest warrant, Carlos A. Elizondo was arrested for Breach of Computer Security. He was remanded to county jail, where he was held until he had his initial appearance. He subsequently posted bond."

On October 23 Elizondo's Brownsville home was raided by Cameron County District Attorney Investigators. On the same day, Elizondo turned himself into authorities when a warrant was issued for Theft by a Public Servant and Misapplication of Fiduciary Property.

The Brownsville Fire Fighters Association accused Elizondo, who was solely responsible for the account, of misusing money and leaving dollars unaccounted for.

"Brownsville Firefighters Association] came to me to inquire about the process for how they could get the information together to be able to provide to the Texas ethics Commission." former Brownsville Independent Schoool Distict trustee Caty Presas-Garcia told KVEO.

Presas-Garcia served with Carlos Elizondo on the BISD school board. She recalls the faces of the firefighters who took over the PAC and helped build a case for the TEC.

"The firefighters that are donating and contributing to the PAC really believe and entrust that whoever is handling the PAC is truly honest and abides by the regulations of the PAC. That was not the case here." Presas-Garcia explained to the station.

This comes on the heels of a visiting judge's denial of a request for a hearing to challenge the search warrant that resulted in his arrest on theft charges.

In late December, the Brownsville Herald reported that his attorney Eddie Lucio filed a writ of habeas corpus challenging whether “good ground” existed for the issuance of a search warrant targeting Elizondo’s home. The court motion alleges that the investigator who prepared the warrant did not provide sufficient facts to establish probable cause and that 404th state District Judge Elia Cornejo-Lopez, who signed the warrant, was not neutral because of her relationship with the Brownsville Independent School District Board of Trustees.

Elizondo is a member of that board and Cornejo-Lopez, in her capacity as a parent, filed a federal lawsuit against BISD over how grievances she filed with the district were handled by school administrators and trustees.

Visiting Judge Martin Chiuminatto ruled that since a grand jury has already handed down indictments against Elizondo, his right to an examining trial regarding the search warrant has been extinguished.

In early April, Cornejo-Lopez recused herself from the proceedings, explaining that regardless of the outcome of the criminal proceedings, Elizondo should feel that he had a fair day in court.

It is obvious that someone has an ax to grind and has a bunch of cowards he hides behind. If DA Saenz would pay as much attention to other cases and he has done on Elizondo's his nephew Joey would be in jail and maybe even
Yzaguirre. Pick your fights Saenz, but just wait and see how what goes around comes around. Let the case go to court so that they can appeal to a higher court who is not corrupt like ours down here and then va a bailar el change! Any law student knows that a conflict of interest was present when Cornejo signed the search warrant, making any evidence from the search as inadmissible in court. Carlos, go for it and hire Perry Mason if needed, pero no te dejes!

ANONYMOUS AT 08:15pm.....let me put it to you in simple retarded terms. This individuals crimes or "minor crimes" go as far back to Los Fresnos EMS years. He stole alot of lumber & amongst other thefts from then on. He's hired lawyers in the past to "expunge" aka delete crimes from his criminal booking records, the proof is there dumbass. Now with that being said, given that he has a corrupt thief past, anytime a person gets a certain criminal charge expunged they sort of go into a probation status, meaning he has to stay "clean" "out of trouble" etc. if not the next time around "criminal charges" will be stiffer. This individual, as you know, has not been able to stay out of trouble, he thinks his local political buddies can offer him immunity. It does not matter what lawyer he gets, he will not get any liniency because of his past. He's simply acting like a 5 year old throwing tantrums. He's long gone from the fire department & his only hope is to keep running his ambulance business. He's been caught end of story. Unless you think these visiting Judges are lying & risking their jobs for a crook like him, i doubt it. Now, do you really think a high level Federal Judge is going to "Ok" all the corruption he committed and simply grab a pencil to erase his corrupt past? Nope! You must be very delusional to think yes. His best bet is to get rid of the lawyer he found in the Bargain Book & save his pennies to pay back everything he stole in hopes of getting a lesser sentence.

Oops! I guess some of us are living a very conservative life and are not aware of all the gossip that floats around in this city like a cestpool. If what the blogger of 10:49 stated, if such is true, why did the Civil Service allow for him to appointed Fire Chief. Why were all these matters not brought up when he even applied for the job in Brownsville. That is why some of us question so many politicos about "the real honest to goodness" politician. Who is he and where is he? We need to clean house in this city if such is the case and Juan, a good research for you would be to compile a list of all elected officials and research their background - corrupt, good or indifferent and publish it in the blog for others to read. Then, we must make a decision about whom to believe or not. You see the problem?

Yes, as I stated. He had all his criminal record expunged so when the day would come to hold the Chief position, on paper he would be the "ideal chief" with no bad history to perfectly meet the requirements for the chief position. Now, the chief position does not fall under civil service laws, it's an appointed position by the city "leaders". In his case, he sucked up to the old city manager Charlie Cabler & eventually was appointed chief instead of other highly qualified personnel that actually earned their rank & have many qualifications that would benefit the fire department personnel. He didn't even pass the promotional exam to be a Captain, he & cabler pressured the previous civil service director to change the scores but after doing so he resigned, he knew it was illegal & would cause alot of problems in the future. This person is very corrupted & will be stopped very soon.

How sad that the community of Brownsville and/or some of the family members that live within the city limits or being short changed in services that should be rendered by the Fire Department/EMS for the city. Instead of hounding a local ambulance service, why not let the Fire Department give up EMS. Either Provide the Quality Patient Care that is needed both for Emergency and for Non-Emergency Transports or contract out the Non-Emergency Transports. The City knows that plenty of other companies, i.e. Carrousel, Vitalis, Med Ex, all are coming in to pick patients and take them to dr. appts., dialysis, and return them (patients) to their residence in Brownsville. Where are the investigators, city inspectors, or who ever it is that is suppose to be watching these outsiders coming in and providing services without a permit (does the city does not have a permit process in place????) Where does the city draw the line? Politico, Wow, Citizens of Brownsville Wake Up, Watch and Learn, let your voice be heard, go to the commission meetings, make some noise. Enough is Enough, why do patients have to wait for hours after their treatment at dialysis because the fire Dept doesn't have an ambulance available and/or waiting for another company to come in from McAllen, Edinburg, etc., to pick up this patient adding to the long waiting time.

Ok blogger at 03:08 lets go ahead and break down your retarded comment. #1 why not let the city fire department give up the EMS side & let other ambulances take over? EMS makes the city money in the millions, if you dont believe it then submit a public information request to the city. The fire department alone does not make profit, if anything it looses money via wages to employees , equipment/vehicle maintenance etc. If the fire department payrate drops Alot of fat firemen will be pissed off & eventually will fight to bring back a city owned ambulance service (the reason the fire department was merged with EMS in the first place). Other fire departments in the RGV pay very low wages that the personnel actually qualifies for foodstamps etc. So no, your stupidity needs to be evaluated. #2 other EMS services work in the city? Well Carrousel EMS for instance specializes in pediatric(children) transfers because they have specialized equipment to do so unlike Brownsville FD. If you say taxpayers are being "short changed" then the next time you see an ambulace that doesnt belong here call the police department yourself to report them, eventually they'll be caught like your friend Carlos Elizondo & Ernie estrada. #3 why do patients have to wait so long for ambulance transports? Well that has nothing to do with the fire department. Example: more than half of the "emergency" calls in brownsville are from citizens that think arm pain is a 911 emergency or others simply call an ambulance to get into the emergency room faster. So its our own citizens screwing over other citizens that really need an ambulance thus creating a "delay" long waiting periods for bedbound citizens. So get your info in order and dont just say what carlos or ernie are telling you to say. Or you can volunteer free rides with your own vehicle , just go park outside a dialysis center & knock yourself out. Or incase you are a disgruntled fire department employee simply PROMOTE to a higher rank if you don't like EMS LOL

You are so wrong Anonymous at 5:34 PM, it was not Carlos who commented, why do you always direct anything that has to do with EMS to Carlos, who are you, These companies don't want the emergency calls because THE CITY OF BROWNSVILLE FIRE/EMS IS THE 911 COMPANY WHO SERVICES THE CITIZENS, and the entire city, never mind the waiting for emergencies, ambulances are too busy doing non-emergency calls, too much money going to waste, let anyone else as stated before come from McAllen, Edinburg, etc. who wants to come and eat the lunch, and probably move $$$$$ under the table to allow these companies to come to Brownsville, soon thereafter, there will be another Hidalgo County with at least twenty or thirty companies running around at each corner, what do you think will happen then? Carlos might not be around, but perhaps you might be to continue the saga.

Go to www.dshs.texas.gov and check out the level of service that they can provide. They are not SPECIALIZED!!!!!!!!!!!! the license itself would state that. Go at it.

Again you're an idiot! Let me bring it down to retarded terms. Just because it's listed as a BLS ambulance with TDH does not mean they do not carry SPECIALIZED equipment dumbass. If their Medical Director allows the EMT-Basic to "operate" iv pumps, ventilators and/or other equipment they definitely can!! I never said they SPECIALIZE in starting intravenous access or advanced airway placement. Other states in the USA allow Medical Directors to train or allow EMT-Basics to provide iv therapy, advanced airway etc. Texas leaves it up to the Medical Director! Fking rookie!! You must have less than five years in the field, i feel pitty for you.
