A visiting judge quashed a motion to remove Brownsville Independent School District board member Erasmo Castro and ruled that the petition filers must resubmit their petition and post a $25,000 bond.
Castro filed the motion to quash and dismiss the removal petition. That petition includes affidavits containing statements from three people who say that Castro has been harassed and threatened on social media.
Senior Judge Romeo Flores issued his ruling after a hearing this morning in the 197th District Court.
The petition filers have not indicated whether they will resubmit and post the $25,000 bond.
The petition to remove Castro from his public office was filed Sept. 24. Castro was arrested on a charge of driving while intoxicated in the early hours of Sept. 2 in the 900 block of Morrison Road. He was arraigned on one count of DWI, a class B misdemeanor, and was released on $1,500 bond.
However, sources at the DA's Office say that the constitutionality of the statute that removes elected officials for intoxication may ave to be decided by an opinion by the Texas Attorney General. If the AG declines to issue an order, the petition might well be dismissed.
"It's a statute that dates back to the 1920s," said a courtroom observer. "The other problem is that there is no legal definition for intoxication. Is it one drink, two? Does it depend on a person's tolerance to alcohol?

Erasmo, if you are so righteous, and you have a conscience, why do you insist on continuing your farce leadership as a member of the board. However, the others are not that different and they are still there, but as you well know, they are smart enough to push things under the rug and not get their fingers dirty. If all the facts and figures that you printed are correct, how come the FBI has not listened to you. Do they even take you seriously? And since the judge is on your side, why don't you try to behave yourself and live up to the oath you took. Remember you said you would never do anything to embarrass your Dad the pastor? I can't wait for all the rope to be pulled and that the culprits are discovered by someone who really cares about BISD and has the power to take action. You think Luis Saenz would do this now that he will be up for reelection. I, myself, would work to reelect him just on that point - to unseal indictments and identify the wrong doings you claim are taking place.
