In a strongly worded missive to Brownsville Independent School District board counsel Baltazar Salazar, Cameron County District Attorney Luis V. Saenz challenged the opinion - issued by hired outside counsel Kevin O'Hanlon - that board member Eramso Castro must leave the board.
He said that since they claim he was drunk when on trips with other board members, the state wants their oral depositions to assist him in removing him from office.
Saenz wrote Salazar and Hanlon - and copied to Castro's attorney Angela Nix - Thursday that removing him by board vote is impermissible and that unless an election is held or a successor appointed, Erasmo Castro has a right to keep his seat under the 'holdover" provision of the Texas Constitution.
- "The Brownsville Herald has reported that Mr. Castro has resigned from the BISD Board of Trustees and that his resignation has been accepted...
"...The Herald further reported that Mr. Hanlon counseled the (board) than 'in light of trustee's resignation, he should absent himself from further board deliberations'," Saenz wr5ote.
"I write today for clarification on if the BISD school board intends to name and seat a replacement for (Castro). Furthermore, I would appreciate any guidance on how...the Texas Constitution does not apply in the case of (Castro).
Saenz said that the Texas Attorney General has in the past "opinioned that Article 16, Section 17 of the Texas Constitution applies to school board trustees that have resigned and a replacement has not been qualified to fill the position vacated by the resigning trustee."It does not say, nor does it mean, that officers may perform the duties of their offices until their successors are qualified, but that they should do it. Such is the contract between them and the state when they take the office, and there are many good reasons why the constitution should be thus interpreted."
"I do very much appreciate clarification on (these) matters. If the school board does not intend to name and seat a successor for (Castro) or hold an election to fill said seat, then as a matter of law he is still the office holder for Position 2 of the BISD school board. Consequently, the State of Texas through (Saenz) has an obligation to continue to pursue the case to secure (his) removal."
"It is alleged (he) is subject to removal because he became intoxicated by means of the introduction of alcohol into his body. It is the case (he) may have on occasion, while traveling with the BISD (board members), become excessively intoxicated. As such it is necessary to depose all the members (of the board) about incidents involving (his) excessive alcohol consumption.
"Therefore, if BISD does not intend to name a successor for (Castro) or hold an an election to fill said seat then please provide dates of availability for all BISD board (members) save Castro, to appear at the office of District Attorney (Saenz) so oral depositions may be taken, starting with Dr. Sylvia Atkinson."

Seriously both of these so called knowledgeable persons that have been in these positions for a very long time should know PROCEDURE. One of 2 things are happening here, 1. Self-interest for this behavior, 2. They really are STUPID and if so should be removed from office and at that point should reimburse the school district for defrauding them that they really knew their jobs, LMAO.

But when we had a superintendent who knew her job and was doing well for the district, we let her go and brought in this Carl Montoya, Jr piece of a new superintendent. He takes no part in the meeting and looks like he is spaced out all the time. Not once is he asked for his insight or his interpretation by any of the board members. He would let SPA control him also by even removing items he had placed on the agenda and he OK'ed it. If you know anyone in Edinburg, ask them about their ex-super. What was he known as and what was his main interest? The spineless school board we had that decided to let Dr. Z leave, did her a great favor in a way, for she was too good to have to sit there and take all the lousy lying and cheating going on with the district. It was so obvious of what was going on when we'd follow the board meetings. Like the saying goes, "One does not know the good we have until we loose it." If I were Dr. Z, I'd sit back and laugh at this "As the World Turns" continues in BISD.
juan i agree with 10.30 am, looks like both the superintendent and the bisd board attorney are only there to pick up a paycheck and screw the direction of the school district. Slefinterest and whats in it for me.
It feels good to see that there are some people who do keep a watchful eye on the school district and know that the new superintendent has nothing between his legs. He does not open his mouth except to say, "Yes, Ma'am!" But knowing what I know, it is quit obvious why these "Ma'ams" decide to hire him and give him great reviews because they can all control him. When did you ever see the board come back from a closed meeting and then publicly comment on the evaluation of the supt - whether good or bad? When did they ever pat Dr. Z for doing such a great job in bringing the district to an A rating? No
they praise Gutierrez for doing great things and what is so funny is that Gutierrez almost gets close to giving Dr. Z the credit for leaving the district in such good standings. But these viejas chuecas never said anything good about her because of the green-eyed monster. The one that really takes the cake is Drue Brown, who is the best two-faced individual that stabbed Dr. Z in the back. With friends like her, who needs enemies. She also did that to her Comadre SLP when she sided with SPA. Drue, you really showed your loyalty to your once friends.

Wow, just learned that Eddie Garcia was appointed to replace Erasmo. Let me ask the public if they know how Eddie is related to Aurora de la Garza and Luis Saenz. Would that not be a conflict of interest for the DA who will be holding a trial on another board member in early Feb.? Same old, same old thing - same families. Aurora is out but relative appointed to TSC board. Now Erasmo is out and another of Aurora's relative is appointed to the BISD board, and a nephew to Luis Saenz. Orale, pues; que pasa con esto? Now we have two police officer on board so they should be able to keep law and order at the meetings, right? Don't hold your breath!
