TRIAL OF SAN BENE COMMISSIONER'S MATE NEXT MONDAY

By Juan Montoya

All is set for the trial of David Lee Hernandez, 33, the father of City Commissioner Carol Lynn Sanchez’s children, who is accused of shooting at her father.

Hernandez is charged with Aggravated Assault Deadly Conduct, Discharge of Firearm, and Unlawful Possession of a Firearm by a Felon.

Hernandez indicted by a Cameron County grand jury on Nov. 20, 2019.

The case stems from an event in which Hernandez allegedly aimed a handgun at Carol Lynn Sanchez’s father on July 7, following San Benito city’s ResacaFest on July 6.

Hernandez was allegedly intoxicated when he requested driving his father-in-law’s vehicle at the Sanchez’s family home. When his father-in-law (unnamed in the police report) refused to let him drive his vehicle, Hernandez shot at him, missing him by a hair and fleeing the scene once he heard police sirens.

Hernandez, who was booked on the second-degree felony on July 9, was released from the Cameron County Jail on July 11.

The case is scheduled for 8:30 a.m. Monday, Feb. 17, in Judge Benjamin Uresti's 107th District Court.IMG_0527.JPG 4x6
At the time of the arraignment, commissioner Sanchez described the police department’s report as “BS.”

“I cannot believe they would take it this far,” Sanchez stated at the time. “I will be filing a formal complaint against the department.”

The victim told Detective Manuel Alvarez that Hernandez was drunk when he fired his pistol at him after he refused to let his grandchildren’s father drive his car.

“When (Sanchez’s father) refused to allow him to leave in the vehicle, David pulled a pistol from his waist area and readied the pistol by pulling back the slide and loading a bullet,” Alvarez wrote in an affidavit. “He then pointed the pistol at him and fired the pistol.”

According to Alvarez, Hernandez came close to shooting Sanchez’s father in the face.

“(Sanchez’s father) told me that he could feel the hot air of the burning gases pushing against his face as the bullet passed by his face,” Alvarez wrote. “He could feel the gunpowder hit his face.”
Two days earlier at the family’s home, Sanchez declined to describe the shooting incident because she did not want to be listed in the report, Alvarez wrote.

“I asked Carol Lynn to tell me what happened as I was told she was there,” Alvarez wrote. “She told me she did not want to be in the report, but she would substantiate what her parents told me.”

Court-appointed attorney Nat Perez was assigned to represent Hernandez.

What is said is that the commissioner’s Dad is nowhere to be found. If my Dad went missing I would have filed a missing person report with a law enforcement agency or something. Maybe it’s part of a master plan so the commissioner’s mate will not be prosecuted for the crime due to lack of the victim/ commissioner’s Dad. Anything is possible in san bene they roll to a different beat there.

Just an observation.... I wonder how he qualifies for a court appointed attorney.

A 90% reduction in bail for someone who fled the scene when he heard sirens make it all too likely he will not be in court come Monday.

Well the Dad/Victim did show up for the court Hearing today. Reset for April the 27th. If the Dad/ Victim doesn’t show up for that hearing the case will be dismissed and all will be well in Hernandezville.
