Just a little over two weeks since new county officials have been sworn into office, the Cameron County Commissioners Court will be briefed by legal counsel during their meeting today on the potential exposure of the county to litigation arising from the apparently illegal and unauthorized imposition of a Sheriff Department chief deputy who was not yet a county employee.
Additionally, the Human Resources Department has since confirmed that Sheriff Eric Garza's right-hand man and one of this major campaign contributors – retired U.S. Drug Enforcement Administration agent Robert Gracia – was not one of the eight applicants for the announced position which closed after a week.
But even if Gracia had been among the original eight applicants, he lacked the Texas Commission Of Law Enforcement (T-COLE) certification that the job description required.
Garza could decide to not choose from among the eight and to open and readvertise the position for more applicants for a longer period. In fact, he could have the former chief deputy – Gus Reyna – fill the position temporarily until Gracia passes the T-COLE exam and then readvertise to give him an opportunity to apply.
After all, the chief deputy is an "at-will" employee and serves at the pleasure of the elected official.
Nonetheless, according to deputies and jailers, Gracia, acting under the color of authority, as early as December 30 ordered all sheriff department personnel to attend three swearing-in ceremonies for Garza January 1, and required them to fill out a 34-page application for the positions they held on pain of disqualification or termination.
Was the county exposed legally to complaints by department personnel who might have objected to Gracia's apparently illegal role in the department?
In an email sent to sheriff department employees December 30, he also demanded two sets of keys to the administration building and access to the confidential and sensitive information of its personnel and a report on the status of investigations being carried out by the department. And under his direct orders, several employees were transferred to different department divisions.
Were those demands and transfers legal? And where does the department and the county go from here?
