RINCONES DISSOLVES TRO, GARZA RUNS OFF DEPUTIES, REPLACES THEM WITH HIS SHERIFF DEPT. PERSONNEL

Even after he had urged the Cameron County Commissioners Court to transfer the supervision, equipment and courthouse security budget from Pct. 2 Constable Abel Gomez and unilaterally rescinded a Memorandum Of Understanding signed by his predecessor, Cameron County Sheriff Garza failed to attend a Zoom meeting Tuesday where the transfer would be discussed and voted upon.

As a result, the commissioners tabled three items that would  transfer courthouse security to the sheriff’s department from the Precinct 2 Constable’s Office, transfer the budget to the sheriff’s department from the Precinct 2 Constable’s Office and transferred and reclassified employees to the sheriff’s department’s from the Precinct 2 Constable’s Office.

But just a few hours later 445th District Court Judge Gloria Rincones dissolved a Temporary Restraining Order preventing Garza from removing or issuing orders to the 15 deputies and court bailiffs under the commissioners' courthouse security budget and he immediately ordered the deputies to leave the courthouse and replaced them with his own personnel.

Rincones also denied the commissioners court’s petition for a temporary injunction against Garza after dissolving a temporary restraining order filed by the commissioners.

Garza claimed though his Office Administrator Rick Cornejo that he had conflicting schedule and would be unable to attend the Zoom meeting of the commissioners court Tuesday.

When Cornejo said he could answer any questions the court had, Cameron County Judge Eddie TreviƱo said that since he wasn't the sheriff and not responsible for courthouse security, the commissioners tabled the items.

They then issued an order citing Gomez's performance and his deputies training in courthouse security, active shooter and SWAT training and kept them under the constable.

They, under the state process, ordered all the signators to meet for analysis and consultation to resolve the issues.

The budget under which the 15 deputies are paid is based on a Memorandum Of Understanding signed originally in 2014 by the district and county court at law judges, Human Resources, the commissioners court and former Sheriff Omar Lucio. It was renewed in 2016. 

And a 2017 state law gave the courthouse security option to the commissioners court to provide a budget and trained personnel to implement it. The statute specified that the deputies should be trained and certified in the various areas of  courthouse security. They are also under the rules of Civil Service.

As it stands now, the 15 court-budgeted deputies remain under Gomez's supervision and listed under the commissioners' courthouse security budget and the sheriff will have to provide their replacement.

Rick Cornejo, office administrator for the sheriff’s department, said during the meeting there was a conflict with Garza’s schedule but that he would be available to answer any questions they had. Since Cornejo is not the sheriff or in charge of courthouse security, Commissioners Court chose to table the items instead.

It is unknown if the 15 sheriff department deputies who replaced those funded by the commissioner court are certified in courthouse security, active shooter, and SWAT training as required by the state. It is doubtful, however, since it is Gomez who provides that training, and except for recent two recent hires, all had been trained in the subject matter.

The court set a status hearing for May 25.

"Garza won the argument and Gomez gets the trophy (15 deputies under the courthouse security budget)," said a courthouse administrator. "He just keeps making things worse and worse for himself and his department."

Dissolving the TRO only proved the reason it needed to be in place. Even after consulting with the Commissioners Court, having a TRO, and removing the TRO, the same issue seems to have presented itself. Now Garza has shown he is over staffed at the Sheriff’s Office and 15 people never needed to be there…. Otherwise he wouldn’t have the staff to move to the courthouse. And if they aren’t qualified then he has also built a solid case for being removed in less than a year from being elected and appointed….

Where is the order dissolving the TRO? Or does the Sheriff just say to people that the Judge said it was dissolved? It has to be documented somewhere to be effective. Otherwise, where is the proof? He carries the transcript of the hearing around?

Even worse is when that puppet master is Eddie Guerra. He tells everyone that you do what he says. It must suck to have him in charge of you Abe. If only Eddie was smart enough to know that he is getting played.

What the judge should do is stop the rise in property taxes pull the trigger Judge. You don't have enough staff to cover your regular shifts, you can't over work deputies after many 12-16 hours shifts they become a liability the body gets tired! you are going to send deputies that aren't trained. Now you placed your deputies in another situation that aren't trained for, you just placed Judge's and ALL CAMERON COUNTY STAFF AND Public at the COURTHOUSE IN GRAVE DANGER! Due to lack of staff, training and equipment! Neither one of you know what the fuck you are all doing! I feel ashamed that I VOTED for you. The sheriff's department is currently understaffed. Where does he expect to get 15 deputies? Maybe Rick Cornejo, Chuck Hoskins, Ram, and the clerks who are playing cops can go protect our judges and staff. Thank you, Rincones, for putting our courthouse in danger. You just set Eric and the department up for failure. Keep in mind jailers are quitting, and the jail is also understaffed. Where do I sign to remove this guy from office? People next time vote for the qualified candidate. This is a perfect example as to why we need to set qualifications on some elected positions. This guy has proven that a reserve officer and a paper pusher is Not the best candidate. You are a JOKE ERIC!!!

This prove that the Texas laws do not apply in Cameron, Hidalgo counties. Maybe this is the reason we citizens must fend for ourselves. An eye for an eye and tooth for a tooth. Denied justice is what has and still run Cameron County. This proves also that the commissioners court is a "REAL" joke. The judicial system is not for justice, but for pay to play in the corruption. There isn't a true faithful judge in Cameron nor Hidalgo County. Keep in mind that Eric Garza and Adela Garza were the ones running the show in Cameron County for many years. They hold many valuable information that could take down the whole Cameron County system. Eric being Cameron county district clerk allowed many so called technical errors to be used to dismiss or convict many criminal offender's cases. It's time of payback for Eric Garza. He doesn't even have to be present during his own defense, he knows for a FACT that he is untouchable. Many of the offenders sit on the Commissioners Court. Is this Gloria, judge one of them? This is my constitutional opinion.

Garza is jeopardizing and playing with the safety of the citizens of Cameron County, this morning there was only 4 deputies patrolling for the entire county... last time this happen was back in 1989.... just to "show" he can manage the courthouse security..

Gomez is a good man and highly qualified to be the Sheriff. If all this goes south for the Sheriff, the county commission should appoint Gomez as Sheriff. And open our beaches.

I'm going on 20+ years in the Sheriff's Office, I have been thru pretty much everything, experienced good and bad supervisors, some that will stand up for you and some that pretend.... but what we are exeperiencing right now is beyond imagination.. I was one of the deputies that believed we needed a change but this is unbelieveable... I don't give a shit anymore I can retire.... I can tell you Abraham that I feel sorry for you, can't believe you're a Capt and lacking some much, threating deputies with getting move to patrol just because you didnt liked the answer you got, that tells a lot about you.... Huerta, you are just like Del Bosque, I understand that you rank was given, not earned, but we expected more from you guys, take pride of your badge, you're letting this people walk all over you, man to fuck up! if you need a gps to find you'lls balls let us know we can let you one at the office... worthless "Lts".

The City is in total Misalignment...Terrible job Bernal is doing...No leadership skills what so ever.. Everything this guy does he read in some book and expects it to work by having his Department heads read the same book then has a meeting to talk about what they learned... THIS is what they do in a book club!!!
Bernal hires people from outside the city pays them outrageous salaries.
He had a female do some training for all departments when she could not communicate in English she gave the whole training in Spanish... Wtf is wrong with the City Of Brownsville...Let's get rid of this Thief Bernal and get an experienced leader..

Thus the result of a vote for someone with VERY little law enforcement experience or administrative experience in law enforcement. Sure glad I didn't waste a vote on this garza!
