APPEALS CT. SETS ASIDE JUDGE'S DISQUALIFICATION OF GONZALEZ IN ONGOING DISPUTE OVER COURTHOUSE SECURITY

The 13th Court of Appeals has issued an emergency stay to set aside a ruling by 445th state District Judge Gloria Rincones that disqualified Cameron County Commissioners Court legal counsel from representing the county in court.

(The appeals court set aside Rincones' order disqualifying Juan Gonzalez, Cameron County county's legal counsel, in its lawsuit against Cameron County Sheriff Eric Garza charging he usurped their budget power in a  dispute over security at the county's judicial building.)  

The Court of Appeals issued the ruling that set aside Rincones’ ruling against Gonzalez pending resolution of a writ of mandamus.

In its ruling the Appeals Court states, “The Court having examined and fully considered the request for emergency stay, is of the opinion that the request for emergency stay should be granted. Accordingly, we grant the relator’s request for emergency stay as we order trial proceedings to be stayed pending resolution of this petition for writ of mandamus.”

In a statement to the Appeals Court attorneys for Gonzalez stated the court abused “its discretion, ignored and/or misapplied the law and otherwise exceeded its authority to the prejudice of Cameron County.”

The Appeals Court has also ordered Sheriff Eric Garza and other interested parties who would be directly affected by the relief sought, to file a response to the petition for writ of mandamus on or before the expiration of 10 days from the date of the order.

an emergency stay is very common in these situations, it does not necessarily mean that Judge Rincones was wrong. Rather, it stops the proceedings while the Appeals Court reviews the matter.

Not set aside. Just a pause on the case at the trial court level.

CHIEF FELIX SAUCEDA'S Incompetent leadership continues to shine!
CHIEF SAUCEDA WITH LAWSUIT MOUNTING AND NOW LAWSUITS COMING FROM WITHIN AS Chief Sauceda has now injured several Officers they were all injured at the shooting range as Chief Sauceda has ordered Officers to shoot and exchange gunfire from vehicles.
Sauceda claims to have read a book on gun fighting and Now is an expert on the matter!
One Officer was even shot in the arm during the UNSAFE DRILLS while others were taken to the ER with fragments that had to be removed..
All Officers have been blamed for their own injuries as Sauceda and his incompetent staff continue on their dismal leadership..
