It was just about three months ago that San Bene resident David Lee Hernandez – the on-again, off-again husband of San Benito City Commissioner Carol Sanchez – got off scot free on three felony counts after the victim, the commissioner's father, would not cooperate with Cameron County District Attorney prosecutors.
That was two years after he was charged with three felonies involving an aggravated assault against his father-in-law, discharging a firearm at his house and being a felon in possession of a firearm.
The reason cited by Asst. DA Pete Gilman was that neither the victim nor his family would cooperate with Cameron County District Attorney's Office prosecutors.
Well, he's at it again. Just this weekend (Sunday, to be precise), Hernandez got charged with one count of evading arrest with a vehicle, a second charge with a prior conviction, Possession of a Controlled Substance, and Resisting Arrest, Search, and Transportation, four counts in all.
And so, the moral to this story seems to be: You can get loaded at a fiesta, go after your father-in-law with a weapon that you – as a convicted felon – aren't even supposed to have, and then shoot at him and leave. ANd if you lead a charmed existence you can go back, jack, do it again.
Two years later, partly because of his political connections through his mate, and because her family hid her father and the family wouldn't cooperate with the DA, he walked on September 13.
In fact, in between the dropped felony charges and Hernandez's latest troubles, he took the time to attend the San Benito commissioner's swearing in along with her mother and father, the alleged victim of the aggravated felony charges.
