HERE GOES JONATHAN GRACIA SKIRTING THE LAW, AGAIN

 

Texas Business and Commerce Code - BUS & COM § 17.08. Private Use of State Seal

(1) “Commercial purpose” means a purpose that is intended to result in a profit or other tangible benefit
(b) Except as otherwise provided by this section, a person may not use a representation of the state seal:
(1) to advertise or publicize tangible personal property or a commercial undertaking;  

He was campaigning and spending money before he declared he was a candidate for for Texas District 38, including hiring a film company to prepare his television ads, giving out chicken plates, and holding anti-COVID-19 "gatherings" (read super spreaders) under the guise of doing it under his "Gracia Law Firm."

At the time, that seems to be a clear violation of the law that falls under the "resign-to-run" statutes of the State of Texas. Gracia's term as JP 2-2 ends December 31, 2022 easily exceeding the one year and 30 days stated in Texas election laws.

Under the law, "such candidacy shall constitute an automatic resignation of the office then held, and the vacancy created shall be fulfilled pursuant to the law in the same manner as other vacancies for such offices are filled."

Of course, he fooled no one, but it does show that this self-described "public servant," has pulled every political trick up his sleeve to try to get himself elected as the Democratic Party standard bearer this coming March primary. 

Now he has used the state seal to give his campaign a deceptive seal of approval from the state, a clear violation of the law.

He is again pulling his political tricks by skirting the law on the use of the state seal for his personal profit. Given the non-response by local elections and law enforcement to precious violations, this will probably also fly under their radar.

But it does belie his claim that he is not a "politician" but is rather – according to him – a "public servant."
