JOSTEN VS. PARKS FEDERAL SUIT NOT MERE ERASMO "CHISME"

(Erasmo Castro did a show on this to attack Mrs. Parks on behalf of AOBE union and there was a BISD new employees and teacher event this weekend and my son said that a lady told them not to buy a gown from Mrs. Parks or else BISD would fire him. Is this what BISD is all about now? using this Erasmo to defame people and do ugly politics? Mrs. Parks sold me my sons gown years ago and even gave him the invitations for free. As far as I know, Erasmo lives of the chisme and gets funded by AOBE for his traveling. Teachers pay close attention where your money is going to monthly from your checks.) Commenter

We have searched the files in federal court and found the lawsuit that Jostens filed against Parks. She added former Jostens representative Jimmy Ramirez as third-party defendant. COUNTER CLAIM OF COMMON LAW FRAUD AGAINST SANDRA PARKS

2. On or about August 2021, Sandra Parks, after Ramirez had closed his offices and unbeknownst to Ramirez, posed as a Jostens Representative to certain schools when she in fact was not. Ramirez closed his Brownsville office in August, 2020.

3. Park did represent herself as a Jostens representative and was giving Jostens calendars and business cards at these schools. Park went to Weslaco CTE and presented herself to Mr. Zamora, the School Principal, and to the Head Counselor as a Jostens representative. Ramirez was unaware Parks had opened her own company.

4. When the time came to take orders and receive monies from those schools, Sandra Park took such orders and received such funds under her own personal company, “The Graduation Center.” This caused extreme problems between Jostens and Ramirez. 

5. On Oct 12, 2021, Ramirez received a call from Mrs. Flores, who is the Accounts Payable Clerk with the La Joya Independent School District. Mrs. Flores asked Ramirez if he had deposited a check from Jimmy Carter Early College High School for the amount of $1,156.50. 

Ramirez told her that he had never received that check. Mrs. Flores then told Ramirez that she would email him a STOP CHECK REQUEST. Ramirez told her that he would fill it out and return it to her the following day, which he did.

6. Before Ramirez and Mrs. Flores ended their call, Mrs. Flores brought up an issue regarding an invoice from The Class Ring Company for the amount of $3,000.00 which she received sometime in August or September, 2021. She informed Ramirez that on the "make check payable" section, it had “The Graduation Center” information. 

Ramirez did not approve, authorize, nor did he have any knowledge that Parks had sent an invoice to Mrs. Flores for $3,000.00. Ramirez is not, and has never been, associated or affiliated in any manner with Parks or The Graduation Center.

Ramirez requests the Court to cause Sandra Park, to be cited to appear and answer in this Court this Counter Claim, and that upon final hearing, the Court grant to Ramirez as follows:

1. Grant Ramirez all equitable damages;

2. Grant Ramirez reasonable attorney’s fees, together with his costs; and

7. Such other and further relief as the Court determines justice and equity so require.
