Brownsville Public Utility Board employees and administrators were surprised to see CEO John Brucak – suspended with pay by the utility's board Monday back in his office Thursday, apparently gathering information to respond to the findings of a forensic audit highly critical of his performance in the failed construction of a $500 million, gas-fired electric plant in Brownsville.
Staffers who called some city commissioners and PUB board members were surprised to see Bruciak on the premises after his suspension and wondered whether he had been admitted to the new PUB offices –which are still closed to the public except by appointment – or whether he had merely entered on his own.
Several sources close to the city commission confirmed the Bruciak sighting and said that Mayor Trey Mendez – an ex oficio member of the PUB board – was aware of his presence there and told them that he had been requesting information from the utility to prepare a response to the findings of the audit, which among other things, accuse him of ordering the use of "vintage" energy need projections to create the appearance of an energy "shortage" to justify its construction.
The audit also documents the collusion between Bruciak and former mayor Tony Martinez (also a member of the board during his tenure) in keeping secret Tenaska's unilateral termination of its role in the project in 2017 and didn't let the commission know until 2020 that the project was dead in the water.
Based on the concealment of the Tenaska pullout, the utility continued to purchase right-of-ways from Hidalgo County to Brownsville. It also allowed the utility to continue collecting high utility rates from its ratepayers that continue today.
"It's like allowing the fox back into the hen house after you've caught him stealing the chickens," fumed a local prosecutor. "When we heard about it, we wondered whether he could have used the time to cut and paste incriminating stuff or to delete items from the record that incriminated him. How can the city let this happen?"

The city let it happen, a suspended CEO, implicated in the mishandling of millions of Brownsville's money was allowed back in the building. Why, we ask? Is it to help cover up any city malfeasance? I'd be curious to know where the surplus has been kept, how much interest it's accrued, how it's been used, what organizations used it, and how the boards of those organizations interconnect. Some may find it shocking, but stuff like this has been going on for a very long time.

Being allowed to return to the scene of a crime
One of the questions that stick to mind are "Why was the PUB purchasing right of ways from Hidalgo County"? Wasn't Vicent Gonzalez from Hidalgo at the time? Why is it that Vicente Gonzalez wants to represent Cameron County and skip town of Hidalgo County? Isn't Vicent Gonzalez a big oil and gas company contributor? The next question is where was our so-called Filemon Vela and why did he skip town really quick? He left to become a lobbyist, yet he sits at the Corpus Chisti Port protecting What? These so-called political leaders know exactly what was and what is still going on with this Brownsville Corruption. Follow the oil and gas leads and you will find the answer. This is my opinion
The moral thing to do on his part would be to stay away if he were truly innocent of any crime (s). His presence back in his office or even on PUB property represents a sense of guilt and appears to be a fearful representation of it. Another 30-days suspension should be added to his 60-day suspension! And, if he disregarded any of the imposed restrictions on his suspension, he then should be immediately suspended without pay. The suspension without pay would then be non-grievable because he violated his suspension. There are many that feel his suspension should have been without pay from the beginning as do I. But, since his suspension involves acts of unlawful events or circumstances, then by law his suspension is that with pay. And that be true, because in the eyes of the law, he is innocent till he is proven guilty. However, his suspension indicates there is enough proof to indicate he will soon be charged with criminal acts. There is no doubt in anyone’s mind or at least with those that I’ve spoken with that he is nothing less than guilty!!! And, his crime(s) were not committed without the knowledge of other. I’m sure names, dates, and account numbers will soon be told in his defense arguments. I believe he will eventually work out a deal with the FBI.
