ARE ELIZONDO AND ORTIZ APPEASING UNIONS WITH AGENDA?

Agenda items for today's 5 p.m. BISD board meeting 


They didn't wait long, did they?

In the first meting conducting business on the board of the Brownsville Independent School District, new board members Carlos Elizondo and  Frank Ortiz – who were backed in the last elections by the unions under the banner of the Association Of Brownsville Educators (AOBE) – will be paying their quid pro quo to the unions that supported their slate.

Feeling their oats, they think they have a majority on the board to 1) Conduct a forensic audit of the BISD 2) instruct superintendent Dr. Rene Gutierrez to solicits Requests For Qualifications from auditing firms fro the audit 3) discuss and take action to terminate the contract of the Law Firm of Ohanlon, Demerath, & Castillo as general counsel for BISD and 4) to discuss and  take possible action on retaining an interim attorney for the board's legal counsel.

Now, bear in mind that the BISD was just recently given a clean bill of health by its auditor. Having received a "clean" audit from its external auditor, the BISD is building its fund balance and preparing for "Life after ESSER," when federal pandemic-era funds will end in 2024.

According to the Brownsville Herald's Gary Long, on Nov. 17, BISD received an unmodified or "clean" audit for its operations during the 2021-2022 school year from its external auditing firm of Cascos and Associates, P.C., of Brownsville. BISD has received such an audit for several years running.

Chief Financial Officer David Robledo said the audit reflects $72 million in property tax revenue, $340.4 million in state revenue and $58.6 million in federal revenue, largely for food service operations.

"When you add it all up it's $471 million," Robledo said. "The grand total of everything we spend is $442 million. So when you do the subtraction $471 million minus $442 million, that's where that $28.9 million comes into play, the surplus, which went into the fund balance."

BISD's fund balance for 2022 is $132.2 million, $28.9 million higher than the year before. The figure for 2021 was $103 million, he said.

Meanwhile, district enrollment is holding steady, Gutiérrez said. As of Monday, BISD had had 37,990 students, a 1.3 percent loss compared to snapshot day in 2021 but far less than the loss in recent years, Gutiérrez and Robledo said.


So why does the new board majority need a forensic audit which, if compared to the last one performed could cost as much as $250,000? Don't they believe Cascos and Associates? Or do they have an auditing firm or individual in mind, one approved by the unions?

(After our post, some Elizondo supporters said that the forensic audit was aimed at uncovering a suspected $1.2 million loss to a "phishing" scam similar to one perpetrated against the Brownsville Public Utility Board and hinted at "other investigations." The BISD, aside from acknowledging the loss, has said that the FBI was looking into that report and were awaiting the results of the federal investigation.)

The same goes for the items dealing with the replacement of the board counsel. If we are not mistaken, the former board majority – after an expensive selection process – chose Ohanlon, Demerath, & Castillo to provide the board with legal advice at one of their meetings held June 2021 to replace former board counsel Baltazar Salazar.

Now it appears that the new board majority of Elizondo, Ortiz, Peña, and perhaps Jessica Gonzalez have decided to forget about the thousands spent on the search and selection process and hand it over to a Hidalgo County criminal lawyer.

(Insiders now say that new president Gonzalez may shirk from giving the new members her vote on the items above after a private tet-a-tet with the administration. We'll see tonight.)

Apparently, the unions have also been promised a Christmas bonus by the new board, as can be seen in this post circulating on their BEST/AFT site.

And are the teachers and BISD personnel happy in their jobs with the district? 

That is also addressed in another agenda item submitted by Elizondo and Peña. In it they ask for an anonymous climate survey in the item  X.B.1. Discussion, considerations and possible action on conducting an anonymous climate survey with all BISD Employees. (Board Member Request Minerva Pena, Board Support Carlos Elizondo)

Care to guess how the AOBE/BEST/AFT membership will answer that question knowing that they have the  majority of the board in their back pocket? 

And can their demands for the replacement and buy-out of Superintendent Gutierrez be far behind? After all, the taxpayers have plenty of cash in reserve for them to blow, according to the latest audit.

Montoya and taxpayers of Brownsville need to know what happens at the BISD. Our maintenance interim administrator Jerry Martinez is not qualified for this we have maintenance workers just driving around doing nothing and doing busy work. Dr Cantu is in charge of operations is doing construction deals with contractors and getting away with it. Look at the stadium project look at it resaca's project this is so ridiculous this superintendent needs to be a whole accountable what happened to the million dollars that were lost that's why we need an audit to see where all this Money's been going

Heads up to all consumers. Do not allow anyone to do any work at your home until you call the permit department and determine if they need a permit, and have they secured one. Demand a copy of their insurance policy if they claim they have one.

I am in a nightmare over my new AC. The permit department has given me three different explanations about retroactive permits. I have an email which says, not allowed. Because of this mess I have no fire insurance on my home if the AC causes a fire.

We started this in July. On December 1st after he told the finance company and BPUB he finished the project, which is still not complete, in August they issued the rebate and paid him on the loan.

then the finance company sends me the permit dated 6 months after we he started work, I yelled BS. The permit says he as 24 hours to request an inspection after he completes the work. He refused to ask for the inspection. When I proved he told the BPUB in August within minutes they were on the phone asking for permission to do the inspection although I had already been told only he can ask for the inspection.

the three inspectors agreed a retroactive permit is only for emergency situations where the job has to be started while the city office is closed, and then once the office is opened they are to get a retroactive permit. Not six months after they started the process.

The city permit office is a mess with no one knowing the rules. I will admit Helen Ramirez has sent the entire mess to legal to determine if rules were broken.

I just got the inspection. Just the drainage violation will cost him several thousand dollars. The number of violations are endless.

Although I repeatedly in writing demanded a contract for the services to be rendered he refused. But the loan company had already given him the money.

Also blow in insulation. Lowes sent their own inspector and agreed the company they hired never finished the project and requested no permit.

It is a complete mess.

Demand to see permits and verify with the city if it is needed. The state has everyone under investigation.

Lowes is a disaster.

The AC's insurance company is demanding so much discovery a judge would stop it, but I have to spend hours producing everything otherwise they will claim I did not cooperated.

The finance company is under state investigation for paying him before he did any work, and failed to ask for our contract, which there is none although mandated by state law or asking for his permits.

I have stopped payments.

So please call the permit department to find out if they need a permit, and if they do not have one do not let them on your property. Before you finance make sure the company insures the contractor is in compliance with state law before they pay him. Now my contract says they will not pay until it is done, and it is not done. They paid him even though I had no contract with him and he is now claiming he never agreed to do things mandated by the code. These people are idiots

Fyi, There is no need to have 2 Deputies, this was all for Gutierrez. Look at Deputy Cantu, she has done nothing but projects for herself. Just look at the Big Project at the closed Resaca Elementary Juan. All for Dr. Cantu to move in to a bigger office at the Glass Palacio. Cantu has no control of her people and now she moved out a Department out all over Brownsville with no supervision. Van y vienen cuando se les da la gana. Someone asked Gutierrez about it and he said he did not know what was happening. Look at the Stadium project, look at all of dr cantus projects that have no real supervision. Everyone knows that Cascos does a favor to all Districts so they can keep hiring him for auditing. They need a forensic audit. Jessica the board member needs to stop thinking with her stomach and remember when she was desperate for answers when she was a parent volunteer. Where are the millions missing.

Sorry to bother you again on this. I reviewed all the violations and they are based on a manual adopted by the city. I checked the manual and under permits contractors when they need a permit for emergency work may begin the job, but must apply for the permit the first business day the permit department is open. Not 6 months after the fact. that is the sole exception listed.

I have asked the city to void the December 1st permit. Also per the code because I smell burning when the system turns on, I have asked the city to order the company to pull their product from my home.

At this time if the AC causes a fire I have no fire insurance. My homeowners insurance company was very cooperative. They could not give me an advisory opinion but sent me the policy in searchable form and said search ordinance. There it was any damage done to my home based by an ordinance violation is not covered by the policy.

I have asked the city without naming names to do an informational meeting on this so homeowners are protected and contractors can learn the consequences for their actions.

7:35 pm., thank you for your kind words. I cannot do the blog. I am too busy working on the federal level and through state administrative procedures to fix this corruption. I cannot do both. I am grateful Juan is allowing me to post. People need to know these things.

Most people know there is only one person posting the insults. he is not work my time. But my work with these federal agencies and state are making a difference. I cannot do the blog plus the other work. Plus a lot of time I am no longer in Brownsville. I go back and forth.
