TEXAS SUPREME COURT DENIES PAT AHUMADA'S CANDIDACY

The Texas Supreme Court on Monday denied the Motion to Stay and writ of mandamus filed by former City of Brownsville mayor Patricio Ahumada after a district judge's denial of his petition for a temporary restraining order and temporary and permanent injunction against Brownsville City Secretary Yolanda Galarza-Gomez, who deemed Ahumada ineligible to run for mayor again under the city charter’s term-limit rules.

Ahumada filed for mayor with the city secretary’s office on Feb. 15. Secretary Yolanda Galarza-Gomez, in a Feb. 16 letter, informed Ahumada that his application was ineligible due to a May 2021 amendment to the city charter, approved by voters as a ballot proposition, that stipulates a “lifetime term limit” for mayors and other city commission members.

The amendment includes this sentence: “Any time served prior to the approval of this amendment shall count toward the lifetime term limit.”

The ordinance goes on to say it “shall not prohibit any Mayor from completing their current term or a term that begins 2021, but would prohibit any other candidate from running for a term they cannot complete because of term limits.”

In the letter to Ahumada, Galarza-Gomez wrote … “I calculate 73 months of previous elected service as Mayor of the City of Brownsville, in December 1991 to January 1994 and June 2007 to May 2011, which counts as ‘Any time served prior to the approval of this amendment shall count towards the lifetime term limit.’

“Therefore, I determine that your application for a place on the ballot for the position of Mayor for the May 6, 2023, General Election in the City of Brownsville, is not qualified because the Charter prohibits a ‘candidate from running for a term they cannot complete because of term limits.’”

In a Feb. 16 email Ahumada wrote, “This effort to disqualify my candidacy for mayor is political to give John Cowen the mayorship, which I am going to do everything to oppose this improper and illegal shenanigans to deny me my constitutional right to run for mayor and my civil rights.”

Cowen, currently serving as city commission at-large “A,” announced his candidacy for mayor on Nov. 17. Also on the ballot for mayor are Erasmo Castro, Jennifer Stanton and District 2 City Commissioner Jessica Tetreau.

Ahumada wrote in a Feb. 27 email in response to Longoria’s ruling that applying the term-limit amendment to him retroactively 32 years after he was first elected mayor is “dirty politics” and “ludicrous and very obvious political.”

Senior Judge Jose Longoria said no to Ahumada’s petition and request for a temporary restraining order and temporary and permanent injunction against Brownsville City Secretary Yolanda Galarza-Gomez, who deemed Ahumada ineligible to run for mayor again under the city charter’s term-limit rules.

Ahumada then filed an appeal with the state Supreme Court based on Article 1, Sec. 16, of the Texas Constitution, which states: “No bill of attainder, ex post facto law, retroactive law, or any law impairing the obligation of contracts, shall be made.”

On Monday afternoon, Ahumada, – who filed pro se, or on behalf of himself as his own attorney – was notified by the Texas Supreme Court his emergency appeal had been denied.

The fact they denied it without an opinion means they could not agree. You can hate the man all you want, but at least he was willing to try. The first thing I googled was Texas AG opinions retroactive laws city and this is what I got in the last sentence "If a city charter term limit provision applies to service as a city officer prior to its adoption, it does not impair a vested right and therefore is not a “retroactive law”

But the other side is a review of the case law shows U.S. Supreme Court and Texas Supreme Court changes it standard in every case. Image the outrage against the Court had they agreed with Governor Abbott citizens have no vested interest in running for public office. What does that have to do with retroactive? Nothing. Even Roy de Los Santos on a podcast came out against term limits. His reasoning was solid. Do you really want a former commissioner or mayor who was very good and knowledgeable being barred from serving on the city commission? He did keep Ahumada out of the discussion. These type cases are about the principle and not the candidate. I would never vote for Tetreau, but I voted against term limits. I stand with the people to decide who wins even if I oppose the winner. Where do you stand? We are not in Russia where draconian laws keep people of the ballot. We are in the US where the people decide.

I strongly believe that Mr. Pat Ahumada "Civil Rights" have been unjustly denied by the highest and most respectful court of our great nation!!! It has failed to protect our constitutional right under the governing law of nation, that being the "Grandfather Clause"!!!

"Grandfather clause refers to a section of a law, regulation, or other legal document that limits how changes will be applied to legal relations and activities existing prior to the change. When laws and regulations go through major changes, they can critically harm businesses or individuals who relied on the prior system. So, legislators, regulators, and businesses often negotiate grandfather clauses to make the changes apply only to new activity. Businesses or individuals who were partaking in the regulated activity prior to the change can continue to do so after the law or regulation goes into effect. Grandfather clauses can last forever, or they often can be limited. For example, legislators requiring power plants to be carbon neutral may allow currently operating power plants to be grandfathered for ten years, giving them ten years to prepare for the change.

The term grandfather clause comes from a racially driven set of voting laws in the South after the Civil War. Many Southern states began requiring individuals to satisfy literacy tests, property ownership, and poll taxes in order to vote. In these laws, exceptions were made for individuals whose grandfathers voted for war, allowing them to avoid the new requirements. Since essentially no African Americans were able to vote in these states prior to the Civil War, only white citizens were able to benefit from this grandfather exception. This effectively prevented most African Americans from being able to vote after the implementation of these laws. The grandfather clause in this law, which limited their application to prior voters, became the term for any clause that has an effect of not applying to individuals doing an activity prior to the law.

The law is as old as the Magna Carta of 1215. I was up all night Sunday reading Kinga Bench decisions back to 1238 to see how they applied the prohibition against retroactive law. I read everything written by Blackstone, and every Texas Supreme Court case, and many U.S. Supreme Court case. They all had one thing in common no one defines the meaning of retroactive. I could not find one set standard and from case the analysis changed. I even read the Constitution Minutes wherein scribes wrote down every work by the Founding Fathers during the debates, and nothing more than saying they should be unconstitutional. This is why I never took a prediction position. BUT GOOD FOR YOU COMRADE YOU PREFER THE RUSSIAN SYSTEM WHERE Putin can pass last minutes laws to keep his opponents of the ballot. Good for Roy de Los Santos for openly opposing the term limits, shame on Jessica who was also a victim for hiding in the corner and saying nothing.

Even before Sunday I has read enough to know their is no clear case law.

The Texas Supreme Court knew had they issued an opinion against Pat it would cost them. Please tell us how a law applied to someone for something they did more than 30 years ago is not retroactive?

If they are paid hourly or by the day. This is a game changer. In this case the managerial person was paid by the day a set fee and the Supreme Court found that is the same as paying by the hour which mandates overtime. So if you are management, but paid hourly they now have to pay you overtime.

Even if he loses it sends a bit message to this Putinesque Commission for using an Ordinance to keep qualified candidates off the ballot. Putin tells his legislature to rubber stamp new laws keeping his opponents off the ballot and they do it.

No sitting Commissioner should receive a vote - especially Putinesque Commissioners Cowen, and Tetreau. They need this label.

I am not saying Pat would be a good mayor, but if thousands of people write in his name, a very strong message will be sent. You can hate Pat all you want, The message will be the people still control the election and not Putinesque commissioners such as Cowen and Tetreau. Pat will not win, but the message will be sent. But if he were to win, he would be allowed to file a new lawsuit asking term limits undermine democracy and the proven will of the people. You can still hate Pat. He is not the issue. It is our Putinesque election. If you oppose someone on the ballot instead of going head to head you just pass a law keeping them off the ballot.

Are we not a better people than that ?

Roy de Los Santos without mentioning Pat came out against term limits. If you believe Roy is fighting for the people in short order he will not be allowed to run and a good commission will be gone. Is that what you want?

I remember when I was going to cummings before the zoo was built all of a sudden a dry cleaners opened shop there. It amazed everybody. What is a dry cleaners doing en este barrio? On the corner of ringgold and sixth st. Nobody in this area even thinks about a dry cleaners. We all noticed that it was never opened. Well than the city ran everybody living there out of that area and that store remained. Why? The zoo was coming, and who ever that store belonged to more than likely made millions. El ratismo sigue and will never stop. Downtown is the same. People that are related, cronies, compadres are given tips that are worth millions. It will never stop. RATISMO continues to this day. They fight to run for some elected office, just to make millions. That is the reason this city is a cesspool of RATAS.
OUR ONLY SOLUTION TO THIS AGED LONG PROBLME IS TO VOTE EVERYBODY OUT. PERIOD.

there is a need to organize and fight this RATISMO. an organization of honest citizens needs to be organized NOW.

I don't know who this clown, BobbyWC (as in Water Closet? ... weird!) is, but, any way, I love his attempt at coining new terms, such as "Putinesque," but his logic fails completely on these posts, as applied to the COB Commission. He tries to paint the commission as some type of plutocracy, based on a false premise, that the Commission has limited access to be on the ballot, by its decree, when, in fact it was the public that decided, by an 85% margin, to implement term limits. In case you didn't know, Mr. Water Closet: that is called democracy, not plutocracy. Why? Because the citizens decided they wanted term limits, not the commission. What a clown!

Two issues: At the bottom of the ballot there is a place for write in. And to the poster you are dead wrong about the commission not being part of term limits. They had to vote to put it on the ballot. The Commission voted to put term limits on the ballot. Another fact you leave out is only 500 people voted on the issue. All this people saw was punishing elected officials with no understanding what it meant. I doubt these super small number of voters even though they were keeping a commission they trust and like from someday running again.

If you think 500 people in Brownsville means the people voted for it, you are a complete idiot of intentional liar. People need to remember if they believe a commission they support and believe in, at some point they will be banned from running for office, it will mean keeping people who actually care from being on the ballot.

But just keep on lying, because that is all you have or ever will have.
