SECTION 4. The changes in law made by this Act to Sections 85.0011 and 85.0025, Local Government Code, do not apply to a sheriff serving a term that began before the effective date of this Act. A sheriff serving a term that began before the effective date of this Act is governed for the remainder of that term by Sections 85.0011 and 85.0025, Local Government Code, as those laws existed immediately before the effective date of this Act, and the prior law is continued in effect for that purpose.
SECTION 5. This Act takes effect September 1, 2023.
(Ed.'s Note: It would seem from a casual reading of the act that Cameron County Sheriff Eric Garza would be precluded from being a candidate for sheriff even after he completes his four-year term since he has only been an active [full time] peace officer for that long and was the county's district courts clerk before that. Any other interpretations out there?)

This is going to be the election of disqualifying candidates at both the state and federal level. The courts have addressed the issue concerning removal. You can only remove a DA for example for acts after the election. The courts are split. Only the last election or all acts since he was elected? This will be a mess. Plus Texas law only allows candidates to challenge other candidates, or in this case the county. No one is going to bring the suit. So there you have it. They all claim to believe in law enforcement, but not a one file a suit to enforce the law.
He should step aside he has done enough damage already.

You’re not reading the law correctly. It’s an active peace officer license or eligible to be licensed because you have 5 years of federal investigative experience or ten years of military service. Anyone with a valid license can run - John Chambers may not be able to run.

I am not a big fan of either of the names mentioned but I am not familiar enough in the local workings (cliques/power brokers) to know who is in it for the people or just for themselves to form my own opinions.But I do agree that the people need to learn more about the inner workings of their governments and vet the candidates more.
