HEY, HELEN, WE'LL MAKE YOU A STAR. A STAR, I TELL YA!

You've got to be kidding.

Can you believe this latest whopper, that intellectually-challenged City of Brownsville Manager Helen Ramirez has been designated a “credentialed manager” by the International City/County Management Association, or IMCA?

Are they serious? Or is it one of those organizations where members rotate for the award after their cities pay their "membership invoices?

After all, this is the woman who – at the direction of now-mayor John Cowen – gave out millions of city money to shady space-related "start-ups" when she was appointed as provisional head of the Greater Brownsville Incentive Corporations (GBIC) without even checking if they could do business in the Sate of Texas.

These co-called "quick wins," celebrated with a big public relations splash by her propaganda factory – the Brownsville Communications and Marketing Department – propelled her to the forefront to the city's public image, only for the facade to crumble in the the glare of the truth. 

(That's Manuel Chacon the director of that department (position at a $125,000-plus salary) performing his "dog and pony" act at the city library memorial for the late Liz Walker and Ramirez (at $250,000-plus salary) in a nice dress basking in the spotlight with Cowen overshadowed by the pair peeking from behind her. Now that you mention that, Helen always seems to be in the center of any photo op, often using the commissioners as a backdrop in the events. Bring in the clowns.)
And no, this is not misogynist or Latina bashing. 

The woman lost $100,000s of public money meant to create good-paying jobs for local people because of her ineptness and lust for glory. Unfortunately, it came at a cost. After giving away money to outside schemers, there was not one job created for local people. 

Cowen is not above criticism either. He and his buddy Patricio Sampayo also tried to grab GBIC money through real-estate speculation that prevented a steel company promising 600 well-paying jobs from coming here unless they paid inflated prices for the land that they tied up before the GBIC could acquire it for them to build their plant. The steel plant is now in Sinton.

Sampayo is still the chair of the Brownsville Housing Authority and Cowen is now mayor. Neat.

City auditors reported that the agreement between 9Point8 Capital was signed by founder J. Brant Arseneau and then-GBIC Executive Director and CEO Helen Ramirez. In the agreement, the company claimed that 9Point8 Capital was a New York based corporation authorized to do business in the State of Texas.

The $1 million was to be paid in 4 increments of $250,000 with the first payment within 5 days of the effective (signature) date then one at 6 months, one at 12 months, and the final at 18 months of a 3-year agreement.

In  other words, the GBIC and Ramirez agreed that the company was going to get full payment of the $1 million halfway through the length of the contract.

Under that agreement, the auditors reported that 9Point8 Capital, an advisory company, was supposed to create local employment (20 full time equivalent jobs – 15 back office and 5 hatchery jobs), create a business “hatchery” to help startups find funding, fund space program scholarships at University of Texas at Rio Grande Valley (UTRGV), and bring capital investment for space startups within the city limits of Brownsville.

The original terms for payment were to be $1,000,000 in incentives, paid $250,000 every 6 months for two years per the original term sheet. The agreement with 9Point8 Capital was signed September 29, 2021, just two months after the proposal was sent to the City and 10 months after the City’s 380 agreement with Spaced Ventures, Inc. Per information given to the GBIC board, the entity was also supposed to bring in taxable business personal property valued at $10 million to within the city limits of Brownsville.

On January 6, 2023, the city auditor informed the city's  Audit and Oversight Committee that the company failed to deliver the services it had promised and had been paid two payment of $250,000 each, and recommended that a compliance  audit be performed on the agreement. The committee agreed.

Auditors found that the rapid pace at which the agreement was proposed and approved was breathtaking. The proposal was made to the city on July 23, 2021, the term sheet signed on August 6, 2021, and the final agreement signed September 29. The first $250,000 payment was made five days later on October 5, 2021 before any work had been performed for the city.
But before the "claw back" process started to get back the city's money, the city gave 9Point8 Capital a six-month window of time to come into compliance with the agreement starting September 26, 2022, and ending March 26, 2023.

However, the audit report indicates that Point8 Capital did not become compliant during that time, and the GBIC board decided to enforce “claw back” per section 3.9 of the agreement. The City Attorney sent a “Notice of Default and Demand for Repayment” to the founder 9Point8 Capital on May 11, 2023.

But the findings of the audit indicate that many "red flags" should have alerted acting GBIC CEO Ramirez, the city and the GBIC board to the questionable nature of the company, its bona fides, its founder, and the services it had promised to deliver. The audit, among other things, found that:

* The founder of 9Point8 Capital acknowledged the legal entity is and was 9Point8 Inc. registered in Delaware, not New York as he claimed in the agreement.

*When interviewed, he said it was his mistake and that he used Capital because no one knew what 9Point8 Inc. was.

* He said it was also his mistake that the agreement referred to 9Point8 Capital as a New York Corporation rather than the legal entity 9Point8 Inc. registered in Delaware.

* He also did not confirm registration with the Texas Secretary of State, or Cameron County, Texas, as an assumed name or “doing business as” or “dba” name as required by the Texas Business and Commerce Code, Title 5, Subtitle A., Chapter 71.

*Additionally, the auditors reported that they found no confirmation of the registration during their search.

Although the auditors reviewed the hundreds of pages of documentation retrieved by GBIC, they
reported that it was not clearly documented what the application and screening process looked like or how it should have looked at the time of occurrence Ramirez signed the 9Point8 Capital agreement.

Further, they reported that it was not clear who should have taken those steps and who should have documented that they were taken, or who should determine that sufficient evidence was gathered and reviewed.

In the compliance audit report, they state that: "We did find a note indicating accepting self-reporting from the grant recipient would be acceptable in determining compliance. We deem the internal controls were inadequate because of the lack of policies and procedures and reliance on grantee self-reporting."

Who else but Ramirez could have made that determination? Or was there a rush to overlook all the due diligence so she could make a media splash with a "quick win" on what a fine job she was doing? The auditors continue:

"Based on the lack of files, prior GBIC management and personnel did not keep files and did not verify existence and registration of the entity called 9Point8 Capital, documented to be a New York Corporation, before signing the Performance Agreement September 29, 2021...Therefore, no one found that the company used an “assumed name”, also known as a “doing business as” or “dba”, and incorrectly recorded the company’s state of formation and legal status to do business in Texas in the agreement.

"No background check on the founder was done or documented and documentation was not kept in entity files. Files were empty, per our discussion with current GBIC staff who recreated the files. We tried to contact former GBIC staff to verify what procedures they had in place during the time of the signing of the 9Point8 agreement, but we were unsuccessful."

"We deem the internal controls were inadequate because of the lack of policies and procedures and reliance on grantee self-reporting. Based on the lack of files, prior GBIC management and personnel did not keep files and did not verify existence and registration of the entity called 9Point8 Capital (company), documented to be a New York Corporation, before signing the Performance Agreement September 29, 2021 (agreement).

Ramirez served as GBIC's CEO and Executive Director from February 13, 2021 until July 26, 2022, during which time 9Point8 Capital entered into the $1 million agreement and the company was paid $500,000 before it was deemed to be in non-compliance.

On January 2023 she was selected from more than 30 candidates that applied for the city manager position to replace former city manager Noel Bernal. At the time, former mayor Trey Mendez told the Guardian:

“The City conducted an extensive search for the right person to bring the right leadership and the right experience for the City of Brownsville,” Mendez said.

“Helen by far exceeds those expectations. She is an outstanding leader and brings an extraordinary approach to municipality management, economic development, and strategic leadership. I look forward to continuing working with her and seeing what great accomplishments she will bring next to the City.”

At the November 9, 2021, announcement where Ramirez crowed that she had snagged 9Point8 to manage the space-related efforts of the city, she said:

"9point8's arrival to the City of Brownsville reinforces one of our main pillars - Economic Development. We want to develop a sustainable economy through businesses like these, and 9point8 will not only create employment opportunities, but these 10 million dollars in Venture Capital will impact our community's access to education, as well as attract other businesses in this industry, allowing us to position ourselves as leaders in the space industry."

Based on her sterling performance at GBIC and Mendez's assessment – the city is out $500,000 and no jobs for local residents were created – the city commission gave her a two year contract and started her at a $216,985 annual salary now increased beyond $250,000.

In granting her the "credentialed management" designation, the ICMA release stated that: "The designation goes to those who have 'significant experience as a senior management executive in local government; have earned a degree, preferable in public administration or a related field; and demonstrated a commitment to high standards of integrity and to lifelong learning and professional development.'”

Cowen said Ramirez attaining the credential “underscores her commitment to excellence in public service and her ability to effectively manage and lead.”

“Her ongoing initiatives and the quality of work she oversees for Brownsville continue to set a benchmark in municipal management,” he said.

“I would like to thank the ICMA for positively advancing the local government profession, and this credential is not only a recognition of my professional journey in public service, but it reflects the hard work and dedication of our organization, made up of over 1,200 (city) employees,” she said.

Ramirez said her office strives on a daily basis to improve its practices and “raise the bar for our community.”

Nowhere but up.

In the first sentence of the article Helen Ramirez is labeled as intelectually challenged and even though i may agree, i think that label should be given to all those that appointed and supported her as city manager. I guess she was awarded the benefit of the doubt when she first started but now after so many blunders , mishaps and fuck ups ( as reported) how THE HELL IS SHE STILL CITY MANAGER??? And to make matters worse and flat out ridiculous she keeps getting rewarded with additional designations and titles?!?!? WHY?? What is the REAL reason for all this ass kissing. The public deserves answers.

ALL LOCAL elected officials are like hired cob and county employees and any memberships is paid by all tax-payers even their salaries are paid by, all the county and city, tax-payers and if you tax-payers don't like it y'all also pay for ALL OF THEIR EXPENSES including all their families, friends, primos, primas compadres, comadres and voting amigos/as.

Helen is a nightmare. But read the qualifications for the label. It is not based on her job performance, but her credentials. Any other person in her position with the same qualifications, would receive the same label.

The city administrators with Helen Ramirez being on the forefront have cost taxpayers money. Yet her excessive salary of $250,000 has remained untouched. Is this the main reason our property taxes continue to rise at extreme levels yearly? Our streets and drainage issues have never been addressed but the salaries of city administrators are addressed frequently. When are we the voters going to take control of our city? I for one believe in small government but it appears I’m alone since voters in this area continue to vote for the same politicians and approve paying city employees’ excessive salaries. And here I thought I lived in an impoverished area.

Eldelasprietas I know you have your opinion but unfortunately i disagree on one part of your comment. When i said the public deserved answers i was talking about the rest of us — not the welfare cheats and nonproducers as you call them . We all agree with your assessment that those fuckers don’t give a shit about anything . But the ones that work our asses off and pay our taxes want to know why our hard earned money is being wasted/ spent on useless projects and incompetent officials! Just wanted to clarify.

These elected officials live in another world with big salaries in a city with nothing good to offer: no pretty streets, no nice parks, no beautiful art, no events for the community etc

Juan if you become a member of the ICMA which fees are paid by taxpayers fund and you become a member of this then you are entitled to get a certificate and it HAS NOTHIGN TO DO WITH THE BAD OR GOOD OF A JOB YOU DO OR EVEN IF YOU NAVE A GOOD NALGA. BY THE WAY THE ICMA STANDS FOR INTERNATIONAL CITY MANAGERS ASSOCIATION IN AUSTIN TEXAS. Pay a fee and get a certificate, sounds like a box of cracker jacks, surprise inside. lol. chuy

Wow !!! A participation trophy for her failures? Helen and city leaders, if you can't determine right from wrong, you lack empathy and leadership skills. Stop with all the BS representing yourselves as great people in Washington, Matamoros , airport or wherever you go that's going to be beneficial to you, but you use our tax money to participate in all these activities. John, You are more interested in all this running around because it benefits your family business. When's your next Chalupa game in Southmost?

Sure Helen, keep continuing rolling out the Red Carpet to all these big companies, while Musk continues to use our area as his playground and weakens the foundation of Port Isabel and So. Padre Island properties. Some people say that the communities are exaggerating, but I’ve been there when my family’s home just shakes really bad. Some of our leaders say that Musks rockets are great for tourism ; but the tourists don’t own property here and don’t give a S#*! after the thrill. Our properties have skyrocketed , but the foundations of our homes, places of business and land are weakening every time Musk shoots off his rockets .
