According to Mark Regan, a former Brownsville Herald reporter who first covered the case in federal court, the motion states that they are asking to dismiss the indictment without prejudice, meaning the former executives could still face charges in the future if prosecutors pursue another indictment.

Sources say that attorney for the Gallegos (Benigno, another "Trey", Martinez) had claimed the government had failed to turn over exculpatory evidence under the Brady Rule and Rule 16 Discovery of a report by a Office of the Inspector General's Office of Audit Services auditor Nancy Bibb. The defense asked the court to dismiss the indictment because she might have been "withholding any document or email whatsoever concerning IES, the defendants, or any of the issues that have been brought forth.")

Asst US Attorney Alamdar Hamdani puts friends first, law second and country third. He has used his race card to achieve his goals. Now, he wants to help people that have hurt the Mexican Americans, the Mexican people and South Texas but if this was a case involving Muslims, he will also help the criminals too. So he is fair in his eyes: he is there to help his friends and keep his connections.
The Motion is without prejudice which means the Indictment can be refiled. He had no choice because he was caught withholding exculpatory evidence. Butter to dismiss it on his own than have the Judge dismiss it with prejudice for withholding evidence.
If you are deported it's because you are breaking federal law.
