The long-simmering dispute between Brownsville-based Varco Real Estate over a multi-million San Benito Economic Development Corporation Resaca Village shopping center project has landed before Judge Benjamin Euresti in the 107th State District.
The city – citing what they say is non-compliance with the original contract – stopped the company and its subcontractors from entering the site, and later said that one of them had tapped into a city water line without authorization.
Varco's lawyers say that the subcontractor "mistakenly" tapped into the city water line, but that the city is using that as an excuse to void the agreement and hand out the construction to other developers.
This comes on the heels of a visiting judge voiding a charter amendment election on November 4, one day before the November general election and after the nine day-early voting period where two-thirds of the final vote has traditionally been cast. The Cameron County Elections Department reported that more than 5,000 votes for and against the amendments had already ben cast when the judge voided the election. The city has appealed his ruling.
And on the sidelines Wayne Dolcefino, President of the Houston-based investigative media firm Dolcefino Media that has been championing Varco alleged that it is investigating "nepotism, alleged corruption and cover-ups in San Benito" and charging that the city has acted illegally in not certifying signatures on a petition to recall the entire city commission.
It also claims that the city is spending money on lawyers without the city commission authorizing their hiring.
The whole wriggling mess, with San Benito residents lined up on either side, has landed in Euresti's court and will be heard Tuesday..
Varco has denied that it has anything to do with the Dolcefino media firm and that they are acting on their own. The city has remained skeptical of those claims.

It appears that back on May 19,2022 VARCO asked EDC for an amendment #4. It appears it was denied cause VARCO had not paid their part of the property taxes to EDC. Plus it appeared that the couldn’t get tenants to rent the spaces. Apparently VARCO was eventually approved for the amendment and is to pay the property taxes to EDC every Dec 31st. Why did VARCO not pay the Taxes owed to EDC ? Also it appeared someone wanted to build apartments at the site and and EDC Board member D Morales questioned the proposal cause it appeared not to meet the EDA GRANT STIPULATIONS. Well that idea was scrapped as it would have violated the EDA GRANT REQUIREMENTS. SO that set the constitution back cause it appears they were counting on the EDC to pass the Apartment proposal. So it can only be imagined what other stuff they tried to pull.
MY QUESTION IS WHY THE EDC STAFF WAS NOT IMPLEMENTING THE DEADLINE FOR VARCO TO PAY TAXES ON PROPERTY TO EDC.THIS APPEARS ON THE EDC BOARD MEETING DATED NOVEMBER 22,2021. WAS THE EDC STAFF ORDER NOT TO ENFORCE THE DEADLINE SINCE IT IS STATED THE DEADLINE FOR VARCO TO PAY TAXES IS IN THE LEASE AGREEMENT. MR DOLCEFINO YOU CAN LOOK INTO THAT SINCE YOU SUCH A CRACK INVESTIGATIVE X-REPORTER. LOOK INTO IT.

This new city manager reminds me of a petulant child by just the way he acts and carries himself. If I were to guess he's not married and still living with his parents; I don't know, he just gives off that vibe. Lol. San Benito should make it clear with it's residents on why they don't hold him to the same standard as they did with the female commissioner that they voted out due to her not living in the city, regardless of how long she had left or what her future plans were by moving out of SB. There's a reason why the city tried to sneak in those amendment during election.
City commissioners should send letters via mail to it's resident explaining the amendments. Explain the current law/regulation, the suggested amendment/change and how the change will benefit the city and it's residents. Your spending thousands on law suits with taxpayer's money, might as well spend some to keep them informed.
The compadresismo is real in the city, and although it might not be that telling or have any affect in other everyday jobs, when it comes to lawmaking jobs that affect the lives of others, well that's a different story.
Hold the City Manager accountable and to the same standard as others. This living in an RV in the city is bullshit. He just proved to us that he was wrong about not having to live in SB and only NOW is trying to comply and trying to shut us up.He had plenty of time to make housing arrangement and if he doesn't comply with the city laws then get him the fuck out and or resign. This crap of collecting two salaries, one as city manager and the other as head of EDC is a spit to the face to SB. That means he's collecting full salary on both jobs but dividing his time working part-time on each. I want a Full time city manager.

Heck the prior City Manager would do anything the now disbanded 3 Amigos would tell him to do. And in return the past city manager would get a perfect evaluation setting him up for a big pay raise. Any update here Juan? San Benito needs companies like these willing to invest in the high risk economy and even higher risk San Benito area. This company has a good product and is bringing good quality tenants. You know San Benito politics giving companies a hard time makes no sense.

The original grant proposal submitted to EDA for this property was to build a mixed use entertainment venue with museums, amphitheater, and a park. There was no mention of apartments nor a commercial strip center. As usual in San Burrito the criminal element took over to bastardize the project.
Also it appears one of the homeowners near the property complained loud enough to squash the whole project saying they didn’t want the noise in their neighborhood and that loud Mexican music! TRUTH told.
