TEXAS SUPREME COURT DENIES APPEAL BY RIOS ON SAN BENE CHARTER AMENDMENTS

SAN BENITO — The city’s former economic development president is took Mayor Rick Guerra to the state Supreme Court, contesting a March 2025 appeals court ruling overturning a state district court decision stemming from the city’s handling of last year’s special election.

In an appeal filed with the Texas Supreme Court, Julian Rios is argued that the 13th Court of Appeals incorrectly overturned Cameron County visiting Judge’s Michael Garcia’s Nov. 4 ruling finding commissioners violated the Texas Open Meetings Act by failing to give residents proper notice of the election.

“The lawsuit moving forward to the Supreme Court requests they review the case in its entirety as it pertains to the City Charter violations because the appeals court looked only at the Texas Open Meetings Act and the case was more than the Open Meetings Act,” Rios said Tuesday in an interview.

In the appeal filed by Houston-based attorney Jeff Diamant, Rios argues the appeals court incorrectly overturned Garcia’s decision granting a temporary restraining order to halt the Nov. 5 special election, whose ballot included five proposed amendments to the City Charter, including a proposal asking voters if they would allow City Manager Fred Sandoval to live outside the city limits.

Rios argues in the appeal that case law shows commissioners violated the Open Meetings Act by failing to give residents proper notice in calling the election while failing to provide them with detailed information describing the ballot’s five propositions.

The appeal claims commissioners placed the order calling for the election on a consent agenda to “obscure” the matter.

During a hearing, City Manager Fred Sandoval stressed the election’s importance, the appeal states.

“Consent agenda items, as noted by the testimony of City Manager Fred Sandoval, whom one of these amendments is specifically targeted to benefit – that is, that the city manager can live outside the city– are for items that are ‘routine and ordinary in nature,’” the appeal states.

Guerra and Sandoval are unethical corrupt politicians. They'll do anything to win, even by cheating.a city manager who does not live within San Benito jurisdiction should not have that job.
