FARIAS SUES NELSON FOR $3.3 MILLION FOR USING EXPUNGED RECORDS IN POLITICAL CAMPAIGN AGAINST HER

The fallout from the Democratic primary race for the 138th District Court between Judge Arturo Nelson and challenger Veronica Farias has taken a legal turn.
Farias on Friday filed a $3.3 million lawsuit against Nelson in the 197th District Court charging that he had allowed a Political Action Committee to run advertisements on behalf of his candidacy in local newspapers and in a massive countywide mail-out that violated an Order of Expungment over two incidents in 2008 and 2011 where she was involved.
She further charges that Nelson used his "official capacity and political influences" to obtain the files and records that were ordered destroyed by a local court for information that "were detailed therein" for political purposes.
In the last two weeks of the campaign the PAC – named "Citizens for a Better Judiciary" – ran a series of ads calling Farias a "troubled attorney" and listing details of two previous charges against her. This was preceded by an ad run by Farias taking Nelson to task questioning Nelson's judicial performance in the case of a child molester that she claimed the judge allowed to go free on probation only to have the defendant engage in sexual abusive criminal conduct with a minor.
This may be interpreted as a "tit for tat" episode in a political race. However, while the the Farias' charges against Nelson are part of the public record, the use by Nelson and his supporters of expunged records is strictly prohibited by law, Farias charged.
"(Nelson) abused his abilities to obtain such information against...(Farias) who was running a campaign seeking (his seat)," her lawsuit states.
She charges that he then illegally released and disseminated and published to the entire area of Cameron County (with his consent, on his own accord, or upon a third party with his approval)...the expunged information"...contrary to the Code of Criminal Procedures and against the Texas Election Code's Code of Fair Campaign Practices.
The law – Title I, Chapter 55 of the Texas Code of Criminal Procedure – states that: "the release, maintenance, dissemination, or use of the expunged records and files for any purpose is prohibited.
"A person who acquires knowledge of an arrest while an officer or employee of the state or any agency or other entity of the state or any political subdivision of the state and who knows of an order expunging the records and files relating to that arrest commits and offense if he knowingly releases, disseminates or otherwise uses the records or files...
"An offense under this article is a Class B misdemeanor."
According to Farias, both charges listed prominently in the PAC's ads were expunged from her record by a court order July 2011. The order prohibits anyone (whether a PAC, law enforcement official, or any individual) from opening the files or the expunged records of the arrests and are "not open for inspect6ion by anyone..."
When Farias approached the Brownsville Herald, which ran the PAC's ads, the editors there went back to their files and made a notation tat the charges arising from the police reports had been expunged from the public records by a court.
The PAC listed its address as 855 W. Price Rd., the same building that houses the offices of Roreig, Oliveira and Fisher, principals with State Rep. Rene Oliveira in the law firm.
It is also the same address listed for the Cameron County Bar Association.
At the time, the Brownsville Police Dept. has looked into the complaint and said it had forwarded the evidence it uncovered to the Cameron County District Attorney's Office.
Farias said that under the Texas Election Code, all candidates must follow the Code of Fair Campaign Practices that states that: "I will not permit the use of character defamation, whispering campaigns, libel, slander, or scurrilous attacks on any candidate or the candidate's personal life....
"I will not use campaign material of any sort that misrepresents, distorts, or otherwise falsifies the facts, nor will I sue malicious or unfounded accusations that aim at creating or exploiting doubts without justification, as to the personal integrity or patriotism of any opponent...
The code that every candidate signs with the state also states that a candidate "will immediately and publicly repudiate methods and tactics that may come from others that I have pledged not to use or condone. I shall take firm actions against any subordinate who violates any provision of this code..."
Farias said that all candidates' who have signed the code have their pledges on file with the Ethics Commission.
At the time, Farias said that Nelson's mere disavowal of the ads would not do.
"If Judge Nelson didn't sign the code of fair campaign practices, why didn't he?" she asked. "He may just try to wash his hands of responsibility by saying it was a committee that did it, but that is not very credible. The Ethics Commission requires any "committee" acting on a candidate's behalf to get the candidate's authorization for an ad."
Farias said that Nelson's "wanton disregard for complying with the law...caused irreparable damage...to her livelihood and reputation...and "was intended to injure (me)...exposing (me) to public contempt and ridicule, financial injury (calling into question my) honesty, integrity, virtue, and reputation."
She is asking the court for $300,000 in personal damages, loss of earnings, loss of earning capacity, mental anguish, defamation of character and personal integrity.
Additionally, she is asking the court to award for $3 million in exemplary damages because he maliciously allowed the use of the expunged material "with his consent and knowledge" to achieve his personal gain.
A hearing has not been set on the case nor had Nelson been served as of Friday.

She caused all those things to herself and her family when she got herself arrested..more than once. l am not defending Mr Nelson, but lady please take responsibility for your actions. How convenient for a politician to sue for money because they lost. I googled the accusations during that campaign and saw the Herald had them posted in full view to the public, she IS a troubled attorney with a CRIMINAL
background. If anyone should be sued its the herald for displaying what she claims is expunged. What a sore loser, pobre pendeja.

Brownsville Politics at its best ladies and gentlemen! So let’s exam why Veronica Farias can’t just take her toys and go home. Is it pride? Could it be a hidden agenda that was interrupted by her behavior getting in the way of running for public office? Well my inclination is to say yes and yes!
The troubles of“reckless” women and the influences of other’s in office are quite evident here. For Veronica to make claim that her reputation has been tarnished, well the truth is even way before she filled to run for office, all you had to do is Google “Veronica Farias Brownsville Attorney,” and all you need to know about those skeletons of her were all just a click away.(Thanks Google!) So for Veronica to make ASSumptions that some kind of political influence was used to obtain such records is not only juvenile, but darn right ignorant!

So I’m assuming that this suit is one of many to come. Because under – Title I, Chapter 55 of the Texas Code of Criminal Procedure it is also illegal according to Farias to have any sort of “maintenance” to the cases that she is claiming were expunged . So I hope she’s lawyering up, because she needs to prepare herself for Google, Brownsville Herald, Yelp, Valley Morning Star, hell maybe even the Bargain Book, and anyone else that has had something to do with her indiscretions and the maintenance of this information. So what I want to know as who is going to represent her? Remember what they say about representing yourself… “That every man/woman who is his/her own lawyer, has a fool for a client. Or is she just a fool to begin with? The world will soon know!

All politicians better remember its we the people. But as for Farias shes and example of everything wrong with the opponents to existing politicians.

What a waste of taxpayers money to even begin to allow this lawsuit to continue. We have more important things to deal with. I'm sick of seeing flunkies like Farias give us no real alternative. We need to ask more from the candidates.

No judge can expunge personal knowledge of her criminal record. He can only order that the record of her criminal charges/conviction(s) to be sealed from the state or federal repository.

I can just imagine a judge ordering a newspaper and it's reporters to destroy any documents making reference to any charges brought against her.

To those who may not know all the facts, do not comment unless you know the true events that occurred. If you do, then speak up and tell us what really happened. What happened has been revealed to the police department and the courts. That is why the court erased all charges and files.
I know this family and the treatment they went through by some police officers who had a political agenda during those couple of years.
When Ms. Farias daughter was involved in a serious five car accident, she came to the scene as any worried parent would. One perticular police officer met her with his opportunity! What parent isn't concerned enough to see if her daughter is alive when she sees the vehicle in scraps? I was there one the scene, I saw everything. I doubt those who commented were there... One shouldn't comment on what happened if you weren't a witness.
As for those who criticized Ms. Farias work ethics, I ashure she is a hardworking lawyer who is not involved with any corruption period.

The question is: Did Nelson break the Code or not. If he did, someone needs to sock it to him and all other legal representatives who think they are all above the law. For the person commenting on the "family" of the complainant, it appears that you merely have negative comments to say as a result of being disgruntled; otherwise, what relevance does it have? There are always rumors about folks families, but again... irrelevant, right? I think the citizens should merely concentrate on the law if they have anything to say. Otherwise, let the justice system (if thats possible) take its own course. Is it not what the law is about?

Those who know me, can acknowledge that I will discuss any disputed issue with anyone who desires to question me. Since I have absolutely nothing to hide, I have issued this reply to the individual questioning if "I have written my own prior comment" - not sure which one you may have referred to. Otherwise, generally speaking, if one believes he/she has faced any type of violation of the law AGAINST him or her, our legal system is here to SEEK justice. EVEN THE VISITING JUDGES ARE ON THE TAKE. WHY IS IT THAT ALL OF THE CASES DISMISSED FOR THE COUNTY OR CLOSE POLICTIAL FRIENDS APPEALED TO THE 13TH COURT OF APPEALS. BECAUSE THE COUNTY AND THESE POLICTIAL FRIENDS KNOW THAT THEY HAVE TWO VERY CLOSE POLICTIAL JUSTICES SITTING ON THE COURT OF APPEALS. WHICH MEANS THE CASE WILL BE AFFIRMED BY THE APPEAL COURT. LOOK UP THE JUSTICES ONLINE AND THOSE TWO JUSTICES NAMES WILL HIT YOU RIGHT IN THE FACE.

JUST RESONALLY A CASE WAS OVERTUNED, REVEARED, REMANDED BY THE TEXAS SURPREME COURT THAT INVOLVED THE DISMISSAL OF A CASE IN CAMERON COUNTY AND GET THIS; THE CASE WAS APPEALED AND AFFIRMED BY THE 13TH COURT OF APPEALS. TIES HAVE REACH ALL THE WAY TO THE 13TH COURT OF APPEALS. THERE ARE OTHER CASES ON REVIEW AND I'M SURE THAT THOSE CASES WILL BE REVEARED AND REMANDED BACK TO CAMERON COUNTY. EVERY JUDGE IN CAMERON COUNTY INCLUDING THE VISITING JUDGES AND ALL THE WAY UP TO THE 13TH COURT OF APPEALS ARE ON THE TAKE. THINK ABOUT THIS, WHY IS IT THAT OUR LOCAL ATTORNEYS DO NOT WANT TO TAKE ON A CASE THAT INVOLVES THE COUNTY OR A POLICTICAL CONNECTED FRIEND? THE ANSWER IS THAT THESE ATTORNEYS HAVE CASES IN FRONT OF THESE SAME JUDGES AND ARE AFRAID THAT THE JUDGES WILL RULED IN FAVOR FOR THE OTHER PARTY EVEN GOING AS FAR AS SIDE STEPPING THE LAW. LIKE IT SAID, GIVE SOMETHING AND GET SOMETHING BACK!
