Claiming that former Mazz frontman Joe Lopez has not exhausted hi post-conviction remedies under Texas law, Cameron County District Attorney Luis Saenz said he will go to court to deny Lopez's attorneys the DNA evidence and information they seek.
Armed with a Texas Attorney General's opinion that basically states that "the district attorney's office must withhold the submitted information in its entirety..."That information consists of files, reports, records, communications, videotapes, and working papers used or developed in an investigation of alleged child abuse under Chapter 261," the AG order states.
Notwithstanding the AG's ruling, Saenz states in his motion to deny Lopez the information he sought was not based on his decision to withhold if from him, but rather, because of Lopez's "failure to show that he has exhausted all his post-conviction remedies."
Saenz noted that the writ of habeus corpus Lopez filed with the 13th Court of Appeals had been dismissed and not denied on procedural grounds. He further stated that Lopez and his defense had yet to file a motion for Post-Conviction DNA Testing under Chapter 64 of the Texas Criminal Code.
Once those remedies are exhausted, Saenz implied in his motion that the Cameron County DA's office would probably comply with the writ of mandamus and hand over the evidence requested by Lopez and his attorneys.
A hearing on the matter is scheduled for April 12 before Visiting Judge Federico G. Hinojosa after 445th District Judge Rolando Olvera recused himself from the case due to his personal relationship with DA Saenz.

Zamora's efforts in the DA's office present an illusion of good works....there is little or no real evidence that anything in the DA's office has changed, except the person sitting in the chair. If Melissa's job is to promote the DA, then she is doing that. The DA is advertising, but is he really doing anything? Has anything changed in that office? Has the prosecution of criminals been taking place? We don't know, because all the money is being spent promoting the man, and we hear nothing about effectiveness of his role. To me its all a big smoke screen....to give the impression of action, but not really showing evidence of action. This smoke screen means that all sorts of "old" crap continues, while Saenz takes his moustache out in the breeze for these promotions. And, how much is this smoke screen created by Zamora costing us???? And which of her friends, allies or business interests are benefiting from our tax dollars??????? Will we ever be able to trust anyone in the Cameron County Courthouse??????

Sounds like DA Luis Saenz is giving Joe Lopez and his lawyers the path to "redemption". Seems to me that DA Luis Saenz is more interestede in public relations than justice. Since taking office we have seen PR efforts, but there is no evidence that the Cameron County DA's office has changed from "injustice" to "justice".

Did Judge Rollie really recuse himself because of his "personal relationship with DA Seenz?" SMH!!! That means he will have to recuse himself from ALL criminal cases! He can't selectively have a personal relationship rendering a conflict on one case and not have the conflict on another. Who cares if it's an ADA before him. That ADA's performance directly reflects upon, and is an extension of, the person he has a "personal relationship" with. If I was a defense atty before him, I would jump up and down seeking his recusal. This judge must want to be the family court judge because he just neutered himself.

Mr. Saenz greatly profited from the people currently sentenced or undergoing corruption trial. His ties to the previous corrupted administration are strong and still very much alive. He ignores criminal cases that support his inner circle and abuses the trust and power given to him by the people to profit from them. De la Garza, and gilmans cases will remain untouched while marra will permanently remain indicted.
