A visiting judge has refused to heed a motion prosecutors from the Cameron County District Attorney's Office that tax collector Tony Yzaguirre's personal recognizance bonds on more half a dozen charges be converted to a cash surety bond estimated at $50,000 per charge but that the official not return to his office until April 15, the day of his pre-trial hearing.Judge Juan Bañales, of Corpus Christi, gave Yzaguirre an hour to get any personal items from his office. Bañales issued the orders during Yzaguirre’s arraignment on the grand jury indictments this afternoon.
A grand jury initially indicted him in early January on charges of bribery, engaging in organized crime and abuse of official capacity.
The judge denied the prosecution's request, since they couldn’t provide evidence Yzaguirre was a threat to the community.Former District Judge and now Yzaguirre's attorney Robert Garza argued that even current Texas Comptroller Ken Paxton was allowed to remain in his office pending his trial on insider trader charges and former Texas Governor Rick Perry was also indicted and allowed to stay.
Paxton, a Republican, is accused of two counts of securities fraud and one count of failure to register as a securities agent. The charges stem from Paxton’s actions in 2011 and 2012 while he was a member of the state Legislature. Paxton has pleaded not guilty.
Perry was also indicted for "intentionally or knowingly misusing government property" by vetoing money for the ethics unit for Travis County.
A second indictment stated that Perry's veto threat "intentionally or knowingly influenced or attempted to influence" Travis County District Attorney Rosemary Lehmberg.
Bañales said wasn't convinced by Garza's arguments and said the decision was based on his discretion.
When Yzaguirrre was charged before a magistrate, one of the conditions imposed upon the PR bond set back then was that he stay away from his office for 72 hours.
Until then, the tax office will be managed by Jesse Garcia, the tax office's deputy administrator.r.
Some found it ironic that Yzaguirre – the county's tax collector – be prevented from taking possession of his office until April 15, tax day.

Finally someone with common sense! Don't agree that these crooks should be out on PR bonds but this is Cameron County. At least, Judge Banales had the sense to keep him out of the office. That applies to the others also, right? But does Pete Sepulveda have the balls to put Tony Y. in Maintenance to earn that pay check or his he going to give him some cushy job? Citizens of CC want Tony Y. to earn a paycheck and work his ass off!

This man has worked all his life. Very well respected and honored. He has done nothing wrong and this is all political. Call it Dirty Politics. Luis you are in for a huge surprise.
