The whole county courthouse is a buzz over the deferred adjudication and two-year probation sentence given to a 27-year-old woman who forgot her 8-month old baby was in her parked car with the temperature hovering in the 90s.
The case was before in the 445th District Court Monday morning but Cameron County District Attorney Asst. DAs and defense attorney Rick Canales could not agree on a plea bargain for Erica Lynn Munoz, of Brownsville.
State District Judge Rene De Coss denied Cameron County District Attorney Luis Saenz’s request for 30 days jail time to be served on weekends as part of Munoz’s plea deal agreement. De Cos said Saenz, not the court, is the one responsible for fighting for getting justice for the child.
Muñoz was charged with criminal negligent homicide in the death of 8-month-old son Jaziel who she found unresponsive in his baby seat in the back seat of her 2007 Nissan parked in her driveway without any shade.
When she called 911, she trold the dispatcher and then officers who arrived at the scene that the boy was totally wet and that he was unconscious and foaming at the mouth.
Later investigations revealed that she had told officers she had returned from having lunch with her husband Jose and had parked in her driveway. Earlier, she said she had been at her husband's office while the boy was with his grandmother preparing a resume because she was stressed out working at a local charter school where she worked as a kindergarten teacher.
The child was taken to local hospital where he later died. Investigators obtained enough probable cause to obtain the warrants and charged Munoz with Criminal Negligent Homicide. The cause of death of the child was vehicular hypothermia, a term used to describe a heat stroke caused by excessive heat in a confined space such as a car.
At the time, her bond was set at $10,000.
But a check of the case docket that Canales – as part of a plea bargain – had reduced the charge from a state jail felony Class A misdemeanor on a Nolo Contendre (no contest) plea. Cos set her sentence to deferred adjudication and for two years probation.
This did not go over well with many commenters who said people with much lesser offenses –usch as possession of marijuana – often got years in jail.
This did not sit well with the original commenter, who posted to Saenz that she had "admired you for some time" but that his request for a 30-day jail time was "ridiculous."
At the time of the incident on September 11, 2014, the National Weather Service in Brownsville reported that the temperature at about 4 p.m., when Muñoz said she had found the baby in the back of her car, hovered at 93 degrees and the temperature index was 105. Muñoz told the officers that she realized the baby wasn't in the house when the phone rang and she started looking for him inside. She said he had been left alone in the hot car for approximately 20 minutes.
When officers arrived at the scene to process the evidence at the site, they placed a thermometer in the baby seat and closed the door. After 10 minutes, the thermometer read 120.
Baby Jaziiel was one of 31 heat-stroke victims in the United States in 2014.
According to court documents, when offices questioned her at the Brownsville Police Department, Muñoz told them; "It's my fault. There is no excuse. I forgot Jaziel in the car." and told her husband she was "the worst mother in the world."
During the court hearing, the local daily said Munoz’s husband and the deceased baby’s father made a strong plea for his wife, asking the court to give her probation. He argued sending her to jail would further hurt the family emotionally and financially.
Saenz said anyone who sees a child or pet locked inside a hot car can break a window in order to rescue them without fear of repercussions. He added no time is safe amount to leave a child in a hot car.
And if they do, the DA's office will probably agree to probation.

Ask yourselves, how much is a child's life worth in Brownsville? Look at them playing in the heat of a 100-degree afternoon. See them wearing rags to school. Watch them struggle in school thanks to lousy teachers. Roll in your anger at seeing the system let them down. Luis Saenz, however, will hold a news conference should your kids be beheaded and an assistant will tell you about they have gone to be with God. Yeah.

Of Course Saenz doesn't give two cents about that poor baby's death, it doesn't benefit him politically, there is no personal scores he needed to settle with anyone on this case, his campaign is practically a cake walk from now. It is in these kinds of issues that he should be focused on, making a real example, specially to prevent them, there is nothing sadder than this infant's death that could have been prevented if he had spent more time advocating against child negligence. But we are not surprised, this is not the first time Luis Saenz has shown little to no remorse for an infant's death, as a matter of fact his lack of moral judgement can be traced from way back, in 1998 he defended Alma Guadalupe Quintanilla who was the baby sitter that was found guilty for the death of 2 year old Margaret "Maggie" June Dittman,(http://www.brownsvilleherald.com/news/local/article_2225a918-9ba0-5786-ab3c-c03791971e68.html) not only did he get her a $10,000 fine and a reduced 10 year sentence for the baby's death, but also, got her an appeal bond in which the lady was released from jail until case went before appeal. How does this guys sleep at night??? Where is this guy's moral compass??? People who defend child killers are repulsive!!! But of course he needs to go easy on this lady, doing the right thing would be a hypocritical thing to do for Mr. Seanz. Now we know he has a soft spot for child killers, one more item to the list of great qualities that our Honorable District Attorney has. What is more alarming is how his employees condone and follow this kind of behavior. Honestly, what kind of message is his office sending about child killers???? So we have to be tough on corruption, conveniently, ruthlessly, and selectively prosecuting politicians (i.e John Chambers, Korri Marra, Ernie Hernandez, Tony Yzaguirre, etc.) but child killers, they are okay!! No biggie, give them a break!!!! Luis Sanez is a big fat lie and a Joke, this guy cannot end well!!!!!!!
This shows how incompetent Saenz and his group of lawyers are. Brownsville residents are completely neglected in the time of justice. Nowadays children in Brownsville have it worse. Horrible parents that claim their children have an illness to get assistance, lousy teachers at school that are only interested in the check and having extramarital affairs and so forth.
Giving this mother a stretch in the Big House would have not helped her or her dead child. However, it might have put the fear of God into all the other local Moms driving around with their kids in the car and their head up their ass.

The blame belongs exclusively to Judge Rene De Coss. He should have never allowed the plea bargain. Thank God that Gloria Rincones is going to replace his fat ass in November. So all you MFs out there BE ADVISED that if you don't want justice then vote for Rene "La Marana" De Coss. If you want a fair but tough on crime Judge then vote for Gloria Rincones.

The BLAME goes to the DA Luis Saenz...let me school you on something here...the DA only requested for 30 days jail time as a CONDITION OF PROBATION, meaning, that yes good old Mr. Saenz had been ok with giving Rick's client probation...did you get that...he had already offered the client probation and was ok with it!! Now, the Judge after seeing this plea bargain could have busted it and said he would not be following the plea deal, however this is where the defendant has to either say they will be withdrawing their plea and taking it to Trial, because that would be the only option left seeing as how the dam DA's office was adamant about the probation otherwise, there would have been NO jail time as a CONDITION OF PROBATION! She was given two years probation and one of her conditions was that she serve 30 days in jail, probably to serve them on the weekend. (Jail time would be going in on to Carrizales on Friday afternoon, being booked, stay all day Saturday, then being released on Sunday by noon) which in turn she would get 3 days credit, 3 FULL days, which would mean she would spend 10 weekends in jail, in on Friday, out on Sunday) and she's done with her "JAIL TIME" that everyone keeps bithching on and how it's the JUDGE's fault. It's both of their faults, but it all comes down to who made the recommendation of even considering probation and Jail time....that would begin with Luis Saenz! What good does it do to have all this #lookbeforeyoulock shit on his FB page if all he's going to do is give the mom/dad/person probation...good one scumbag Saenz, good one. And BTW Mario Saenz...your comment on the thread of that incident..."Had to be a Republican judge, VOTE GLORIA RINCONES DEMOCRAT" isn't your dumbass brother supporting a REPUBLICAN candidate...Mr. Cortez?!?
