PAROLE BOARD DENIES GONZALEZ RELEASE UNTIL 2019

For the second time in as many years, a state parole board has denied Marco Antonio Gonzalez, the former Cameron County Sheriff Department corrections officer who shot and killed fellow guard Ivan Reyes on June 2014, conditional release and said he must serve his five-year sentence until June 2019.

Image result for marco antonio gonzalez, brownsvilleOn May 17, the board said Gonzalez should remain incarcerated in the McConnell Unit near Beeville until June 15, 2019 because the nature of his offense indicates "that the instant offense has elements of brutality, violence, assaultive behavior, or conscious selection of victim's vulnerability indicating a conscious disregard for the lives, safety, or property of others, such that the offender poses a continuing threat to public safety."

Also, the board said that "the record indicates that length of time served by the offender is not congruent with offense severity and criminal history."

Actually, a jury acquitted Gonzalez of the murder charge and he was later found guilty on nine charges of aggravated assault on police officers and retaliation and a charge of attempted murder and kidnapping were dropped during the trial.

The charges stemmed from a six-hour standoff with police called to the house of Monica Robles, his former lover, where he held her at gunpoint and attempted to shoot her brother when he arrived to investigate the shooting of Reyes after his sister called him.

Gonzalez was found guilty on the nine charges by a jury and – through a series of misunderstandings and confusion on the jury's part because of muddled instructions by the judge – assessed a total of five years on each charge with two years credit for time served.

Court transcripts show that the jury thought that after they received the court's instructions, they were assessing five years per charge to run consecutively and sentencing Gonzalez to 45 years.

Instead, they found out that his sentence on the five convictions would run concurrently and he will be eligible for release in 2019.

After the sentence was announced, the finger pointing began. Cameron County District Attorney Luis V. Saenz blamed 404th District Judge Elia Cornejo for her instructions to the jury confusing them on whether the sentences in the second trial would run consecutively or concurrently.

Cornejo, in turn, said that she was just following the law and said she was neutral.

For the Reyes family and local court observers, the fact that the defense team of attorney Ernesto Gamez and his daughter Erin were able to convince a jury in the murder trial that Gonzalez had acted in self defense was ludicrous.

"Ivan had put down his gun because Gonzalez was holding Monica Robles in front of him," said his father Carlos Reyes. "When he did, Gonzalez shot him in the chest with the assault rifle and then as my son was trying to crawl out of the house, he shot him in the head. How is that self defense?"

The parole board on May 24, 2017, denied Gonzalez parole on the same grounds as they did this year.

The Reyes family, meanwhile, have been advocating that naturalized citizens such as Gonzalez, be deported based on their argument that the six-hour standoff – and evacuation of a nearby elementary school – constitute domestic terrorism since he violated the oath he took as a citizen and a law enforcement officer to uphold the law.

"This violent, addicted and sadistic man cannot be allowed to walk the streets and co-exist with peaceful, law-abiding citizens," they said in a statement.

"As a naturalized citizen born in Rio Bravo, Tamaulipas, he swore and promised to obey the laws of the land. He has broken that solemn vow and broke every law – of man and God – when he perpetrated these acts of violence and murder.

"In fact, his crime was also a crime against the community because as a result of the standoff and the shootings, an elementary school nearby went on shutdown to protect the children from accidentally getting shot.

"There has to be a way to prevent this from happening again and these horrors to be perpetrated against our fellow Americans. The law must be changed to allow for the deportation of violent felons, even if they are naturalized citizens.

"Not only are we advocating the change in the law to allow for their deportation, but we are asking that the law be applied retroactively. Currently, the law only allows for citizenship to be revoked for naturalized citizens for treason against the United States and for selling their naturalization papers.

"In this case, not only did Gonzalez betray his pledge to this nation to obey its laws, he also betrayed his oath to the state when he shot and murdered a fellow law enforcement officer and committed these crimes. We ask that a system that is similar to those that exists in some European countries be studied and that a citizenship review board for naturalized citizens with the power to strip those committing heinous crimes and felonies of their citizenship and deported.

"We therefore plead to our government that his citizenship be stripped and that he be deported so that our fellow citizens will not live in fear that someday he will again torment and pillage innocent people now that he has perverted the justice system and gotten away with murder."

Exactly, for stealing fajitas, Escamilla got 50 years. For killing someone and threatening many, the stupid judge woke up from her snooze and did not instruct the jury correctly. I say, "Let him out and let him go live at Elia's house and put Elia in to replace him in jail. How can a judge get away with such pendejada. Any peon sitting at the trial were immediately commenting on what this idiot judge had done. Y que le hizieron? Nada, so she could go out and chase a frivolous personal suit. Is it correct that she will not be running for judge again? They got Banales for speaking well of Judge Hester, but let Elia go for being stupid.
