ELIZONDO-SAENZ LOVE FEST BETWEEN STATE VS. DEFENDANT

“First of all, I want to thank God, my family and everyone else who was here with us (and) my lawyer, Eddie,” Elizondo said after the trial while hugging his wife.

“It’s a very hard road, and I just want to thank, again, my family, God and everyone who prayed for us. Everyone who was praying for Eddie, for the DA (District Attorney) Saenz, because we also have to thank him, he was doing his job. We are happy with what happened today, we can rest as a family today and for now, we are going to go home. We are very tired of all of this.” Former BFD Chief Carlos Elizondo after not guilty verdict

“You know, you do cases every day, you win some, you lose some and I hate to say that we lose some because we are just seeking justice and if justice is that the jury said ‘not guilty,’ I respect that,” Saenz told The Brownsville Herald.

“I wish him and his family well. I know they went through a lot. This didn’t have to happen, but this case had to be tried, and we tried and the jury spoke. I hope he can put it behind him and that he can start recovering, get back to work and move on … He was my friend, and I hope that he can be my friend again.” Cameron County District Attorney Luis V. Saenz

It's good to see everyone is willing to let bygones be bygones, even after the fallout from the not guilty verdict issue by a jury in the trial of former City of Brownsville Fire Department Chief Carlos Elizondo on six counts of computer security breach while suspended by the city.

It didn't help that new Fire Chief Jarrett Sheldon, the person who filed the complaint against Elizondo, just ordered to “downgrade” the access and make it "view" only.

“He said, ‘I need for you just to downgrade it.’ In other words, the only thing he ever told to anybody was: don’t shut it off, just downgrade it so that now he only has access to view,” Eddie Lucio, Elizondo's attorney, told the local daily.

If that is so, then why file the charges? In this case, the city's policy did not enumerate what specific department assets Elizondo could not access, something Sheldon said on the stand that he was working on revamping.

But before there's a group hug of everyone involved, let's keep in mind that there are two more charges out there not related to the computer breach. He faces a separate indictment accusing him of theft and misapplication of fiduciary duty over allegations he stole from the firefighters association.

Will the DA's Office get cold feet knowing Lucio will be Elizondo's lawyer in those cases as well?

"The only way that Luis can salvage this is for him to try the two other cases personally," said a local attorney. "If they are dropped or someone else in his office is trampled by Lucio, it might not go well."

Elizondo is a piece of crap and should have been convicted. He is a part of the local political mafia and they always seem to skate. Its the corruption in Cameron County politics that keeps this the poorest county in the state and makes businesses turn away from coming here. The corrupt politics makes the quality of life here stink.

Of the things they have accused Elizondo of they prosecuted him on this? These charges seemed flimsy to begin with and now, knowing that the department did not even have a policy against the behavior (he should have known they said--how crazy is that)and knowing that they must have considered that he might try to access the system and were apparently okay with it otherwise why just restrict his status to read only other then deny him all access? Waste of money and resources by the city of Brownsville, the fire department and the D.A.s office. I wonder if Elizondo will still love Saenz when the legal bills start rolling in.

Poor Eraasmo? What have they done to him? He made his bed so he now has to lie on it and thing about what he said when he was sworn in at board member - He would never do anything to embarrass his father! He has two strikes against him in this short of a time and nothing has been done about. Why have they not removed him from the board or at least tell him to stay away from HHS where he loves to take pictures of the kids. Parents need to rally at the school and not let him in? What is he doing with those pictures?

The jury spoke and that is the justice system. Carlos and his family has gone through hell and he and God know what the truth really is. How did that telephone call between De Leon come into play. Will that be brought out on Part II of his upcoming trial? If you study all these cases, it is only right to question the corruption that does exist here in our town and the richer get richer and the poor only get food stamps. Something is wrong in Denmark!

No big surprise. There are huge problems with the other case against Elizondo too. All three cases were politically driven and not fact based. City said no ambulance companies were operating in COB except what Elizondo allowed. Fact ; 1000 calls to outside ambulance companies over ten years according to COB records. None of those outside companies had a permit either. Why no arrests there ? DA should drop charges against Elizondo and investigate why COB only gave him the half of the evidence.

If he goes to trial and is found guilty he'll get 50 read my lips 50-50 seconds in jail end of story and his job back if he promises not to use medical tape plus the lawsuits and he'll win. More pot holes more floodings no bus shelters and the homeless will stay at veterans park, Ooooh but everybody will get a pay raise.

I am tired of seeing the shit show put on by the DA's office. Leave your vendettas out of the courtroom. Way to Go Lucio!
Congratulations to the Elizondo family

Art Teniente was the wrong prosecutor on this case! His demeanor and the sound of his voice is annoying enough to turn off any jury! He's just not a people person even when he' not working!
Didn't surprise me that Elizondo got off and the CCDA just ought to drop the other pending charge because Elizondo will get off on that one! There was enough evidence to get a conviction BUT it was the presentation and Lucio' slick tongue to show doubt!
What' sad that conviction for alleged sex crimes with no evidence get convictions because of a slick tongue from Bailey and the ignorance of juries to understand the terminology used in trial!
Oh well, only in CC!
