NURITH EXPLAINS NO VOTE ON PROBE INTO LOST $1.3 MILLION

(Ed.'s Note: Tuesday's vote by a majority of the City of Brownsville commissioners to investigate  the $1.3 million double payment by the Brownsville Public Utility Board to Texas Noble Construction was not joined by District 1 commissioner Nurith Galonsky. Despite her no vote, the city administration's request to initiate a probe into the initial missing $1.3 million payment which was sent to the wrong bank account and the wrong bank where it disappeared was approved. Below is Galonsky's reasoning explaining why she voted against the probe by the city.)

One of the reasons we have different city boards is to engage Brownsville citizens in local government. It is our responsibility to appoint people who we believe are competent and qualified to sit on each board and that we trust will make good decisions for the City and our citizens. 

BROWNSVILLE VOICE To that end, we should encourage board members to take an active role in executing their duties as board members — ensuring that they regularly attend meetings, stay informed about the issues their organization is dealing with, and that they explore all sides of each issue.

In addition, I believe that the City Commission should respect a board’s decision on matters that it has explored and decided after careful consideration. In other words, if the board has received ample information to make an informed decision, then I think we as a City Commission should respect and ratify the board’s decision unless new information comes up or it becomes apparent that material information was disregarded.

In this particular case, it has been less than two months since the incident in question happened and the BPUB Board has decided to wait until the FBI investigation is concluded. If this is an instance of phishing, then BPUB has cyber security insurance that can cover most if not all of the damages that the company has incurred. 

Alternatively, if the incident is a result of an “inside job,” then I trust that the FBI will identify everyone involved in the crime and prosecute them accordingly. Meanwhile, BPUB’s internal auditor has done her own audit and given recommendations on what policies and procedures should be adopted to avoid the same situation happening again. Consequently, it is my opinion that having the City Commission initiate its own audit and/or investigation at this time is premature or duplicative.

Additionally, Mayor Mendez sits on the BPUB Board and is a member of BPUB’s Audit Committee. In deference to him, I would like to give him and his peers an opportunity to deal with the situation as they see best.

There is no indication that BPUB is being poorly managed or impropriety is prevalent thereby necessitating an immediate intervention. 

 Like I said earlier, if it turns out to be an instance of phishing, it is likely that BPUB can recover most if not all of the damages. And if it turns out that the loss of money was an “inside job,” then I certainly do not want to compromise the FBI’s investigation or assume that we can do better. 

To the extent that the City Commission has questions about what has happened, it is appropriate for us to ask the Mayor what he knows or have CEO John Bruciak give an explanation of what he knows. But to go as far as initiate our own investigation or audit seems ill-advised at this point.

Either this so called professional is really off or she is confused, She states that meanwhile, the BPUB auditor has done, (in the past already been done), her own audit and gives recommendations on what policies should be adopted to avoid the same SITUATION from happening again. The BPUB auditor did discover wrongdoing or why else would the BPUB auditor report to the commission her recommendation on what policies and procedures to adopt to avoid the SAME SITUATION from happening AGAIN. Truth is the City Commission already did initiate their own investigation or audit and there were wrongdoings. The citizens of Cameron County want some transparency as to "WHY". From the language used on the article from Nurith Galonsky it appears that she is hiding something or trying real hard to cove-up some wrong doing. She must be aware that we the citizens of Cameron County are aware of what SHIT smells like. Seems you and your crew already initated your own investigation and audit and found shit. At least be truthful.

Sure, we are still waiting for the FBI to present its case against someone we trusted to vote her into the BISD school board and she is not even "under house arrest" as many of us are with the Coronavirus!

The virus in Brownsville is actually that spread by people who "scratch each other's back" and pass it around. If the money was never issued to Capistran's firm, it was stolen and by whom? Oh, the insurance is going to pay it without question except for an increase in premium that we taxpayers will have to pay on hiked charges by PUB.

No excuses excepted, Nurith! You messed thing up with this explanation!
Once you appoint a commission, how are they supervised and by whom?

Wow ! A true politician with their eloquent words to avoid the issue or solve the problem. If it had been an employee doing this to a business, they would have been shown the door with prosecution coming. Everyone washing their hands on this one. You should hold the overpaid CEO and Financial Officers accountable for this, isn't that why the command that excessive salary.

She just lost her re-election, nice try to cover your trail on why you voted “nay”, the real question in this is what is wrong with some transparency for the citizens of Brownsville? Why wouldn’t you want that for your citizens? We all know in house audits only allow one to cover/clean up ones mess, there’s nothing wrong with calling in a different set of eyes that have no affiliation to this situation. All in all, someone needs to be held accountable, if not one person faces ramifications it is clearly evident that Tray the gay and company took steps to only seem proactive. If the headlines read CEO fired, board members removed, it is then we shall know a true investigation occurred. Let’s re-open “The Bridge to nowhere” (Lucio grins and stutters).

Majority of the officials and their selective individuals are democRATS and willing to turn the other cheek when it becomes them! Where are the Feds when we need them? It is this same bunch of dolts that set up General Flynn on bogus charges because they didn't like his politics. If they can't get to the bottom of this, call in the Rinches or Louie Saenz. Two other investigations are already under way -- the FBI's and a PUB audit. If an insurance company pays for it they will no doubt want to conduct an investigation to try to recoup their money. So, I'm not entirely clear what another investigation would accomplish at this point, unless there is reason to be concerned about systemic problems with the PUB Board's oversight.

The danger with too many investigations is that they get in each other's way and it makes it more difficult to determine what happened. Beyond that, Galonsky is right that the City Commission should not be micromanaging the PUB board. In her time on the PUB Board and GBIC I'm sure she felt the sting of interference by the City Commission (like the hiring of the unqualified Lozoya over her objections).

That said, "Trust us" is rarely a good approach for a public official to take. And where is the PUB Community Advisory Panel?
