(Ed.'s Note: The case against David Lee Hernandez, at left, husband of San Benito Commissioner Carol Sanchez, taking her oath of office Tuesday is flanked by her father Cusberto Sanchez on her right and her mother Carmen Sanchez on her left. Hernandez was booked with three charges July 7, 2019: Aggravated Assault with a Deadly Weapon of a family member, Deadly Conduct/Discharging a Firearm, and Unlawful Possession of a Weapon by a Felon over an incident involving his father-in-law Cusberto Sanchez.
Although Sanchez has previously stated that she and Hernandez are separated, court documents still list her as Hernandez’s spouse. Commissioner Sanchez could not be reached for comment.The case stems from an event in which Hernandez allegedly aimed a handgun at Carol Lynn Sanchez’s father on July 7, following San Benito city’s ResacaFest on July 6. Hernandez was allegedly intoxicated when he requested driving his father-in-law’s vehicle at the Sanchez’s family home. When his father-in-law (unnamed in the police report) refused to let him drive his vehicle, Hernandez shot at him, missing him by a hair and fleeing the scene once he heard police sirens.
Police on the scene could not find Hernandez but found a loaded pistol and a spare loaded magazine.
The state had asked for a continuance after they alleged that they had been unable to meet with the victim and that he had been avoiding prosecutors. Then the COVID-19 virus got in the way in April 2020 and the case has dragged on until September 2020 when Hernandez refused a plea bargain from the Cameron County District Attorney's Office.
COVID-19 prevented the selecting of a jury and the case was reset again and again.
Until now, the Sanchezes have not been served, according to the court records. The trial is now reset for September 7, 2021. For all appearances, it might have been handy to serve them during the commissioner's swearing in. Or have they kissed and made up and it’s all good now?)
