CAPITAL MURDER: PAY ATTENTION SHERIFF, THERE WILL BE A QUIZ


When the reporter asked Sheriff Garza if the double execution of father Inez and son Manuel Cruz whose bodies were dumped on Old Port Isabel Road was a Murder or Capital Murder Sheriff Eric Garza said: "That's going to be up to the  (Cameron County District Attorney) Luis Saenz .

That happens when you hold a basic peace officer license. Obviously he didn't know what to answer.

They were kidnapped, both of the men’s hands were bound with electrical cords and had their heads covered with a t-shirt and with a gunshot wound to the head, that constitutes a Capital Murder and is based on the Texas Penal Code, not the DA's opinion.

What is Capital Murder in Texas? Pay attention Eric, it will be on the quiz.

Murder is elevated to a capital offense when the murder occurs under specific circumstances. Pursuant to Penal Code § 19.03(a), a person commits capital murder if he commits murder as defined above and:

The individual killed is a peace officer or fireman in the line of duty and the person knows the individual is a peace officer or fireman;

The killing occurs during the commission or attempt of the following felonies: kidnapping, burglary, aggravated sexual assault, arson, obstruction or retaliation, or terroristic threat;

The killing was committed for payment or promise of payment. Both the person who kills another and the person who hires a person to kill are guilty of capital murder;

The killing occurs during the escape, whether successful or not, from a penal institution;

The individual killed is an employee of a penal institution and the killing is committed by an incarcerated person;

The killing is committed by an incarcerated person in conjunction with organized criminal activity;

The killing is committed by a person incarcerated for murder or capital murder;

The killing is committed by a person incarcerated for the following aggravated felonies: aggravated kidnapping, aggravated sexual assault, or aggravated robbery;

The person kills more than one individual either during the same criminal transaction or during different transactions but under a common scheme;

The person killed is under 10 years old; or

The individual killed was a judge or justice and the killing was committed in retaliation or on account of the judge or justice’s service.

What is the Punishment for Capital Murder?

Capital murder carries a penalty of life in prison without parole or the death penalty.

What - the fuck - are the odds that D.A. Luis Saenz will even bother with this. He is the Un-District Attorney, a man apparently at odds with seeking justice.

You should start a pool on these cases, with the winner being the one who predicts Saenz will jump headfirst into a case. But, sure, don't hold your breath.

Who has he prosecuted anyway?

I’m not sure the problem with inaction is Luis Saenz. I suspect the one pulling all the funny strings is Edward Sandoval and something tells me that moving him to his role may have always been a play for a bigger case in Cameron County; however, not to defend Eric Garza, but he is right that the DA’s Office will decide if they pursue the capital crime or the regular charge or both.

I think much of what you witness with Eric Garza is a heavy reliance on Robert Garcia and said person may be the real problem in the SO. Donor biz has a cost… is Garza bought and paid for? Or is Garza able to get out of the deed that helped get him Sheriff? Character test…

Wow. Gentlemen,
when you have nothing to cry about; the beard, if he looks good with beard or no, wtf is that a concern to the voters that voted him in.
The answer he gave was, for your information the political correct answer to give. Since you know so much about the penal code and what not, you seem to ignore that the DA makes deals depending how strong the case is. At times, if the accused works out a DEAL/PLEA it is up to the DA in best interest of the case to make decisions. The accused could want to disclose who sent him and that might be what the DA wants to pursue. If Mr. Garza answers Capital Murder to make YOU happy, you or the people that keep up with this other than to cry about beards and media at the scene answers, could say, "why did the DA go with Murder and not Capital Murder like the Sheriff said." So his answer is correct.
The problem is that you liked or coached your prior leader/hueso to answer I DO NOT KNOW, I DO NOT KNOW AT THIS TIME. All his answers by the way were from behind his desk late in the day when he was finally found to answer to media. Mr. Garza was at the scene, beard or no beard. Llorones.

Sheriff Garza is having a love child with his side piece, she is due in July!! Things in Cameron County are about to get very interesting..He tried to make her get an abortion. Thought he was happily married but I guess not

working for any tax supported job is easy many work for over 50 years and are NOT qualified but somehow they stay there.
