ROBERT GRACIA: THE DO'S and DON'TS OF MAKING A TRAFFIC STOP

(Ed.'s Note: The road to hell is paved with good intentions, the saying goes. In this case, this is what happened to Cameron County Sheriff Department Chief Deputy Robert Gracia this past Wednesday, March 2, when he attempted to cite a truck driver for what he considered to be speeding. He pulled the truck over in his unmarked unit and the driver, thinking he was a fake cop, kept going and called the Brownsville Police Department. Once he stopped and police arrived, Gracia demanded that the cops cite the driver for excessive speed. But, alas!, poor Bob, didn't realize that his unit did not have radar to prove his charge. The driver wanted to file a complaint for an unlawful stop and the PD guys referred him to the Sheriff's Office. Good luck with that.)

You can pace vehicles with certified speedometers; if the vehicle wasn’t paced it would be an issue.

Stay away from them.....let them pass....5 miles over the speed limit...let them go....


They do not sleep well, they are not paid well, and they guide themselves with their radar...they do not know the towns they go by.

Help them reach their destination without killing anybody.

Gracia doesn't know the law. He just knows how to break it. What a piece of Shit of a man. Hope the driver of the 18 wheeler was taking away his son Jonathan's pictures away. I was tired of seeing his ugly face all over town. With his lying slogan....im not a politician. Lol

The truck driver should file a formal complaint to the Texas Rangers, stating an official complaint of abuse of power and unlawful detainment by this unworthy and unqualified representation of a law officer!!!

It would be interesting to see if Gracia called his underlings to give the truck driver a ticket. I wonder who signed the ticket swearing to the speeding and stuff. Did Gracia "order" them the deputy to issue a ticket? I also hope the truck driver had an up to date truck with video and gps as most of our trucks now have. That could really blow Gracias story out of the water.

He had to take the State exam for peace officer 3 times till he passed it. How do you expect him to know that you can't give someone a ticket for speeding if you don't have a radar?
You know this won't be the last time this inept "chief deputy" will do something before he gets arrested.

So why did BPD not take the report from the trucker ? Looks like the incident happened in the city. BPD could at the very least made an miscellaneous report on the alleged incident.

Bad enough that this ex-Fed with the dark clouds over him bought the second in command position for over $30K. This ex-Fed who has no idea about conducting traffic stops especially in an unmarked vehicle and wearing no uniform and using his eyes to determine a violation of speeding is nothing more than a liability, pending lawsuit with a payout. Sad, that BPD did not take a complaint even though this is a clear violation of abuse of official capacity. More so, BPD should have taken the complaint especially because this ex-Fed demanded that they issue a citation for a violation not observed by them. Thanks a lot Eric Garza for hiring this POS! But then again, you are nothing or an LEO with street experience and you only proved that for a very generous political contribution you will give someone a key position in your administration. Get rid of this POS, he is going to cost the county money and maybe your next reelection!

Seems to me that a low life cop in the neighboring county went to jail when he tried something like that. Don't waste your time with the sheriff's dept. Texas DPS is responsible for complaints on ALL law enforcement officers licensed by the state. Most readers here are too arrogant or slow to understand this. Attempting a traffic stop on an unmarked vehicle? He should be investigated by the DPS.

THE TEXAS TRAFFIC CODE SPECTIFALLY INDICATES THAT NO UNMARKED POLICE VEHICLES ARE PERMITTED TO MAKE TRAFFIC STOPS FOR ANY TRAFFIC VIOLATION EVEN IF THE OFFICER IS IN UNIFORM!!!! THE ONLY WAY FOR AN UMARKED UNIT TO MAKE A STOP IF THERE IS PROBABLE CAUSE TO BELEIVE THAT A CRIMINAL OFFENSE HAS BEEN COMMITTED, IS COMMITTED OR IS GOING TO BE COMMITTED THATS IT!!!!!!!! UNMARKED UNITS ARE NOT ALLOWED BY THE TRAFFIC CODE!!!!!!

At March 5, 2022 @ 1113. YOU MAY BE THE PROBLEM WITH RGV POLICING… where is the CODE specifically stating unmarked units cannot conduct traffic stops?

“A police officer in an official uniform–or displaying a badge–may use an unmarked vehicle for traffic enforcement and stops when they witness or suspect a traffic violation. If the driver flees, a marked vehicle must be called to initiate the pursuit.“

Sec. 720.001. BADGE OF SHERIFF, CONSTABLE, OR DEPUTY. (a) A sheriff, constable, or deputy sheriff or deputy constable may not arrest or accost a person for driving a motor vehicle on a highway in violation of a law relating to motor vehicles unless the sheriff, constable, or deputy displays a badge showing the sheriff's, constable's, or deputy's title.
(b) A person commits an offense if the person violates this section. An offense under this section is a misdemeanor punishable in the same manner as an offense under Section 86.011, Local Government Code.
(c) An officer charged by law to take or prosecute a complaint under this section shall be removed from office if the officer refuses to do so.

I am not, in any way, attempting to help Mr. Garcia out or favor him, I have my own concerns with other matter, but if anyone on these comments are commenting nonsense about a sheriff deputy in an unmarked unit cannot make a traffic stop AND THOSE SAYING SO are instructors for TCOLE exams, then maybe the TCOLE exams are flawed? CONSTABLES SHALL serve papers and MAY. Perform traffic when they have NO SHALL WORK… OR SHALL make a stop in the interest of threat to property or life.

It’s been apparent these past few weeks many peace officers in the RGV or at least in Cameron County may be poorly trained on actual application of law.

And now I will tell you, after explaining how people don’t understand the traffic code and who can enforce it, WHAT the issue with this situation is for Mr. Garcia.

1. In order to CITE for a misdemeanor (class c), ONE HAS TO OBSERVE the violation.
2. Brownsville PD … DID…. NOT …. OBSERVE
3. Garcia could have CITED… with HIS OWN TICKET BOOK…

So… now we know people got some work to do job their LEGAL COMPREHENSION of the LAW…

I was driving 40 miles over the speed limit, I fought the BPD in court. I won the case because my park car was been push by the wind. The radar detector was not working right. Asshole cop.

I am sure you succeeded in your imaginary court case as the judge saw your ineptness and felt bad for you. Since the judge and jury live in your head, they are very well aware of your daily school bus rides on the short bus and the need to get gold stars on your forehead at the end of evey school day. You see, everyone does win!
