CCSO CHARGES ON SUSPECT TRYING TO TAKE A DEPUTY'S GUN CAUSING IT TO FIRE AND AGGRAVATED ASSAULT ARE DISMISSED

An asylum seeker's arrest in the pre-dawn hours last Tuesday by a lone Cameron County Sheriff's Department deputy answering a domestic disturbance call that resulted in his heavily publicized arrest and charged with two felonies and a misdemeanor, has resulted in a dismissal of the charges.

A press release issued by the department indicated that  deputy Victor Leos responded to a domestic disturbance at about 5:30 a.m. at a residence on the 6400 block of Tabitha Circle off S. Dakota Road in Cameron County. A woman there told Leos that a man she allows to stay on the property in a sofa outside the home arrived intoxicated and was causing a disturbance. She said he had left before the deputy arrived.

While Leos was talking to the complainant, the suspect, identified as Noel Jose Arieata Paez, arrived wanting to speak to the deputy and showed him a United States Immigration document that was titled “Warrant of Arrest.”

Leos, who wrote in his report that he observed that Arieata Paez appeared to be under the influence of some unknown drug, then proceeded to detain him and attempted to place him in handcuffs and that it resulted in a scuffle.

During the ensuing struggle Arieata Paez, Leos reported that the suspect reached for the deputy's holstered handgun but had failed to remove it "due to the holster’s multiple levels of security."

Leo's report stated that Arieata Paez caused the firearm to discharge but that he was able to place Arieata Paez in custody after deploying pepper spray and immobilized him with a taser. Nobody was hurt by the discharged bullet projectile.

Arieata Paez and transported him to the Carrizales Rucker Detention Center charged with Attempting to Take Weapon From an Officer TPC 38.14, a State Jail Felony, Aggravated Assault on Public Servant TPC 22.02, a 1st Degree Felony (2 counts), Resisting Arrest, Search or Transportation TPC 38.03, a Class A Misdemeanor (2counts).

He was placed in custody on a total of  $108,000 in bonds.

This is where it get interesting. After hailing the arrest and filing two felony charges against the asylum seeker in social and mass media, a hearing on the charges indicated that the report – written by Leos, the arresting officer – was found deficient and the charges were dismissed. Federal authorities placed a hold on the suspect and he remains in custody.

Media organs have been trying to secure details on the reasons for dismissal of the two felony and the two misdemeanors charges, but the CCSO has not issued details on the reason for the dismissal of the state charges for which Arieata Paez was arrested and jailed.

The DA office works with law enforcement or AGAINST law enforcement. There is something wrong with the magistrate court or the ADAs, these guys are always dismissing the cases for even mistakes that are minor.
Do they not understand how we are overworked!? We work long hours and the calls keep coming in. What’s the point of us making arrests if they are getting dismissed regardless do you really think we even want to make arrests now!!?


I wonder if the VICTIM was rellated to magistrate court or the DA office
If the charges would be dropped on the suspect because the deputy messed up on report?

Well maybe the charges were dismissed cause the Feds are taking him away and eventually will be deported. Also maybe the case will be re submitted at a later date or something. Just saying

Suddenly, a cancer diagnosis strikes, necessitating surgery and chemotherapy. Upon resuming work, you find Sheriff Garza has reallocated your unit to a novice detective entangled in an intimate relation with a captain. This just goes to show that the sheriffs office under the supervision Eric Garza is incapable of doing their job. First of all, Leos is one of the biggest skater and one of the most shady deputy the sheriffs office has. Yet Eric praises him. I’m sure Leos report is falsely written. Can we look into how a gun goes off in a level 3 holster? Guns don’t shoot by themselves. It says that the suspect attempted to take the gun but was unable to and then the gun suddenly goes off??! Lol. Sounds like a big cover up for me. Sheriffs office is trash.

These charges got dropped because DA’s office knows the sheriffs office lied on the report. DA’s office actually has respect for the badge unlike Eric and his minions. Hope they look into this incident further!

Linda Macias is in charge of District 2....very close to this Dakota street but not part of her area. Then the City of Brownsville should have a program to clean all the streets: people can throw away sofas, wood, old refrigerators, washers, etc to help the residents have a clean place and not accept rats, snakes, mouse etc in their homes.

It is very hard to get rid of pests...it is a never ending task.

There is no way a gun in a Level III holster goes off without it being out of the holster. More lies to protect the Deputy who obviously f@cked up. How did he write the report if he was in the hospital getting treated for his injuries. His cheatin wife posted a pic of him being wheeled out on a wheelchair. Something is off here. Inquiring minds want to know what the real story is.

As for now the grand jury has nothing to do with the charges being dismissed. The grand jury comes into play when the individual is arrested and the DA presents the evidence. The grand jury will then decide if there is enough evidence for a trial. But then it also matters what evidence was presented to the grand jury. To me n just me it looks like the statement presented to the arraignment judge lacked probable cause for the arrest and the judge dismissed the charge or charges. There is more to this and needs to be looked into. Looks like a mess.
