As a retired soldier, I am especially proud and happy to salute our flag, not just during the National Anthem, but any time it’s on parade.
While it is a piece of cloth with bright colors and, of itself, meaningless, it is a symbol that represents our country and all of its people. It definitely merits our respect.
It greatly disturbs me when I see blatant disrespect by anyone when our Anthem is being played. For example, when watching any sporting event, and it is played, I often see people in the stands moving around, talking, not even looking at the flag, some with cell phones either talking or playing with it, and so many other things.
These people are not making any point, they are just being disrespectful.
I did not witness Collin Kaepernick’s initial act of kneeling during the National Anthem. If I had, without knowing why he was doing it, my reaction would have been negative.
Now that I know, I still get a bad feeling in my stomach when I see it, but I understand why and defend his right to say it.
Here is what the law, passed by Congress, actually states about the National Anthem: “Title 36, U.S. Code § 301 - National anthem (a) Designation.— The composition consisting of the words and music known as the Star-Spangled Banner is the national anthem.
(b) Conduct During Playing.– During a rendition of the national anthem –
(1) when the flag is displayed –
(A) individuals in uniform should give the military salute at the first note of the anthem and maintain that position until the last note;
(B) members of the Armed Forces and veterans who are present but not in uniform may render the military salute in the manner provided for individuals in uniform; and
(C) all other persons present should face the flag and stand at attention with their right hand over the heart, and men not in uniform, if applicable, should remove their headdress with their right hand and hold it at the left shoulder, the hand being over the heart; and
(2) when the flag is not displayed, all present should face toward the music and act in the same manner they would if the flag were displayed.”
Individuals in the uniformed services have their own orders and know what to do; they don’t have a choice. Note, however, that (b)(1)(B) reads: “members ... may render the military salute ...”. Also note (b)(1)© reads: “all other persons should ... men not in uniform ... should remove their headdress ...”.
The words “may” and “should” are not definite. They imply a voluntary act. Also, this US Code § 301 does not set any penalty by law for any violation or non-observance of this law.
Neither Kaepernick nor any other NFL players or owners have been arrested or charged with any crime for taking a knee.
Now, the Constitution of the United States, specifically, the 1st Amendment protects “Freedom of Speech.” It has long been established in constitutional law that physical acts may constitute a communication or “speech.” Examples may be burning of an effigy, a public demonstration, and so forth.
Taking a knee during the National Anthem is certainly a public demonstration and it falls under constitutional protection.
Collin Kaepernick and all the others taking a knee are exercising their constitutional right of freedom of speech. Since when is exercising a constitutional right disrespectful?
Is a man who, when arrested, refuses to speak being disrespectful when he exercises his constitutional right against self incrimination? Since when is exercising any constitutional right un-American?
If any American fails to exercise a constitutional right, or avail himself/ herself of it, that person is effectively giving up a constitutional right. In other words, he/she has no rights!
While the law does not “punish” anyone for these actions, the NFL has taken it upon themselves to do so. I say to the NFL that this punitive action is un-American.
All of us have the right to our feelings, but we should not condemn any for exercising their rights under our constitution, the supreme law of the land.

Thank you for your service, i totally agree with you. However, we cant even teach our youth to use crosswalks, and we want them to respect a symbol?
I once had a student in my government class that would not stand for the pledge. I told her I had to stop if and when I crossed the bridge when the Mexican flag was being lowered and so she had to stand out of respect for our flag. She told me she did not pledge her alligance to any flag other than the Mexican flag. I spontaneously answered, "Then don't stand in line at noon at the cafeteria to get your free food!" I wish I had not lowered myself to her level, but when you find yourself in a rage you say things that later may come back to haunt you. However, I still think I needed to defend my flag. She later sat in class covering up a small novela book with her classnote book as I lectured to the class. I went around the back of the room and came back and removed the novelita from her and threw it in the trash. When the bell ran, she came to take it out of the trash can and told me it had cost her money, and I, the grown up, had to tell her, "Para los pesos que pagaste!" 50 years later I am sure I would have done the same thing, for my flag deserves more respect than some of us human beings deserve, including myself. There are many flags in many lands, there are flags both old and new, but there is not flag forever grand, like our own flag, red, white and blue. My music teacher at Putegnat taught us that song way back and we sang it with pride and respect.
Pinche pendejo maestro just like a teacher. Defend your beliefs against another adult not a student. I hope they fired your ass and you are not a teacher anymore memso.
If I was her dad I would have gone to her school and beat the crap out of you estupido, all this time and you still haven't learned anything.
Mr. Barrientes needs to educate himself on the United States Constitution. The Bill of Rights which includes the 1st. Amendment guarantee of free speech, protect people from the government. It does not protect people from their employers or the wrath of the general population.
These kneelers have no Constitutional free speech protection. They would have if the government tried to sanction them, but it is not the government lighting their asses on fire. It is their employer and the fans.
Sadly, Mr. Barrientes is not the only one who is ignorant about the United States Constitution. This kind of ignorance is rampant.
Bravo !
As a Veteran , I agree but do not believe these "football entertainers" have any right to disrespect the flag the millions of young boys and women that have died for you and I.
I no longer watch NFL football.
I don't understand all the commotion, these players are employees of the NFL and if your employer tells you to do something, you do it. Plain and simple!! In any job, your employer can fire you for insubordination, but these guys think they're special because they make millions of dollars!! I dislike Trump and I didn't vote for him... but I agree that if you're not going to respect a symbol of this country, then GET OUT!!
Racist redneck hillbillies don't concern yourselves your racist republican president will fix this situation, he'll just simply eliminate all your rights and all your freedom of speech.
The racist "beaner" who wrote at 6:51 on June 18 about "redneck hillbillies", reinforces the idea of racism in the RGV. There are a lot of Hispanics in the RGV that support the patriotism of the veteran who wrote this article. The flag is a symbol of this nation. For those who a Mexican patriots, they should move south...but they won't because they like the freebies on this side of the border. As a veteran myself, I support the vet who wrote this article and am proud to honor our nation's flag.
Racist hillbillies is why we have food stamps and all those freebies. They marry within their own family and are the dirtiest people on earth. Cracker face fagot. When ever there's a war you idiot hillbillies head to canada or even mexico, so don't tell me about patriotism idiot mental retard.
Comments at 6:51 is not referring to any patriots so what are you talking about maybe you are the racist here and using the veterans as your reasoning to spout your racial anger.
Racism in the valley? what are you talking about that there is no racism in the USA only here.
There are more veterans in the valley than any where else in the USA per captia per area. When ever there is a war more hispanics enlist than any other racer percentage wise.
Who the hell do you think you are?
Begal sucking SOB...
The killing of blacks by police is not racially motivated according to poster at 1:12pm. Racism only exist here in the valley according to poster at 1:12pm. Racism by a hispanic constitutes racism against veterans, he is teaching the valley about flags and symbols and patriotism. If you don't agree you should move south and no longer qualify for freebies as you will be on the other side of the border. We should be proud and very fortunate to have this commenter at 1:12 pm because he supports our veterans and is proud to honor his nation's flag.
Well goollie Mr. we all appreciate and thak ya for ur support don't know what we would have done without ya.
Thank you for calling us beaners, racist, freebie deadbeats and specially unpatriotic...
specially coming from a non-racist.
The gringo is quick to call everybody else racist but himself hypocritical
A national day of protest has been planned for June 30
