CITY LAWYER SELECTION DELAYED TWO WEEKS; NEECE BLAMES DE LEON, MARTINEZ STALLS FOR MORE TIME TO MAKE CHOICE

After what was likely a verbal battle in Executive Session, Brownsville's city commissioners entered the chambers one by one Tuesday night, not looking happy.

Not actually having attended a commission meeting personally in a couple years, only viewing on Brownsville TV, it felt like I'd traveled in a time machine. The mayor and commissioners seemed shockingly older than I remembered.

The obvious discord from Executive Session spilled over into Action on Item Discussed in Executive Session, Item A: Consideration and possible ACTION to hire a city attorney, the candidates being Lysia H. Bowling, Rene E. De Coss, Gerry Linan and Aaron Leal.

Mayor Tony Martinez moved that the item be tabled, since only one of the candidates had been fully interviewed, another partially interviewed and two candidates not interviewed at all.

The motion to table failed, with, at least, Commissioners Longoria, De Leon and Tetreau-Kalifa voting "nay."

"I don't see how we can proceed with a selection before we interview all the candidates. It's simply not fair," Martinez said more than once.

Commissioner Neece reintroduced a Motion to Table, but that also failed.

Neece then whipped out a prepared statement and began reading, obviously angry.

Neece cited the termination of the previous city attorney in August 2017, the formation of a search committee October 2017 with Commissioner De Leon as chairman. Neece named himself as part of that committee as well as prominent locals including judges. Neece claimed one of the candidates did not even have a law licence, but was simply a law school graduate.

"The committee didn't have its first meeting until April of this year," Neece claimed, "with only six meetings scheduled and the chairman not present for two of those meetings. Commissioner Tetreau-Kalifa did not attend any of the meetings."

Commissioner De Leon asked for the opportunity to respond and denied most of Neece's claims, calling one an "outright lie."

De Leon said he had no part in formulating a job description for the position, leaving that up to HR, Human Resources.

"I'm tired of the personal attacks," De Leon added.

Commissioner Neece nervously played with a rubber band during De Leon's response.

(At this point, I went back to the man and woman videotaping the session, asking if the volume on the public address could be turned up. They said they had no control over that.)

Commissioner Tetreau-Kalifa made a statement, then left abruptly.(I decided to leave as well, frustrated over the amateurish use of the public address system. Several of the commissioners are lawyers and are clueless about use of the microphone, let alone articulation, enunciation, etc. The interim city attorney sat on a table with two microphones and spoke directly between them, not being picked up by either. LOL)

Tetreau-Kalifa was in the hall outside chambers.

"Were you angry?" I asked.

"No, I just went to get my phone," the commissioner responded.

"We're hemorrhaging money paying outside attorneys to handle lawsuits, over $150,000 so far this year. We get billed for 30 minutes just asking a question," the commissioner added.

"Martinez and Ben are dragging their feet intentionally because they want someone else, not on the current list of candidates, to be city attorney. They are hoping for a new commission in May that will go along with their plan."

Local attorney Gerry Linan approached. He said he was the candidate fully interviewed. Rene De Coss, who spoke as he passed in chambers, was the one partially interviewed.

The City of Brownsville has been totally dysfunctional for some time with no City Manager, no City Attorney and several critical city positions manned by interims.

Commissioner Tetreau argues that the city is hemorrhaging money, yet sits on the GBIC board that signed a quarter-of-a-million-dollar contract for its new executive director, a salary fit for a City Manager.

She stated numerous times that she was pushing for a city attorney to be selected last night because she was tired of wasting money on contracting out. If she were so concerned with the expediency of the selection process, she should have cared enough to attend the hiring committee's meetings that she was a member of. She did not attend a single one. Where was her concern then? Where was her love for Brownsville (as she embarrassingly repeatedly professed at last night's meeting) when she refrained from participating in the committee's process she agreed to.

Seems it was business as usual. If you haven’t realized it by now, all of the city commissioners are incompetent in performing any type of job. Second, they have their own agenda of who they pick for this positions (a friend, compadre, family member, etc) that will do their bidding. They don’t look after the public they were elected to represent but only themselves. That is why Brownsville is falling way behind to other valley cities. To make matters worse, we keep voting for them.

A really good example of why more than 1 atty should not serve on a city commission is the Brownsville City commission. Juan, Can we pass an ordinance to remove all but 1 atty from the commission? It sounds like the compadre system is in full swing as long as Tony Martinez is successful at keeping attorneys out of the city.

Once again we have a situation which proves there is absolutely no leadership or positive management ability from our Mayor, Tony Martinez. As usual, he wants a "yes" man/woman to be the City Attorney. Since Rene de Coss ran as a Republican in a previous election, you can be sure that Tony, an "I love Obama" Democrat, doesn't trust any Republican....even when Rene is probably the best legal mind of the group. Tired of hearing de Leon's name....he is a racist....by his own words and should not be allowed to serve as city commissioner. But, de Leon carries water for Martinez. This city commission can't make good decisions....so we will continue to have an interim City Attorney as Tony Martinez takes swirling down the toilet.

We know that the citizens of Brownsville seem to accept corruption among its elected officials, but never have the citizens sat back and allowed a totally incompetent mayor to just stop the city government from getting anything done except build bike trails and spend tax dollars without positive results.

@12:34 There is no "interim" atty. The last one on the payroll left in July. Management is a shambles, and only the cabler cronys are the ones hanging around.

I hope all the applicants saw what a dysfunctional city is by last nights meeting.

There is attorney's on the commission??? Even if you combine the 3 that are on there, you couldn't get 1 semi decent attorney! The 3 attorneys on there are a bunch of idiots! Ben is fucking high as a kite all the time, (City Manager should drug test commission every now and then, just sayin) who not only wants to please Tony all the time, but walks around like he's the best thing to ever happen to that commission, get over it Neece, you're not! Cesar...hmmm....does Cesar even know who to spell attorney, I'm sure he knows how to spell RACIST, that little kid hasn't tried one good case all his crappy career....oh but he could dance circles around Sossi, Morado and all those attorneys...the ones who actually know what they are doing right! And Tony...the bar should have a time limit as to how long one should be considered an attorney after not practicing for many years....when was his last case....1980?!?!?! How old is he like 100?? He needs to step down and stop thinking he is making Brownsville better...oh and he needs to change his wardrobe every now and then...he's a dam Mayor, put on a tie every know and then idiot, look decent, presentable, something...at this point Erasmo is looking better than him!

There should be a drug and alcohol test every day at the court house for every lawyer attending the court, there are more lawyers attending court each day under the influence of drugs or alcohol, or both. This will include the DA'S office the court could then fine the law firm that fails the test for all costs. So do not use Rene Oliveria, as you will never get your case heard.
