WOMAN ON QUEST FOR JUSTICE OVER DOG SHE RESCUED

(This story was originally scheduled to be posted Monday, but medical issues prevented the interview from happening. We post it here today. It may be slightly long, but details offer an important message for animal lovers in the city. Get your Kleenex ready.)

If a Brownsville resident ever comes upon a wandering stray animal, Yolanda Speece hopes that they won't be subjected to the same treatment she got from the Brownsville Police Department and its administrators, including the Chief of Police.

 Speece found a wandering German Shepherd on January 2022 in front of her workplace near the Cameron County Courthouse in front of witnesses and took it home to shelter it in hopes that she would eventually find the owner. During that stretch of time – 88 days, or about three months – she was unsuccessful in finding the owner despite walking the dog multiple times in the area where she had found her.

Then two Brownsville police officers appeared at her house demanding she hand over "Dobie" because Samantha Nathaly Vargas, who claimed the dog belonged to her grandmother Manuela Pilar Vargas who she said lived at 700 E. Polk, although a private investigator found that the elderly woman lived in El Paso, Texas for the last six years and that the property mentioned in Brownsville is empty.

Based on her experience, she says the Brownsville Police Dept. showed her that they are ignorant of the law and enforce it as they see fit despite their actions, apparently violating people's rights. Specifically, she said that.

* BPD officer Efrain "Sonny" Cervantes violated police protocol and capriciously took the law into his own hands by pressuring her to hand over Dobie despite city ordinances that state that animals at large or abandoned become the property of the finder after harboring the animals for three days and are legally defined as owner from there on.

* Officer Rolando Trujillo – despite being a veteran officer and the first on the scene at her home – allowed Cervantes to ignore the law and became a passive observer, the "good cop."

* The staff of the BPD's Internal Affairs Dept. referred her to Sgt. Cecilia Valdez. when she attempted to file a complaint against Cervantes. When Speece asked how she could go about speaking to her, they had Valdez call her. Speece said she wanted discretion and Valdez agreed to talk to her at 5 a.m. at the PD. That attempt at discretion was in vain because their conversation was adjacent to a group of detectives at the station. She said Valdez  refused to take the report and abused her verbally and escorted her out of the police department. When Speece asked her how to get the body cam footage of the officers, she, in turnn, sent her back to Internal Affairs. Speece said Valdez told her she had no rights and said she did not see that Cervantes had done anything wrong. 

* Det. Rey Ordoñez – who Speece was told she would need to speak with in order to justify a property hearing before municipal court –  said she had no case because, according to the flawed police report filed by Cervantes - indicated that she had voluntarily surrendered the dog.

* When she tried to relate the facts to Lt. Napoleon Gonzalez, he basically said he didn't want to hear her "rant" and ignored her and hung up the telephone on her.

* A Det. (Sergio?) Perez told her that the alleged owner of the dog – Samantha Nathaly Vargas – had told him that she no longer had the dog and that she had lost her when she was allegedly involved in a phony drive-by shooting incident. Vargas claimed that she and her family had run for their lives amidst gunfire to escape and abandoned Dobie. She claimed that when she returned two days later the dog was gone.

* On July 14, 2022, a property hearing was held before Municipal Judge Rigoberto Flores who awarded Speece ownership of Dobie. Vargas defaulted by not showing up.

* On July 19, Speece was getting ready to address the Brownsville City Commission about the situation and was deterred by Commander James Paschal who promised to take a personal interest and would help her. In the end, he discouraged her, and eventually changed his tune and did nothing. 

 * On July 28, Paschall called Speece and Animal Control Supervisor Robert Dippong who said Asst. City Attorney Jennifer Avendaño told him that the city's legal definition on the municipal code are not enforceable. Speece later found out that Paschall had contacted Vargas on the case and told her she needed to be present for the small-claims hearing. When she attempted to represent herself in a justice of the peace court, she was told she needed an attorney.

* When Speece attempted to hire the services of local attorneys she found out that no one wanted to take the case and that one she paid $2,500 locally only offered a limited scope representation. Out-of town attorneys wanted $5,000 a day for their services. Many claimed that the city had qualified immunity and were not going to take it.

 Now, with Dobie gone, and the police unwilling to enforce the law correctly, she wants Brownsville residents to be aware that if they expect the police to do the right thing, they are in for a rude awakening. That is why now she vows that she will go before the city commission until something is done. She said she is far from finished trying to find Dobie and reclaim her and says that this is not the last the city will hear from her.

When she spoke to then-At-Large-A commissioner John Cowen, he told her that it was inappropriate for her to talk to him about it and suggested she sue the city despite it having qualified immunity.

"I really expected that the city would have done right by me or any other Brownsville resident," she said. "Right now it is clear that my dog was stolen and that the BPD aided and abetted in the theft because of their ignorance of the law they are supposed to enforce. It breaks my heart not knowing whether Dobie is alive or dead and suffering somewhere without  the love that I had for her and still have for her. I hope she is safe wherever she may be."

Yes, but you have to show that you posted flyers around the neighborhood, then you have to talk to your neighbors about it and then you contact the animal shelter.

The Bottom line, most people in Brownsville do not like dogs. Just go around and see that dogs are abused.

Tied to trees with chains for years.
Out in the heat and cold all year long.
Never taken to the Vet.
Reason: time and money.
Who has time to be with dogs and spend money on a dog.

Kids love video games, tv, internet.
Moms have to go to the gym, pool, shopping etc to be stressful.
Dads want to see the football games etc

Brownsville's finest have a couple of weeks training.
Then they enter the FORCE where some cops have power and others do not.
That is why they can not be neutral. They take sides: ( I go with the powerful and stay away from the GOOD cops...they do not get to the top).

They favor their friends, men...
If possible solve your issues on your own, do not get the police involved.

Police believe the criminals. The victims do not know how to manipulate the cops.

1. You have the right to remain silent. If you wish to exercise that right, say so out loud.
2. You have the right to refuse to consent to a search of yourself, your car or your home.
3. If you are not under arrest, you have the right to calmly leave.
4. You have the right to a lawyer if you are arrested. Ask for one immediately.
5.Regardless of your immigration or citizenship status, you have constitutional rights.

NOT IN BROWNSVILLE
1. Speak , the police officers are your friends.
2. Do not do this. It is fake information that the cops plant drugs in your car. That only happens in movies.
3. Do not do this. You can be arrested or shot.
4. Lawyers will not help you.
5. Not in Texas.

Brownsville and Texas go by other laws. Protect yourself from the bad hombres.

If You Are Stopped in Your Car
1.Stop the car in a safe place as quickly as possible. Turn off the car, turn on the internal light, open the window part way and place your hands on the wheel.
2. Upon request, show police your driver's license, registration and proof of insurance.
3. If an officer or immigration agent asks to look inside your car, you can refuse to consent to the search. But if police believe your car contains evidence of a crime, your car can be searched without your consent.
4. Both drivers and passengers have the right to remain silent. If you are a passenger, you can ask if you are free to leave. If the officer says yes, sit silently or calmly leave. Even if the officer says no, you have the right to remain silent.

A. If the police or immigration agents come to your home, you do not have to let them in unless they have certain kinds of warrants.
Ask the officer to slip the warrant under the door or hold it up to the window so you can inspect it. A search warrant allows police to enter the address listed on the warrant, but officers can only search the areas and for the items listed. An arrest warrant allows police to enter the home of the person listed on the warrant if they believe the person is inside. A warrant of removal/deportation (ICE warrant) does not allow officers to enter a home without consent.
B.Even if officers have a warrant, you have the right to remain silent. If you choose to speak to the officers, step outside and close the door.

HINT: When the police chased a drug dealer and he ran into his home....the police could not enter the home.... permission was not granted. Some people know the law.

If You Are Arrested
1. Do not resist arrest, even if you believe the arrest is unfair.
2.Say you wish to remain silent and ask for a lawyer immediately. Don't give any explanations or excuses. If you can't pay for a lawyer, you have the right to a free one. Don't say anything, sign anything or make any decisions without a lawyer.
3.You have the right to make a local phone call. The police cannot listen if you call a lawyer.
4. Prepare yourself and your family. Memorize the phone numbers of your family and your lawyer. Make emergency plans if you have children or take medication.

QUESTION: When you are arrested, do they order you to get naked? not in the police car but at the jail/prison?

If You Are Stopped for Questioning
1. Stay calm. Don't run. Don't argue, resist or obstruct the police, even if you are innocent or police are violating your rights. Keep your hands where police can see them.
2. Ask if you are free to leave. If the officer says yes, calmly and silently walk away. If you are under arrest, you have a right to know why.
3. You have the right to remain silent and cannot be punished for refusing to answer questions. If you wish to remain silent, tell the officer out loud. In some states, you must give your name if asked to identify yourself.
4, You do not have to consent to a search of yourself or your belongings, but police may "pat down" your clothing if they suspect a weapon. You should not physically resist, but you have the right to refuse consent for any further search. If you do consent, it can affect you later in court.

NOTE: Most people in Brownsville behave good with the police. We are afraid of the police so we consent, answer all questions etc Remember, only criminals know how to play the police officers. The rest of Brownsville get in trouble with the police because we consent, we talk, etc

Example: the chick lied to the police about her mother, her address and that the dog was stolen by opening the gate. The mother lives in El paso, the address is a vacant lot and the dog escaped from her and she never looked for the dog. Police officers are treated like babies by criminals. LOL In Spanish it is: Se los chamaquearon. LOL

PERFECT

Samantha Vargas declares the dog escaped AGAIN when she was part of a drive by shooting. Samantha Vargas ran for her life and saved her family but NOT the DOG. Detective Perez believed Samantha Vargas.

It happens...
Then the judge gave Speece the dog but Samantha Vargas did not show up to court.

It happens...

The police is busy doing other important work...they do not worry about dogs that escape from Samantha Vargas.

HINT: Samantha Vargas has the dog. She sold the dog. She sent the dog to El Paso etc. What a clever lady, interview Samantha Vargas and find out how she did all this.... It is good to know how to fool the police.

A therapy dog was honored at a high school graduation for being an extra good boy.
Here they are sent to the cops for re-training as look-outs to warn of discovery of any bad feelings. Hurting a cop's feelings will become a felony and punishable by serving jail time up to a year.

The police can commit a crime and ARE ABOVE THE LAW and free of prosecution.
The city can commit a crime and are above the law as well and free from prosecution.

That is probably why Cowan told Yolanda to sue the city. He knew because his uncle is an attorney, and he figured she would go away.

How can citizens feel safe? If they are protecting a thief, think about how many drug dealers, murderers, rapists, etc. they are protecting? STILL FEEL SAFE? Sorry, your guns won't protect you because police will arrest you for murder. Trust me, I have experienced their idiocy in other ways not just with my dog. I can tell you about all the lies but especially the lies that have been coming out of the BROWNSVILLE POLICE DEPARTMENT concerning this. If they are lying about something as insignificant as this, maybe you all should be concerned that they will lie about anything including MURDER! I hope you or your loved ones are not on the receiving end of that! WORRY!

There were other details to this that Montoya didn't have enough space to clarify because attention spans are too short.

I won't hide even though the police are following me and trying to discredit me any way they can.

It doesn't just happen in the movies! This is real life and the police in Brownsville are corrupt... The city attorneys are protecting their crimes and that should concern you!

I know a lot of you are ready to attack because you THINK you see blood in the water but it isn't my blood. It is BPD's.

You need to pay attention.

BTW I am going to be at the BROWNSVILLE CITY COMMISSION ON JULY 11. If you want to talk to me, I will gladly do that. I want to keep talking to the city commission because they are either going to get tired of me or people are going to start paying attention and DEMAND MORE FROM THE CITY LEADERSHIP AND THE POLICE!

THAT IS WHY IT IS DANGEROUS AND THEY NEED MORE TRAINING! TWO WEEKS ISN'T ENOUGH. THAT IS OBVIOUSLY CLEAR. IF THEY ARE MAKING MISTAKES OVER SOMETHING LIKE THIS, THERE IS NO TELLING WHAT KINDS OF MISTAKES THEY ARE MAKING OVER TRAFFIC STOPS, DOMESTIC ABUSE, MURDER, TELLING PEOPLE THEIR RIGHTS OTHER THAN MIRANDA, ETC.

MAYBE THEY NEED MORE AND BETTER TRAINING BECAUSE IF NOT THAT MEANS BROWNSVILLE RESIDENTS ARE IN DANGER OF POTENTIALLY BEING HURT OR KILLED! Didn't someone say something about Trujillo AND HIS FATHER killing residents and they got off! Doesn't this concern you more than picking on a victim?

THEN YOU NEED TO FACTOR IN THE WHOLE LANGUAGE BARRIER. ACCORDING TO THE CENSUS, THERE ARE A LOT OF PEOPLE THAT DON'T SPEAK ENGLISH. THOSE PEOPLE ARE PROBABLY EVEN MORE IN DANGER OF HORRIBLE THINGS HAPPENING TO THEM BECAUSE POLICE DON'T KNOW THE LAW.

THEIR JOB IS TO KNOW THE LAW. They are enforcing it. It is like telling a teacher he/she doesn't have to know how to teach. Teachers go through a year of training and then there is continuing education. Police have continuing education. so if they have all of this training, how could they break a law like this one? Because they don't know the law.

That is dangerous that the police who are supposed to be enforcing the law DO NOT KNOW THE LAW. That means THEY ARE BREAKING THE LAW and that means residents are not safe!

True, since my first encounter with a cop when I was in jr hi all he was using was cuss words and since then they haven't stopped. It seems that they are train in the jungle in africa of in a muslin country or even in south america BUT NOT HERE. No body that I know uses cuss words like these changos do.
The ALL need to be re-trained and EVERY six months cause they go back to do their normal shit.

God created dogs and cats. They are defenseless and this creates a problem for human beings. Do I protect a dog? Do I protect children? Do I protect my husband / my wife?

You have a choice and that makes a difference.

I know of three dogs that were stolen. They escaped from their owners, they ran around the neighborhood, a guy in a truck saw them, and opened the door and the dogs went inside the truck.

The owners (MEN) went looking for them...the dogs were never found.

They were big dogs, almost unique here in Brownsville....to me they were just dogs: uno chato y el otro blue heeler dog. Los dos mansitos.

I have always admired the young men that are stopped by the police and are ordered to sit on the edge of the street with their hands behind their back.

The cars are always sports cars.

GUILTY: The fathers that help their sons to buy a sports car.
GUILTY: The moms that that tell their kids go and get me tortillas, pan dulce, etc and the kids go in their red cars to buy a RASPA for MOM.

ENVIOUS: the police officers that see a sports car being driven by a CHAMACO with free time

WINNER: the CHAMACO that know that the police officers are jealous and they stay calm and are polite to the police officers. IT IS JUST A TICKET.

PRICELESS: The grandmother that pays the traffic ticket and tells the CHAMAQUILLO "igualito a tu abuelo mijo" and prays that the NIETO is always SAFE on the roads.

Someone was asking if Vargas was pretty! She was not. She was on the heavy side and she had a butter face.

Maybe she serves in other capacities. IDK that is a question to ask CERVANTES because he defended her and apparently because of him, they are defending her and covering for HER CRIMES!

Stealing a dog is a crime. So is filing a false police report.


Oh and I was also told after she lost the dog that it was a "civil" matter and they were out of it.

The thing is this happened BECAUSE OF THE BROWNSVILLE POLICE DEPARTMENT'S INCOMPETENCE AND NEGLIGENCE AND IGNORANCE OF THE LAW!!!!

Like I said, if they are ignorant over this, what else are they ignorant about and how many people have suffered because the BROWNSVILLE POLICE DEPARTMENT IS INCOMPETENT AND DOES NOT KNOW THE LAW!

PLEASE come to the next city commissioner's meeting on July 11. Feel free to talk about how you were wronged by the police department. if you know of someone who has experienced something bad at the hands of the BROWNSVILLE POLICE DEPARTMENT because of FAULTY TRAINING, then the city commission needs to hear this.

Bekah Hinojosa is an ideal example of this foolishness.

TINO is being sworn in. Make this an event for them to remember! They need to know that the city is broken and they need to fix it. PLEASE speak out. It is nice that you are doing this here but the commission needs to hear how the police don't know how to treat us

On the question about qualified immunity, and what it is, this is immunity for local governments in the state of Texas, other states have similar immunities, but this is for Texas. The law prevents them for being sued for simple negligence. To make this easy to understand, imagine a slip and fall during an arrest that causes injury, such as a broken wrist, or lacerations, requiring stitches and medical cost. The government cannot be sued for this. The police may have been negligent, but the immunity prevents the lawsuit. Now if the police used excessive force, that would constitute gross negligence, and there is no immunity for that. The government can be sued. This is the case in many of the television reports of police abuse, those stand up in court, because the gross negligence evaporates the immunity law. This is why students that slip and fall and hurt themselves at a public school cannot sue the district, even though the district had an opportunity to keep the floor clean that is not gross negligence.

just because of qualified immunity, doesn't mean that police and city employees SHOULD NOT DO THE RIGHT THING! Their servant leadership philosophy is WORTHLESS when they break the law and then don't try to fix the problem. If you break your ankle during an arrest, they should pay for the hospital bill. If they steal your dog, they should apologize for FUCKING UP and then replace what they stole.

Their motto concering working with the community is a good philosophy but it looks like those words have GONE WITH THE WIND!

Their philosophy is useless when they abuse the person seeking justice and not receiving it!

It is even more USELESS when the city attorneys and government DEFEND that.

the city needs to start looking into ANY NEGLIGENCE no matter how small. If they fucked up, they should fix it. If they don't fix it, then they are in the wrong!

Human beings, we tend not to be logical and calm when we are upset, angry and facing problems.

Divorce couples: they go crazy when they think of the best years and the money they gave their wife/husband and then they were abandoned.

Parents: they give their best to their kids....the kids crash their car, use drugs, and alcohol....parents GO CRAZY.

Brownsville locals do not sound sane when they discover their taxes went up in fumes in: Tenaska, PUB rates, La Casa de Nylon etc

I would never take a police officer training LOCALLY. It is clear that it is the BLIND LEADING THE BLIND. I think police do what they want because their training is SHIT!


Maybe before offering these community courses, maybe we need to train the police officers first. Maybe the money needs to go into insuring THE POLICE DO THEIR JOB WELL! IF POLICE DO THEIR JOB ACCORDINGLY, THERE IS NO NEED TO TRAIN CITIZENS!
THE POLICE ARE BEING PAID, NOT CITIZENS.
